HSADq'RTEKri THIRD MILITARY DISTRICT, J
(Department Ga., Ala., and Fla..) \
Atlanta. Ga . May 26, 1868. J
General Orders So. 80.
So much of the sentences of the prisoners (Win.
Pettigrew, Frank 11. M(today, Hugh L. White,
iboma-j W. Roberts, James Steele, John Cullen,
anil Samuel Stray bom, citizens), sentenced by
General Orders No. 72, to confinement at hard
labor at the Dry Tortngas, as remains unexpired,
ou the receipt of this Order at Port Jefferson, is
hereby remitted, and the prisoners will be dis
charged.
In thus early releasing these prisoners, the
Major Genera! Commanding trusts the c lemency
extended toward them will not he misunderstood.
Ibese misguided and thoughtless young men
were convicted, after a fair trial, of*nets of vio
lence and outrage against a citizen, with the ob
jectof driving him out of the .State.
The frequent complaints of similar conduct,
and the failure of the civil authorities to repress
the evil, rendered it necessary to exercise tho
power conferred on him by law, nnd bring those
prisoners before a military tribunal. Their con
duction and punishment having, however, vindi
cated the principle involved, the Commanding
•cucral, in view of the suffering imposed on tbo
tdatirea and friends of tho prisoners, of tho
prumiiiee made of future good conduct, and in
1 •« belief that a proper example, earlier made,
might have deterred the prisoners from eoininit
u»g the offence, has directed the dischargo of
’h® prisoners.
The Commanding General takes this occasion
o Rate that similar clemency need not beex
pected in future, and he warns tho people of
18 that he is determined to sup-
P sll lawlessness and violence, and all at
ctnpiß of individuals to take the law into their
‘ iao, h, or decide who shall not livo in
e country. To protect every person in his
f'K ts of person and property, »h made by tbo
jw the paramount duty of the Commanding
encral, and it is well the people of the District,
the authorities having in charge tho preser
» ion of the peace, .and the execution of the
should know that he is determined to
rente all the power under his command in the
h nrge of this duty, and that horeaftor no
fii. Kl ei ?. t,un afi h«re allowed, will in -
cnee him to relievo the guilty from the just
punishment awarded them,
