Georgia Constitutional Coßrention
We, the Kcpreoeatutiveeof tlie people ol the
State of Georgia, la Convention assembled, to
secure to all citizens thereof the enjoyment of
lifts and property, and of pursuing happiness,
do ordain and establish this Constitution for Its
government.
AKTICia I —DXCLAKATIOX OK RIGHTS.
Sac. 1. Protect ion to person and property is
the duty of Government.
Sac. 3. Impartial protection shall be full and
complete.
Bac. 3. No person shall be deprived of life,
liberty, or property, except by due process oi
law.
Sac. 4. There shall be no imprisonment for
jdebt, except for fraud, or when the debtor re
sides beyond the limits o( the State, or is about
to remove therefrom.
Sac. 5. The punishment of all frauds shall be
provided by law.
Sac. 6. The writ of kabcas corpus shall uot be
suspended unless, in ease of rebellion, the pub
lic safety may require it.
SBC. f. A well-regulated Militia being ucees
shry to the security of a free people, the right
of the people to keep and bear arms shall not
be infringed.
Sac. 8. Perfect freedom of religious senti
ment be and the same is hereby secured, and
no inhabitant of this State shall ever be molest
ed in person or property, nor prohibited from
holding any public office or trust ou account ot
his religious opinion; but the liberty of con
science, hereby secured, shall not tic so con
strued aa to excuse acts of licentiousness, or
S practices inconsistent with the peace
:ty of the people.
Sec. 9. Freedom of speech and freedom of
the press are inherent elements of political
liberty. But while every citizen may freely
speak, or write, or print on any subject, bo shall
be responsible for the abuse of the liberty.
Sec. 10. In all prosecutions of indictments
for libels, the truth may he given in evidence,
and the jury shall have the right to determine
the law and the facts.
Sec. 11. The right of the people to appeal to
the courts, to petition Government on all mat
ters of legitimate cognizance, and peaceably
assemble tor the consideration of any matter
of public interest, shall never be impaired.
Sec. 13. Every person charged with offense
against the laws of the State, shall have the
privilege and benefit of counsel; shall be fur
nished, on demand, with a copy of the accusa
tion and a list of the witnesses on whose testi
mony the charge against him is founded; shall
have compulsory process to obtain the attend
ance of his own witnesses ; shall be confronted
with the witnesses testifying against him. and
shall have a public and speedy'trial by an im
partial jury.
Sec. 13. No person shall be put in jeopardy
of life or liberty more than once for the same
offense, save on his or her own motion for a
new trial, after conviction, or in case of mis
trial.
Sec. 14. No conviction shall work corruption
of blood, but conviction of treason shall work
a general forfeiture of estate during the life of
the person attainted.
Sec. 15. Treason against the State of Georgia
shall consist in passing an ordiuance of seces
sion, or in levying war against the State or the
United Suites, or giving aid and comfort to the
enemies thereof.
Sec. 16. Excessive hail shall not be required,
nor excessive fines imposed, nor cruel and un
usual punishment inflicted.
Sec. 17. The powers of the Courts to punish
contempt shall be limited by legislative acts.
Sec. 18. Legislative acts in violation of this
Constitution or the Constitution of the
United States are void, and the Judiciary shall
so declare them.
Sec. 19. Ex post jaclo laws and laws impair
ing the obligation of contracts or preventing
the enforcement thereof, are prohibited.
Sec. 2w. Laws shall have a general operatioh,
and no general law, affecting private rights,
shall be raised in any particular ease by special
legislation, except with the free consent, in
writing, of all persons to be affected thereby;
and no person being under a legal disability to
contract is capable of such free consent.
Sec. 31. The power of taxation over the
whole State shall be exercised by the General
Assembly only to raise revenue for the support
of the Government, to pay the public debt, to
provide a general school fund, and for common
defense, and shall be ad valorem only.
Sec. 33. The General Assembly nthy grant the
power of taxation to county authorities and
municipal corporations, to be exercised within
their several territorial limits.
Sec. 33. There shall he no poll tax levied,
except for educational purposes.
Sec. 34. The right of the people to lie secure
in their persons, houses, papers and effects,
against unreasonable searches and seizures,
shall not bo violated. The social status of the
citizen shall never be the subject of legislation.
Sec. 25. No place or places shall be searched,
and no person or persons, thing or things shall
be seized, without first particularly describing
the places, persons and things.
Sec. 26. No warrant shall be issued but upon
probable cause, supported by oath or affirma
tion.
Sec. 27. Private ways may he granted, upon
just compensation being first paid.
Sec. 28. There shall be within the State of
Georgia, neither slavery nor involuntary servi
tude, save as a punishment for crime, alter legal
conviction thereof.
Sec. 29. That all elections shall be free and
equal.
Sec. 30. Each branch of the General Assem
bly shall be the judge of the (Jhalifieations of
Its own members.
Sec. 31. No person shall be molested for his
opinions, nor suffer any civil or political inca
pacity, or acquire any civil or political advan
tage in consequence of such opinions.
Sec. 32. Laws shall be passed by the General
Assembly to protect from sale under execution
a reasonable amount of property for each head
of the family for the use of his or her family.
Sec. 33. All penalties shall bo proportioned
to the nature of the offense.
Sec. 34. No citizen of this State shall be sub
jected to corporeal punishment.
Sec. 30. No Lottery hereafter shall be au
thorized, or sale of lottery tickets allowed in
this State.
Sec. 30. No person, after the adoption of this
Constitution, shall engage in a duel, send or
aoeept a challenge, or be aider or abettor to a
duel; and the Legislature shall tix the punish
ment.
Sec. 37. The State of Georgia shall ever re
main a member of the American Union; the
people Hereof are a part of the American na
tion; that every citizen owes paramount alle
giance to the Constitution and Government of
the United States, and no law or ordinance of
tills State in contravention or subversion there
of can or Bhall ever have any binding force.

Belief Ordinance as Adopted by the
Convention.
Whereas, By the late war, the people of
Georgia have lost over four hundred mil
lion dollars of taxable property, also a vast
depreciation of real estate, and the total los
of four years’ labor, thereby throwing into
hopeless confusion the equitable relations of
debtor and creditor ; ana,
Whereas, All, or nearly all, the indebt
edness was based either directly or indi
rectly upon the property thus destroyed or
depreciated, while the amount of indebted
ness is held undiminished:
1. Therefore, we, the people of Georgia,
in Convention assembled, do solemnly or
dain, That from and after the passage of
this ordinance, no court in this Stale shall
have jurisdiction to hear or determine any
suit, or render judgment in any ease against
any resident of this State, upon any contract
or agreement made or entered into, or upon
any contract or agreement made in renewal
of a debt existing prior to the first day of
June, 1865 ; nor shall any court or minis
terial officer of this State have jurisdiction
or authority to enforce any such judgment,
execution, or decree, reudered or issued
upon any contract or agreement, or renewal
thereof, as aforesaid. Also the accompany
ing resolution :
Resolved, That the Committee on Judi
ciary be, and they are hereby instructed to
insert in that part of tqe Constitution which
defines the powers of tho Judiciary of this
State tho following section:
•ECTIOX .
No Court in this State shall have jurUdio
tion to hear or determine any wit, or ronder
judgment in any case against any resident
of this Slate, upon any contract or agree
ment made or ci.terew Into, or upon any
contract made in renewal ol a debt, existing
prior to the first day of June. 1865: nor
shall any court or ministerial officer of this
Slate have jurisdiction or authority to enforce
any judgment, execution or decree, rendered
or issued upon nny contract or agreement,
or renewal thereof, prior to said first day of
June, 1805, except in the following eases, in
which the Courts aud ministerial officers
shall have jurisdiction aud authority ;
11. Where the debt grows out of a
trust, for the benefit rtf minors, and
tho trust property is in the hands of the
trustee, or it lias been invested by him in
other specific effects of value, now in his
hands, or has been fraudulently disposed of
by the trustee, who has reliable specific
assets arising from tho disposition of the
trust property, which he converts to his own
nse, or when the debt is due from a third
pergou to a trust estate, or where the debt
is against a corporation, or corporations,
in their corporate capacity. Except also
where the debt or contract is set up
by. way of defence to any matter ot which
the court has any jurisdiction, and that
the said debt is more Ilian any debt
due by the defendant to the plaintiff,
of which tho oourt shall deny jurisdic
tion, except, also, where the debt is for
real property sold, and not one third or more
of the purchase money has liecn paid, and
the suit is in the name of the vendor, and
Iho said property exists in ihe hand i of the
debtor, who refuses to deliver it back to the
vendor, and where it has been fraudulently
disposed of by the debtor to avoid judg
ment, und except all debts due to charita
ble institutions, institutions of learning,
mechanics, and laborers.
And iu all other cases where the Legis
lature shall hereafter by a vote of a ma
jority ot its members thereof, cinfer juris
diction on any Court created by this
Constitution or by legislative enactment.
Provided, That jurisdiction over debts
for the purchase or hire of slaves, or over
debts the credit of which was based on
slaves as property, shall not be conferred
on courts in this State.
SECTION .
All contracts made and not executed
during the late rebellion, with the intention
and for the purpose of aiding and encour
aging said rebellion ; or where it was the
purpose and intentiojn of one of the parties
to such contract to aid or encourage such
rebellion, and that fact was known to the
other party, whether sail contract was made
by any persou or corporation with the State
or Confederate States, or by a corporation
with a natural person, or between two or
more natural persons, are hereby declared
to have been and to be illegal; and all
bonds, deeds, promissoiy notes, bills, or
other evidences of debt, made or executed
by the parties to such contract, or either of
them, in connection with such illegal con
tract, or as tho consideration for or in
furtherance thereof, are hereby declared
null and void, and shall bo so held
in all courts in this State, when an
attempt shall be made to enforce any such
contract, or give validity to any such
obligation or evidence of debt. And in all
cases when the defendant or any one inter
ested in the event of the suit will make a
plea, supported by his affidavit, that he
has reason to believe that the obligation or
evidence of indebtedness upon which the
suit is predicated, or some part thereof, has
been given or used for the illegal purpose
aforesaid, the burden of proof shall be upon
the plaintiff to satisfy the court and jury
that the bond, deed, note, bill or other evi
dence of indebtedness upon which said sdt
is brought is, or arc not, nor is any suit
thereof founded upon, or in any way con
nected with, any such illegal contract, and
has not been used in aid of the rebellion ;
and the date of such bond, deed, note, bill,
or other evidence of indebtedness shall not
be evidence that it has or has not, since its
date, been issued, transferred, or used in
aid of the rebellion.
SECTION .
It shall be in the power of a majority oi
the General Assembly to assess and collect
upon all debts, judgments, or causes of
action, when due, founded on any con
tract made, implied, or done before
he first of June, 1865. in the hands of any
one in his own right, or as trustee, agent, or
attorney of another, on or after the first of
January. 1868, a tax of not exceeding
twenty-five per cent., to be paid by the
creditor on pain of the forfeiture of the
debt, but chargeable by him. as to one
half thereof, against the debtor, and col
lectable with the debt: Provided, that this
tax shall not be collected, if the debt or
cause of action be abandoned or settled
without legal process, or if in judgment be
settled without levy anu sales; aud provided
further, this tsx shall not he levied so long
as the Courts of this State shall not have
jurisdiction of such debts or causes of ac
tion,
2. That this ordinance be, and hereby is
adopted as a part of the Constitution of this
State, aud the Judiciary Committee are
instructed to alter the several sections of
their report giving jurisdiction to the Courts
so as to fail to give jurisdiction in.the cases
herein denied, and the Committee on Con
solidation and Revision distribute this ordi
nance to its proper place in the Constitution.

To amend an Ordinance passed January 3.
1868, to issuo Bonds for the payment of sub
scription to the M .con & Augusta Railroad.
Hbo. I. Ha it ordained, etc., That the words
“live hundred each” he Rtrioken out, and the
words “one thousand each” be inserted.
Sac. 11. And be it further Ordained, That
all Ordinances and parts of Ordinances milita
ting against this Ordinance be, and tbo same
arc hereby repealed.
Done in Council, this seventh day of February,
1868.

the eounty of Meriwether, in said District—At
Newnan, in said District.
On this 11th day of February, 1868, on read
ing the foregoing Petition, it is ordered by the
Court that a hearing be had upon tbo samo on
the 3rd day of March, A. D., 1868, before Chas.
G. Me Kinky, Register, at the Register’s Office,
n the city of Newnan, Georgia ; and that notice
thereof be published once a week for two weeks
in the National Ropubliean and New lira news
papers, printed in laid District; and that all
creditors who bavo proved their debts, and other
persons in interest, may appear at the said time
and place, and show cause, if any they hare,
why the prayer of the said petition should not
be granted.
And it is further ordered by the Court, that all
such creditor!, whose places of residence are
known, shall bo entitled to services of notice of
the said order, either personally or by letter ad
dressed to them at their known usual place of
abode, attested by the Clerk of the Court, or
served at their usual placo of residence by the
Marshal orjiis Deputy, or seat by mail, whereof
due notice shall be given; and that the second and
third meeting of creditors bo held at the time
and place aforesaid.

said Court, and the seal thereof, this 11th day of
