himself at least stimulated to greater exertions, if
not essentially improved.

ing is commendable in the highest degrec % nnd

THE TRIAL OF MRS. KINNEY.
Hntmah Kinney, charged with the murder of
her husband by poiren, wnsputon trial before the
Supreme Coral, its Boston, on Monday. Tho

called over, nud after the counsel for the prisoner
had challenged eight, the jury was empanelled for
the trial.

*T. Kinney, by mixing white arsenic with some
herb tea, which was given to him to drink.
The mercantile Journal give* the following
summary. of the case for tlie prosecution as stated
by Mr. Parker:
The prisoner was married 26th Nov. 1838, by
Rev. Mr. Blagden, nud was five years older than
.her husband. Mr. Kinney, during his sickness,
was exceedingly thirsty, and was advised hvan
attendant friend to take some herb tea. This
ten wsh prepared by the prisoner, who was .re-
? nested not to sweeten it.—His friend, Mr.
iondwin, who administered the ten, tasted of it
before he administered it to’tbe sick man—and tlie
email pnrtiou taken by Mr.'Goodwin, caused him
to fall sick.
There was a post mortem examination, and the
contents of the stomach were analyzed by Dr.
•Martin Gny. The post mortem examination was
made by Ors. B; 8. Jackson, Storer nnd Bige
low. On the question of suicide, Mr. John
Barnes will give innnirtant testimony, to show
that the deceased did not kill himself.

of discunsion has been held for the last twelve
years, without attaining any positive result*. We
think that 3Ir. Forsyth has explained mid
defended die American claims most successfully;
hut it would appear that the Administration of
Government true to its principle of notcoramtt-
ting itself in such.a manner as to run die risk
of losing votes, has been over cautious in its
mode of procedure.
Much remark has of late been excited by die
movement!! of British troops north of die St.
John, within die limits of the disputed territory.
The opinion is more and more confirmed among
die inhabitants of Maine, diat while ive are tie-

cuing her positions. She lias a post on the Te-
misconta Lake, only 37 miles from die St. Law-
rancc, and a good road thence to that river.
The fiict is that the British claim to the disput
ed territory is most unfounded. Even Sir Chas.
Buller iu his late article on diis subject in the
Westminster Review, conceeds that die claim
set up by Great Britain is preposterous. At die
same time, he regards die American claim rsiiii-
snpported;but,ui‘order touphold his assertion,he
is obliged to adopt tho singu Inr supposition dint die
meaning of the word sea is not only coextensive
with Unit of the words Atlantic Ocean, as used in
the treaty, but that it is actually the most com
prehensive term of the two. The language of
tho Treaty of 1783 is perfectly explicit nnd
moved from all ambiguity. The Highlands along
which die boundary line runs is defined to be—
the Highlands that divide those rivers that emp
ty tliciinudves into the St. Luwreuco, from those
dint fill into tlie Atlantic Ocean.
Iu the lirat place it is clear diat such n chain
of Highlands does exist. The nature aud
properties of water demand that where there
are two great basins, one inclined towards the

The place of the lauding was on a largo rock lit
the foot of a ciifl*, in the own of Plymouth, Mas
sachusetts, near the termination of tho north
street, lending to the water. In the year 1774,
un nttemjit was made to removo this rock, over
which a wharf had keen built, ton more central
situation. The rock was split in tho operation.
The upper portion of it wns removed nnd placed
near tlie Court House, and is regarded bv the in
habitants and by visiters, ns an invaluable me
morial of that grant event, thn arrival of the first
planters of New England, nt the place of their
settlement. -The22d of December, New Stylo,
corresponding to tlie llth Old Style, in Plymouth,
has universally tlm appellation of “Forefathers'
Day." The number of sealers wns 101. They
had sailed from Ply wouth in Uug’mul iu the. May-
flower, on tlie 0th of September. On thn 0th of
November, they discovered the land of Cape Cod.
Oft tlie llth of November, they formed them
selves into a body politic, and cl.ose Mr. John
Carver their governor for qne year.

tho British barque Ann Martin, arrived yesterday
from Kingston, Jamaica, we nre indebted for
full files of papers up to tlie Dili inst.
The idea was prevalent on the Island that the
crop of sugar this season would lie large’r than
that of thu last year. Other than this we do not
learn an item of the least importance.—Picayune.
Another Steamboat Accident.—Scnrcoly n day
has passed during the last two nr three weeks
llint we have not linen compelled to record
some steamboat futility. Three accidents were
chronicled yesterday, and wo are under the
necessity of adding another to the-list this after
noon. On Sunday night, the l’ntrick Hen
ry, Shaw, from Mnysville, came in contact with
the Maid of Arkansas, nt Tunica bar. The latter
wns stove in, forward of the cook-house, ran on
the bar. and sunk in live feet of water.—Native

CONGRESS.
In the Senate on the 23d inst. Sir. Williams
called up the hill proposing tho regulation of pay
anti emoluments of Pursers of the Navy, which
after some debate, together with a bill in refer
ence to Navy rations, were laid on the table.
The bill iu reference to Naval pensions wus like-
wise called up by the same gentleman, which al
so elicited some debate, nud on motion was post
poned to Wednesday, 30th inst. Several hills
were ordered to be engrossed—one for punish
ing certain crimes against the Untied States—one
for extending the time for completing the cen
sus, nud another to punish for tho counterfeiting
of. American coin. Others of less importance
were passed.
On the-4th, Mr. Buggies, from the Commit
tee ou Commerce, reported a bill for the belter
security t of tho lives of jiassengers on board of
steamboats, Mr. Benton presented u hill for
taxing hank paper in circulation in the District
of Columbia, nnd gave his reusons in fit II for pre
senting it, which after considerable debate, in
which Air. Clay of Ala., Calhoun, Webster, and
others participated, tho bill was laid on tho table.
The Senate then adjourned to Monday ,28th inst.
In the House on the 22d, Air. Aduuis present
ed a resolution calling upon the Post Master
General for information in reference to nil the
Postmasters removed since 1839, the cutises of
their removal.—Information ns to the fact whe
ther or not tlie removed Postmasters have hnd nu
opportunity to testify as to the accusations a-
gainst them—the resolution lies over for one day,
A resolution was udopted, inquiring of the
Clerk ns to the catiao of tlie falling of the Chan

Heavy Loss.—The Boston Transcript of Tues
day evening, says: "The British barque West-
minster, Mollison. front Singapore for Loudon,
with a cargo .of 4600 chests nt tea, was driven
ashore on the rocks about a mile to the eastward
of Daniel Margate, nu the morning of the. 22d
November, and bilged. Crew saved. About 1^00
chests of tea were saved, tho rest lost. The
cargo was owned by Daniel C. Bacon,'Esq. of
