Yitr. Orange Tree—Emllcm of Geni-
»•—This is t Ire prince of trees. It bears
ht the sanie time blossoms and fruits. Its
leaves are ever green, ond ns it increases
in age and size, it increases in beauty and
fruitfulness. Its flowers load theuirwith
fhe ricliest perfume anti its fruit is tlie
|tjosx delicious mid exquisite on earth.
This superiority overull other trees, ttnd
these inestimable qualities render it e
happy emblem of genius, that magnificent
8ml splendid boon of nature, which like
this tree is ever green, and which grows
Wore and more hcnutilul beneath the hand
®f time. Thus genius surpasses every
other attribute of mind, and is continually
producing new blossoms, while it in load
ed with mature fruit.
. The Grunge tree has also been enn-
Juderod typical of tbe passion of love,
“CCRuse although its fruit lie golden, its
odours exquisite, and its taste delicious, itr

REPORT ON JFDBK FORT’S C ASE.
The Select Com since, to whicVw.n referred
(lie charges iTrefei'iril by .lu*r|ili lihicltslavir, h-
Itaiitst Mosks Fokt, the .lltlge of the Southern
Circuit in this State, KHPUIlT— •
That they entered u|jon the discharge of the
duty devolving upon them by said lefcTenee,
under a deep sense of the duty ivliirli they ow
ed to the right* of th<i persCa whose CoiiJuct
was intpcnched, bn the one hand, and the ligiits
oftlie citizens of tliM ct.it,;, on tiie other. Taut
under these feelings, they deemed 4 tiieif duty to
allow oftlie freest invcMii’.itloi) nil tiie one side,
and the most ample mean, of defence on the o-
tiler. The tnare I'lfei luidly M ohlain these ends,
•your committee consiip-red that they had the
power, (and itccoriliog'y exercised it.) of per
mitting troth the accuser and accused, to appear
before them by counsel. Both parties availed
themselves of this privilege, and thereby enjoy
ed the right, lo Lie fullest extent, of cross and
re-examining ull the witnesses who were brought
before the coiuiniitcc.
The evidence thus given in before the com
mittee, has hern committed to paper nod here
with submitted lo the House, with the papers
therein referred to.
From the evidence thus submitted, your com
mittee fed themselves aut lorisod to say, that
ft»f first charge submitted, 10 wit, that the said
Moses Fort, “ has been on the hunch as Judge
so intoxicated, at repeated times and places, as
to render him incapable and wholly incapacitat
ed from performing the duties assigned him as
Judge,” has been substantially supported mid
proven.
Mueli evidence has boon submitted to your
committee in support of 11 its second charge, to
wit—til.it the said Moses. Fort, ” has repeated
ly decided causes in (he c iiirts, or some of them,
in and over which lie p.esided, from base and
unworthy, improper, pallid, and cumipt mo
tives.”
And although the* evidence adduced to sup
port (Ids charge, pioves many acts of the said
.Moses Fort, which might he deemed either ille
gal or improper ; yet in the opinion of your
committee, i^isUn! ol that clear and positive na
ture which they have consi hired necessary to
enable them to pronounce the motives of the
said Moses Fort, either improper, partial, or
corrupt.
In support oftlie third charge, very little evi
dence has been submitted to s onr committee, I
oilier limn nn exemplitic.itimi of the record of j
one case, which was an indictment (or tin assault j
with intent to munler Which in Hie opinion of |
your committee, cannot he considered sufficient i
to warrant the conclusion, that the Judge was I
actuated by corrupt motives, in making Ids vie-
cisions in llii- case. [
The fiiaith chaige is in its nature more gene- |
nil, to wit ■ that the said Moses Fort, “ from
general intemperance ami iuto.viratioo is unlit
and incapaciinti d fiom pelfoi niiog the duties ot
J iidge." l'lie ev i.lence in support ol I bis charge,
consists of 1 tint produced to substantiate the
first, Connect'-d with proof of the general habits
of the snid Moses Fort I'.Tr intemperance It
will lie readily perceived, that the I■ uiIt or fnl-
fit\ of this charge must depend upon the effect
ivldch a giren degree of intemperance will or
may have upon the mind and conduct of any in
dividual. And though the whole evidence may
net shew such an extravagant and continued use
of ardent spirits by tiie said Moses Fort, as
icliully to disqualify him from pci fo'ming all the
duties of Judge ; yet, in the opinion i.f your
Committee, it must have opposed a considera
ble barrier to (lie speedy ail'd faithful adaiiuis
t ration of justice in the ciieuit over which lie
presides.
Whatever difference of opinion, then may ex
ist, as to die disqualification of (hi* Judge, finm
Ids intemperance, to perform the ditties of his
office, your committee are of opinion', that all
must agree, that the ciidence shews such an
habitual tuU'iUjirrmicc un tile p.q l of III,; Judge,
as to prosli ate ti e dignity ot’ his olii-rt, and ma
terially to interrupt the discharge ofhis ..ffirial
deities With these view 3 ol'tlie subject, an.I
