debtor, his chance of obtaining any part of

selves. This certainly embarrasses the

would not be under an uniform and univer
sal system of Bankruptcy, known to even-

insolvent law;;, and which they arc entire
ty Jy incapable of correcting, is the universal
practice which, ve are informed, nc:v pre
vails, of debtors holding the absolute con
trol and disposition of i'*ir effect-; mak
ing their own tenm* with their cieditors;
giving what they please and to whom they
please, and setting all ju jtice in the distri
bution of their property at defiance—they
will give yon this much or that much, pro-
tided you will sign an absolute releasef
or provided you will let them retain this
or that part of their Cstale, &c. In abort,
the creditor, knowing that the whole game
is in the hands of his debtor, generally
fakes whatever it may please him to give,
snd on such terms as nc may choose to
dictate. It may be safely asserted, that
there is scarcely a case of insolvency
where there is not some fraudulent assign
ment ; some partial and unjust preference;
mid some abominable exclusion of perhaps
the most, honest and most needy creditor^
of the insolvent.
If the merchant fails, and the firmer
comes to the city to look after his effects,
he now finds it“ swallowed up by assign
ments and judgments, given to more press
ing or more favoredfereditiors; ami he
must sit down with a toVUoss. Under the
equal juatice of a banket law, this ini
quitous juggling is prevented and punished,
and every creditor- receives * fair propor
tion of tliat utterly, on the faith of which

some endorser, whose only merit had been
to lend his name to prop up the bankrupt,

We would only add, that if the passage
of the law is in a great degree indifferent
to certain parfs of the countiy, where it
will have but little operation; and is loud
ly called for—nay, earnestly implored, and
imperiously necessary for other portions of
our union, it would seem that a fair and
liberal Writ ofjpmproqilso an< * mutual ac
commodation would Induce the geutlemcn
who represent these fortunate districts-—
for fortunate they certainly arc—to indulge
thdir brethren --L-ith a-measure which they
at least believe essential to their prosperity
