Paper Collars.-—The Round Table
declares that the paper collars now so ex
tensively worn by ladies and gentlemen
are poisonous ami cannot be long used with
out serious consequences. It says :
“Many men and all tho ladies who wear
paper collars are liable to the satuo gradual
poisoning. That they have no eruptions
upon the neck is only a proof of their
greater peril, for it shows that the system
is so corrupted or weakened as to take in
the arsenic without that natural, healthy
rcdstence which produces sores or boils.
On the other band, however, a lady may be
disfigured for life by unsightly blotches
arising from the use of these collars and
cuffs. As they are at best only a sham ami
a substitute for linen and muslin, and as
no great expenso is involved in tho pur
chase of the only materials of which collars
can bo safely made, wo hope that tho wear
ing of poisonous paper collars will bo dis
continued, and we urge all physicians, and
especially the Board of Health, to instruct
the public in regard to this important sub
ject.

Editorial Withdrawal.—R. M.
Herring, Esq., has withdrawn from the
editorial columns of the Carolina Time* of
Charlotte, N. C. It. P. Waring, Esq., is
now the solo editor and proprietor of this
well conducted journal.
For Solution.—When 100 boxes of
Prunes cost $2.10 each, and by selling them
at $3.50 per cwt. (112 lbs.), the gain is
25 per cent. The weight of each box is
required.
Tiie Alarm of Fire.—There was
an alarm of fire last night, at I. Kahn k
Co.'s store. Fortunately no damage was
done. Our energetic Fire Brigade turned
out promptly, as usual, but their services
were not called into requisition.
Personal.—We notice that Gov
ernor Johnson has returned from Washing
ton. The Senate has not yot confirmed the
appointment to Bogota. A gentleman who
appeared to bo posted, told us recently that
the pay was $7,500. — Columbu* {Ga.) Run.
City Council.—The regular month
ly meeting of the City Council will bo held
at 9 o’clock this morning.

Recorder’s Court— Only two or three
cases were tried in this Court yesterday

Important Trade Mark Cask in
Canada.—Before J. C. Tacho, acting in the
absence of the Minister of Agriculture.
Tried at Ottawa, C. W., March 21 and
22, 186*.
This suit was brought by Messrs. Perry
Davis & Son, of Providence, R. 1., U. S. A.,
to procure for themselves tho enregistefft
tion of the words “Puin KUlcr” as their
Trade Mark in tho Trade Marks Registemof
Canada. Lymans, Clare & Cos., of Montreal,
C. E., having previously obtained the en
rogisteration of “ Lymans' Universal Pain
Killer” as their trade mark.
To sustain their claim of exclusive right
to the words “Pain Killer," l’erry Davis &
Son brought proof that .tho sale of their
medicine was already established in 1839,
and their labels “Pain Killer" printed in
considerable quantity in IS4O. Also, the
records of several courts in the United
States in which this claim was sustained
against using the term “Pain Killer" as a
part of the name of similar preparations, as
early as 1848.
It was claimed by Lymans, Clare &. Cos.
that the term “Pain Killer," before its
adoption by Perry Davis & Sen, was a com
mon term, like “Embrocation," “Liniment,"
“Lotion," and other similar well known
words, and to adopt it as a trade mark
could not constitute an exclusive right to
its use.
Dr. Taebo having listened attentively to
the proofs and arguments on both sides,
entered into a very full explanation of the
law as applicable to the ease; showing
what constituted a trade mark, and what
an infringement on the same is, and in
closing, said: “Both trade marks having
been attentively examined by me, I decide
that the Trade Mark in question consists in
the words ‘Pain Killer ;’ " and ordered tho
cancellation of Lymans, Clare & Co.’s Trade
Mark, in the Trade Marks’ Register, and
the entry of Perry Davis & Sous in the
same.
We had quite a string of good luck on
Craven street yesterday, only it was too
soon over. A mule ran of! with a cart,
but unluckily kept the middle ot the street
and did no damage to himself or the cart.
This was very provoking to ye Local, lm

ing wo saw a paragraph in tho Press stating
that tho Local was absont, or absent-minded.
Now, if there had been any items such as
the above floating around, or if tho proprie
tor had stepped down the Globe Hotel
steps and broken his ankle, or Blobbs bad
becu carried home on a shutter, with an
eye gouged out, or tho Foreman had had
his nose knocked into pi, or some of the
Printers had fallen out of tho window look
ing at the pretty girls in Broad street, or
the Siamese Twins, (t’other one), had ex
ploded on his tenth glass of Soda Water, it
would have been very apparent that tho
Local wrs neither very absent nor absent
minded. But it’s all right, and we arc not
sorry for it.
