Davison v. H'ilson.“
Mr. CoUnvan opened the pleading". Mr.
Scarlett had lo st Me the ease opened by bis
learned ft it nd. Tlie*|ilaii)tifFnow applied to
tth'in for some repar.Mum in dam iges, lor the
loss lie had so lamed, i.t being disappointed
of a marriage he had contracted, and from
Tvhirh lie could reasonably expect comfort
and happiness. A celebrated writer (Lord
Bacon.) who would he admired as long as
tin; English language existed, and whoso ob
servations on manner's and human nature
formed the surest authority to which their
attention could be directed had said, “ A
young man marries for a mistress—a mid
dle aged m ni for a companion—and an old
man Tordi nurse.” This remark was autho
rized by tile highest specie* of philosophy,
ami the justest views of human nature.—
“ It is not good for man to he alone.” Soli
tude, tit any age, was not good. We were
made for cn iimunlcating and enjoying tin
pleasure of consolation, by a reciprocity of
attention and kindness. He made these re
marks because he observed a smile on some
faces at the age of Ins client, who, he admit
ted, was sixty tight. (Laughter.) And if
he could provide himself with a nurse, on
account of the defendant’s conduct, he w as
entitled to damages, ami must feel the loss
bn suffered, as sensibly as some younger
men. The defendant was of an age to he
answerable for her promises. She had at
tain,id the discretion which years conferred,
and was not a giddy, thoughtless, extrava
gant girl. She w as not at a period of life, us
in many cases, to make her marriage unhap
py—but a steady, discreet, sensible lady, of
>n age quite propoitinnate to the plaintiff’s.
Mis" Wilson, he understood, was sixty four!
(Peals of laughter resounded through the
court, and infected the learned genllnniiii

himself.)—He wished he possessed the ge’
tia and eloquence of a celebrated w riter, it*
charmed his readers with a deseriptioi!
love at the age of CO—or that he felt the pm
pfie fire of a lviiter of our own age (Lord
Byron), who made the lose of an old man of
8t> the subject of a tragedy. The love he
had to state to the jury was one of the so
berest views which the passion presented.
But there was gteat advantage, after all, tn
aged lose—it possessed the comforts and
advantages of a steady and matured union
of sentiments. If there was no real friend
ship hut in a perfect community of interests,
a true friend w as not to he found by parties
in any slate—The plaintiff, a seafaring man,
h g illsntry on hoard Itis vessel, had ilislin-
g ishud and advanced himself. He had been
married, and had ;t family, and Itis wife died
in 11)05. Since that time lie had lived at
Ayton, where the defendant residid with
he.’ father, mother, ami-younger water.—
They became acquaint) d. and were inspired
with mutual esteem. Her hi other, his par
ticular fiieiid, was now dead, her father, mo
ther, and airMei^lolluwi d, leaving fRWgilont .

I. her wishing bosom heaves,

(During the repetition of this the court was
convulsed:)
>• Whenever you marry again, gentlemen,
May is the proper time.” She intimates to
her’nccepted lover, how gay she would he
next week at York, attending concerts and o-
tlicr nniiisenn»ts, suited to her prospects,
and directs him to take the house only lot
six years, which was extremely prudent, as
by that lime the house might not he large e-
nough. (Laughter.) She corresponded with
him after tier return from York, till the tin
ry month of May, and in one letter com
plained of the inconvenience of getting her e-
pistles into the post office and of being ton
much watched—which ladies in her circum
stances were apt to think. (Laughter.) Jn
tlirse letters it was evident that she thought
of changing luiNsituatimi—that she npprov
ed of the plaintiff’s attachment—and wtis
only waiting till the month of May “ bro't
all things about.” On consulting Mr. and
Mrs. Dodd, a change of mind took place, and
she wrote a cold and doubtful letter. II'
a-.ked an explanation, and she answered with
the same coolness and reserve, lie did mil
Illume the Dodds for the advice they had
given—every person had his own views of
happiness.
Mr. Justice Baily.—II was kind advice, to
prevent them doing a foolish tiling.
Mr. Scarlett.—Another letter was written,
to say thr house would not lie wanted, sub
scribed, 11 Your obedient servant, Jladlel
IViIson,” in-tead of ns formerly, “Tour’s
sincerely.” From these cirrumstances they
would see the ground of complaint—aod it
she had thought proper to break her con
tract, some compensation ought to lie made
to the plaintiff. After being acquainted
with her lilleen y^ars, he was thrown hack
on all the miseries of solitude, and deprived
of his prospects. He should prove, the pro
mise from the letters from which he had read
xtracts.
Mr. Justice Baily-,—And the breach too, I
suppose ?
(His Lordship recommended an arrange
ment, hut the uttempt failed.) .
Mr. George Dodd ivas examined, to prove
that letters had passed betw een the parties
and that a number produced were it) Miss
Wilson’s band writing.
After another attempt at arrangement,
Me. Scarlett said, at the recommendation
of his Lordship, lie acceded to the prnposi
lion, to takaxCotodiet for a small sum, and
proceed futmpRwConsidcring the ages and
situations of the parties, lie could not ex
pect such damages as if they were younger,
and^there was more love and sentiment in
the connexion.
Mr. Ilaine.—I am glad it is put an end to.
Mr. Justice Baily.—£20 is all I think, un
der the circumstances, the plaintiff is entitled
to.
