Resolved, That the Committee on
Public Lands lie instructed to enquire
into the expediency of permitting such
purchasers of the public lands, prior to
the first of July, Hl’iO, to demand and
receive patents, who have paid into their

mid third instalments on each tract pur-
c based.
Mr. Thomas submitted the following
motion for consideration :

The Committee to whom has been re
ferred Hie Constitution of the State of
Missouri respectfully report :—
Thai they have not supposed them-
s'-licsj hound to inquire whether (lie pro
visions ol the constitution inferred to
them be wise r liberal. The grave and
dilllcult question as to the restraints which
should bo imposed upon Ihe power of
Missouri to fotm a constitution for itself
was decided by Ihe act of the last session,
and the committee have had only to ex
amine whether the provisions of that act
hnve been complied with. In the opin
ion of the committee, they have been.—
The propositions, too, which were of
fered in the same act to (lie free accept
ance or rejection of the People of Mis
souri, have all been accepted by llicfn.
But there remains a question too import
ant to be overlooked.
We know that cases must often arise
in which there may he a doubt whether
the laws or constitution of a state do not
transcend the lino (sometimes the obscure
line) which separates the powers cf the
different governments of our complex
system. It appears to the committee,
that, in general, it must he unwise in
Congress to anticipate judicial derision
by the exposition of an equivocal phrase,
and that it would be yet more objectiona
ble, by deciding on the powers of a state
just emerged from territorial depend
ence, that it should give the weight of its
authority to an opinion which might con
demn the laws and constitutions of old, as
well as sovereign states. The commit
tee are not unaware, that n part of the
tw enty-sixth section of the third article
of Ihe constitution of Missouri, by which
the legislature of the stale has been <!i-
1 cted to pass laws ‘ to prevent free ne
groes arid mulattoes from coining to, and
settling in, the state,” has been constru
ed to apply to such of that clns* as are
citizens of Ihe United States, and that
their exclusion has been deemed repug
nant to (be federal constitution. The
words which are objected to are to be
found in the laws of at least one of the
middle slates, (Delaware,) and a careful
examination of the clause might perhaps
countenance the opinion, that it applies
lo the large class of free negroes and mu-
latioes who cannot be considered as the
citizens of any state. But, of all the ar
ticles in our constitution, there is proba
bly not one more difiicult to construe
well than that which gives to citizens ol
each state the privileges and immunities
of citizens of the several states ; there
is not one, an attention to whose spirit
is more necessary to the convenient ami
beneficial connexion of the states ; nor
one of which too large a construction
would more completely break down their
defensive power, and lead more directly
to ll-.cir consolidation, 'i bis much, in
deed, seems lo be settled by the estab
lished constitutions of states in every
section of our Union ; that a state lias
right to discriminate between the white
olid the black man, both in respect to po
litical and civil privileges, though both
citizens of another state ; to givu to the
one, for instance, the right of voting and
of serving on juries, which it refuses to
the other, llow far this discrimination
may bu carried, is obviously a matter of
nice and difiicult inquiry. The commit-
lee do not propose to engage in it.—
They believe it Lest, whenever a case
occurs which must necessarily involve
the decision of it, that it should be sub
mitted to judicial cognizance.
In this lien (which narrows their en
quiries Ji duties) the committee are con
firmed, by a consideration of the embar
rassments and disasters which a different
course of proceeding might sometimes
produce. When a people are authoriz
ed to form a state, and do so, the tram
mels of their territorial condition fall
off. They have performed the act which
makes them sovereign and independent.
If they pass an unconstitutional law, and
we leave it, as we should that of another
state, to the decision of a judicial tribu
nal, the illegal act is divested of its force
by the operation of a system with w hicli
we are familiar. The control of the ge
neral government is exercised in each
particular case, iu support of individual
right, and the state retains the condition
which it has just acquired, and would not
easily renpunce N But a decision
Congress against the constitutionality el

operate directly by vacating the law ; nor
is it believed that it could 1 educe the state
lo the dependence of a territory. In
these l ircumstaiu 1*. to refuse admission
into the Union to such 11 state, is to re
fuse to extend over it that judicial au
thority which might vacate the obnox
ious law, and to expose all the interests
of tin* government within the territory
of that state, to a legislature and a judi
ciary , the only check on which have
been abandoned. On the other hand,
if Congress shall determine neither to
expound clauses which are obscure, nor
lo decide constitutional questions which
must be difiicult and perplexing, equally
interesting to old states, whom our con
struction could not, as to the new, whom
it ought not to coerce, the rights and du
ties of Missouri will be left to the deter
mination of the same temperate and im
partial tribunal, which has decided the
conflicting claims, and received the con
lidence, of the other.
The committee recommend the adop
tion of the following resolution
This repoit having been read by the
Clerk, tlie resolution therein referred
to was read, as follows :
Whereas, in pursuance of an act of
Congress passed on the sixth day of
March, one thousand eight hundred and
twenty, entitled “ An act to authorize
(hr people of the Missouri territory to
form a Constitution nnd Slate Govern
ment, and fur the admission of such State
into the Union on an equal footing with
the original States, and to prohibit slave
ry in certain territories,” the people of
the said territory uiil, on the nineteenth
day of July, in the year one thousand
eight hundred and twenty, by a Conven
tion called for that purpose, form for
themselves a Constitution and State Go
vernment, which Constitution and State
Government, so formed, is republican,
and in conformity to the provisions of the
said act :
Re it therefore resolved by the Senate
anil House of Representatives of the Uni
ted States oj America, in Cotigress assemb
led, That the State of Missouri shall he,
ami is hereby, declared to Lo one of the
United States of America, and i« admitt
ed iifto the Union on an equal footing
with the original states, in all inspects

The resolution was then read a se
cond time,
Mr. iMWndes moved to refer the reso
lution to n committee of the whole, on
Ihe state of the Union, which put it i.i
the power of the House to act upon it at
anytime it thought proper. He need
not say, that there, was no disposition to
act upon this subject without fuM notice
to all parties concerned ; and, if no oili
er person did, he should himself, when
proposing to call for the consideration of
the report, give a day or two notice of
h^ intention to do so. Whilst up, he
took occasion to say, that this report, as
indeed all reports of committees, must be
considered as tlie act ofa majority of the
committee and not as expressing the sen
timent of every individual of the commit
tee.
The reference was agreed to.

PROPOSED AMENDMENT TO THE CON
STITUTION.
On motion of Mr. Smith, of North
Carolina, the House then resolved itself
into a committee of the whole on the
State of the Union, Mr. Ross, of Ohio,
being called to the chair ; and, on mo
tion of Mr. Smith, also, proceeded to the
consideration of the motion, submitted bv
him, proposing an amendment to the Con
stitution of the United States, as it con
cerns the Election of Electors of Bresi-
dent and Vice 1’resdeat of the United
States.
Mr. Smith, declining entering into any
argument in support of the proposition,
on which his views had been fully ex
pressed at the last session, said, he had
called up the question at this eaily day,
in the hope that an expression of the o-
pinion of the llonae on the subject might
be obtained at this session, lie added a
