the commissioners appointed by the last Legisla
ture to sell the fractional surveys, to expose to
s ite all the fractional surveys lying in the county
of Walton, which was within the ninth district
formerly Hennr- county, the commissioners afore
said will offer for sale in the town of Milledgeville,
on Mon lay the 9th day of February, 1824, the foL

of originally Henry, now Walton county.
The aforesaid fractions to be sold on the same

William I- Sims and Margaret Sims, on the 3d day
of June, in the year eighteen hundred and twen
ty, to secure, unto the said James Roberts, the
payment of a certain promissory note, drawn by
the said WiHiurm 1, Sims on the said third day of
June, the said year, in favour of James Roberts,
nr order, for ihe sum of six hundred and thirty
eight dollars, an;l eight cents, payable on the first
lay of January in the year eighteen hundred and
twenty two, to wit; nil that weal cm moiety or
half lot, nf that lot of land in the city of Savan
nah, in Oglethorp ward, known and distinguish
ed in‘he plan of said city by the letter Q, toge-

said western moiety.
It is ordered, on motion of Law & Jackson,
attorneys for plantin’, that the principal, interests,

O N the petition of Aaron CLveland and Susan
Os his wife, who was Susan G. Bona, statinu
that Jacob Fahm, before the intermarriage of'hr
petitioners, to wit; on the 22d day of June 1821,
did in conjunction with om. Joseph A. Scott, ex
ecute a joint bond to <hv a id Susan C. in tfie
penal sum’of four thousand dollars conditioned
for the payment of two thousand dollars with in
terest from date, on or before the first day of
March then next, and that for the better securing
the payment thereof, the said Jacob did on the
day ami year first aforesaid make his certain in
denture of mortgage, whereby he mortgaged to
said Susan C all that lot of ground known and
designated as Garden lot number thirty nine, No
39, and also, that adjoining half part of anothe<
lot known aa lot number forty two, No 42, con
taining together eight and a half acres more or
less situated to the East of the city of Savannah
and bounded to the north west of Lot No 26, (u
the South and East by lands belonging to the es
ta’e of Hampton Lillibridge, and the west by
the public road leading to 81ridaway island where
on a brick yard ia now established and known by
the name of Fahms brick yard—that there ia now
on the said bond or mortgage obligatory the sum
of eighteen hundred dollars with interest from the
23d day of January, 1823, and praying the fore
closure of the equity of redemption of th? said
Jacob and hia heirs, executors, administrators and
assigns in 8c to the saidmortgaged premises.—On
motion of W. W. Gordon, attorney fbr the peti
tioners—it ia ordered that the principal ana in
terest due on the said bond or writing obligatory
together with the cost of thl* application be paid
into this court within twelvemonths from this date,
or in case of default that the equity of redemp
tion of said Jacob Fahm, his heirs executors, ad
ministrators, and assigns be from thenceforth for
ever forclosed and that such further and other
proceedings be had thereon, aa are pursuant to
the statue in such case made and provided —
And it is further ordered that this rule be pub
lished in one of the Gazettes of this state at least
once a month for twelve months, or that a copy,
be served on the defendant at least six months
before the time appointed for the payment of the
money into court.

mortgaged by Matthew McAllister now deceased,
in his lifetime by dead of mortgage, dated on the
tenth day of March in the year eighteen hundred
and twenty three, to Matthew Hall McAllister his
heirs and assigns to secure to the said Matthew
Hall McAllister, the payment of certain promisso
ry notes made by the said Matthew McAllister to
the said Matthew Hall McAllister or order, for
the sum of five thousand dollars, wtiich said note
bears even date with the said mortgage and is nay
able at a day now past, and which said mortgage
and note were afterwards duly assigned, and in
dorsed by the said Matthew llali McAllister to
the said petitioners. And the petitioners having
further stated that there ia now due and owing
on the said note and mortgage the principal sum
of five thousand dollars with interest from the 30th
day of May 1823
On motion of Habersham for the petitioners, it
is ordered that the principal, interests and costs
due upon the said mortgaged premises be paid
into court within twelve months from this date,
or on failure so to do, the Equity of redemption
in the said mortgaged premises shall from thence
forth be foreclosed and such further and other
proceedings lake place as are in pursuance of the
statute in such case made and provided. And it
isforther ordained that this will be published in
one of the public Gazettes of ibis state at least
once a month for twelve inonlhs or a copy thereof
served upon the legal representatives of the said
Matthew McAllister, at least mix months previous
to the time at which the said money is ordered to
be paid into court.
