has not been leased for enclosure or cultivation

and hy special Legislative enactment, neither of
which has been obtained to authorize th« enclo
sure or cultivation of said common.
And whereas the City Council believe that the
enclosure add cultivation of the said South com
mon will prove injurious to the health jf the cit
izens generally.
Sec Ist. Be it therefore ordained by the City
Cduncit of Augusta, that it shall not be lawful for
any person or persons to make any fence or en
closure by ditch Os otherwise in any part of the
common of Augusta, South of Watkins Stteet
Sec. 2. And be It further ordained, that attjr
persou who shall make any enclosure or part of
enclosure under any pretence or in any manner
or form whatsoever, shall be fined in a sum not
exceeding one hundred dollars, for each and
every day such taclosUie, part of enclosure,
fence or obstruction shall remain.
Sec. 3 And be further Ordained, that each &.
every fence, ditch part of euclosure
or oMthiction shall be considered a Nuisance
and it shall be the duty of the city Marshnß *..4
all other officers of council to abate such nui
sance, by removing any fence or other obstruc
tion* made or found on any part of the said

TO THIS PUBLIC.
rpHE controversy between Ihe City, and the
J. 1 rustees of the Academy, haying become
one of tome interest to the citizens, the City
Council have deemed it advisable to give this
short notice to the public, of their reasons for
the above Ordinance, and the necessity which
called for it.
Ihe City Council have been advised •'and be
lieved, that when Augusta was laid nut and plan
ed by the ptoprietory government, the common
was defined and appended to the town, for the
common benefit of the lot holders, and citizens ,
as the word “ town common,” itself seems to
import.
That being thus appropriated to the public,
or common use of the ettiaeus, this right has
never been taken from them by the legislature,
or abandoned hy themselves. Nor has any act
been passed, interfering with the right Os com
mon in the ciiizens, except at their own request,
or for their supposed benefit.
That the power to lease given to the trustees,
was to lease for seven years, and has long Aace
expired, and bring then given te promote the
health of the city, at thejrcgueet of the citizens,
should not now toe exercised, when experience
has shew that the enclosure would most proba
bly be tnjuiious to the health of the city, and is
therefore opposed to the wishes of the citizens.
That the City Council, have not abandoned
the rights of the citizens by paying for a few
years for their own property, in ignorance or
neglect of the rights of the citizens, which they
failed until recently to investigate.
That this neglect it less extraordinary than
the unwarrantable assumption of a fee simple
title in the trustees, when in fact they never
were appointed any thing more than
agents of the state to lease.
'1 hat the trustees are themselves conscious
that they have no legal title to the common, is
sufficiently manifested hy the desperate step re
cently taken by them, of causing the common to
be run out as vacant land, under the law Secure
ing head rights.
The City Council acting only as ti.e guardians
of tha rights of the citizens, expect their rea
sonable co aperatioj) 1,1 the maintainance of
their rights.

ETThr Beard of Trustees of the Academy of
Richmond County, have noticed with siltprise
the caution inserted by the City Council of Au
gusta, in the Gazettes of the city, against any,
persons renting the Cohiidon from the Board
which is held by them in Trust for the use of the
Academy aforesaid. This caution is the more
extraordinary, inasmuch as the City Council
have been for tt}Z last ten yfeafs up to the Ist
inst. Tenants of the Trustees of the very Com
burn referred .o—and alsti, that within the last
I two weeks a negociation hat been .pending be
tween the parties f«r a further extension of the
lease- The Tfustees deem it only necessary to
advise the public, that lesseeaOf any portion of
the aforsaid Common, will be protected in the
enjoyment of their rights, by a couvenant set
forth in the deeds of lease from the Trustees to
that effect
The Common will be offered for Lease on the
first Tuesday iu February next, as previously
advertised.
