Jn what i have said respecting rents, I wish
tohedistinctly understood, 1 have spoken hegp
tofore in general terms—as if the premises from
which they arise, were now in the same condi
tion, as they were -»hen mortgaged—in other
words, as if they had been built upon when mort
»ageil; in tlwt case, the whole of the rents would
have been liable to lie credited on the mortgages
as well wltal tube* front the lots of the purchas
ers, as from those retained by St>ultz. As it is,
all the rents arc of legal I’tgui by tbe
receivers; but 1 do not think the whole of them
are to be credited on the lieps. I think (Lut
with hesitation) that there is a wide distinction
between the cases of Shultz ami the lot purcb
eseri—Shultz owed the debts, secured by the
mortgages. The whole of the rent*, arising
from lots retained by bint, ttowever paiich en
hanced by improvements put by him ’on ’then)
after tbe execution of the mortgage, ought to tie
credited mi tlieru But the lot purchasers do not
own the debts. If tbe cred tors get the amount
of rent from their lots, corresponding to their
situation, when Shultg parted from them, tlieii
