In purfuarce of your Lordfliip’s inftrudVions to me of
the 1 bth and 20th of October I proceeded with the flips
under my orders, and the troops under the command of
the Hon. Gen. Charles Sennit, to the rendezvous off the
Colotnbreties; and after having been joined by his Majef
tv’s Hoop Petcrcll, and the arrangements for landing had
been completed, on the sth in the afternoon I Hood for
Minorca, hut in coidequtnce of light winds I did not make
that iiland till daybreak on the 7th, then within 5 miles
of the port of Fou me lies, where finding the wind direftly
out of that harbor, and the enemy prepared for our recep
tion, I (having previously consulted the General) made the
iign and for Capt. Bowen, of the Argdy-accompan'cd by the
Cu.rnorant and Am bra, to affiH in covering the landing,
to lead into the*Greek of Addya, there not being water or
f nice enough for tl.c line of battle fiiips, which he executed
in a inoH officer like and judicious manner; and in liaulim r

fired one gun, but on feeing the broadlide the enemy left

iln icc, which was rapidly executed, the Leviathan and
Gt utaur plied on and off Fournelles, to divert the attention
of tiie enemy; but knowing an expeditious landing to be

the Leviathan and Centaur off its entrance, to fee that fer
vire performed. One battalion was put on fliorc by 11
o’clock, and directly took the height, which proved fortu
nate, as the enemy very quickly appeared in two divisions,
one of wh-eh was marching down towards the battery before
mentioned, when I ordered the covering lhips to commence
a cannonade, wliicli effectual 17 checked their progress, and
the General kept them at bay with the troops he had; and
by 6 o’clock in the afternoon the whole were on lhore,
with eight 6 pounders, fieldpieces, and 8 days provHions,
as silfo 2 howitzers. On the lame evening, after ordering
the Cormorant and Aurora to proceed oif Port Malion,
with 7 trailljx i ts, to form a (livei lioii, I got under weigh
with the Leviathan and Centaur, and tuuiecl up to Fom
in lies with an intent to f ice the harbor; but on my enter
ing the paflbge 1 found the enemy had evacuated the forts,

ordered Capt. Digby to embark the marines, and to put to
lea, and qmile- under tiie command of Capt. Markham,
who was employed ill covering the port of Fournelles and
Add, a, ami preventing succor being thru wn in, whillt my
pendant was hoillcci on board the Argo, where I continued
two days, aiding and directing the neceflary supplies for
t'e arm)-. In this I was ably a Hilled by Capt. Bowen.
During these two days J vifued lieadguarters to consult
with the CcnerJ, when it was decided, as the anchorage
ot A. My a was extremely hazardous, and thcjtranlports in
hourly 1 ilk of being loti, t<> remove them to Fournelles,
which was executed under cover of the Lcviatiian and

In the middle of the night the General lent me another

When I went on fbore I signed the capitulation the Gene
ral had made, on which fortunate event I mod truly con
gratulate your Lordship. The Centaur joined, not having

Markham being apprehensive that tlie continuance oi the

in the Cormorant, with the Aurora, Capt. Caulfield, en
tered the port, theft ships have been employed for the de

pleasure to allure your Lordlhip, in the performance of the
various services incident to the movements 1 have dated, 1
cannot pass too high encomiums on t- e Captains, office nq
and seamen, under my command. From Cant Pouiden
and Prefsland, Agents of Tranlports, I received every

now beg leave to mention my First Lieutenant, Mr. George

to undergo during the attack of the iftand, has proved
highly dd’erving my praise; 1 have therefore put him to act

activity, and correritnefs of Lieut. Whifton, of the Confti
tuiida cutter, in the various services and messages he had
to execute.

(liould be font witliout delay, I have not yet been able to
visit the port of Mahon, to obtain a return of the flats of
tlie dock yard or vefieri captured in that place; but lu
derftand from Capt. Lord Robert Mark Kerr that there are
no (lisps of war, ar.d only one merchant fiiip of value, the
particulars of which 1 will tranlmitby the earlicft opportu

I have the honor to acquaint you, that, at half pa.ft 3
p. tn . on the 13th inst. I had the good fortune to come up
with the (ilip that I hauled the wind after round Cape
Rouge, conformable to y. , lignal: (he proved to lie his
Majesty’s (liip Petercll, m pofieflion of Don Antonio
Franco Gandrada, 2d Captain of the Spanish frigate Flora.
Who, in company with the three others named in the mar
gin,* captured her the day before.
1 he fi 1 gate had come from Carthagena, had touched at
Barcelona, (ailed from thence on Saturday l ift, bound to
Mahon,. with 8 millions of rials to pay the troops.
Deeming it abfclutely necessary to make the Petercll
ufhful until your return, I took all the Spaniards out, ~j 2
in number, and gave her in charge of my ift Lieutenant,
Mr. Lyne, with a Mate, two Midfhipmcn, 30 seamen,
at Fournelles, with a letter for Gen. Stuart, and to return
here immediately.
lam Cony to inform you-the Spaniards behaved vew ill
to the officers and fsaiftcn of the Petercll, having robbed
and plundered them of every thing. Great part of the
Captain ana officers clothes 1 have recovered. I returned
off this place yesterday, but being calm I could not get
near the more.

an act, on the sixteenth day of February iuftant,
entitled, “ An Acft to compel all Officers, Civil and Mi
litary, to take and fubferibe an Oath to support the Condi
tution thereof.” in the words following, to wit;>* ‘
“ WHEREAS it is necessary that all Officers, Civil
and Military, within this ftatc, fliould be bound to funnort
and maintain the Constitution of the fame, be it therefore/
enabled, That ail and every Officer, Civil and M btaryj
holding^any office under the authority of this ft ite, 1 J
