present time, and from recent events which have
taken place, since the Inst notice, the proprietor deems
it proper to give a succinct history of it from the begin
ning to the present time, leaving out as much a3 possi
ble wliat has been already published.
The Proprietor, sometime before lie ottered this Lot
tery to the public, had mortgaged nearly all the pro
perly to two persons whom he owed—one contained
(lie negroes, the other the lands, &c., and as he believ
ed, for less than half of its value: However, with a view
to tuke them lip before, or nt the time they became
due, and proceeded on with his mercantile business;
but he was from misfortune unable to take up the mort
gages, nnd having made many other creditors, and
perceiving that landed property had fallen nearly half
its value, and finally finding for what it would bring,
that even nil his property would not satisfy his credi
tors, unless he gets its value ; and having been thus fix
ed, and being anxious to do justice to his other credi
tors, as well as the mortgagees, offered his property in
i said Lottery.
He applied to his creditors for their approbation—
nnd amongst them, one whose claim is (juite inconsi
derable, refused, and issued his fi fa (alter which, o-
thers issued and levied on the property.) and it wit? all
sold, trom the first Tuesday in last August, and up to
the first Tuesday in September, and bought in by two
mortgages at comparatively small prices, but more
than the amount of the fi fa, and the property left with
the Proprietor to carry on the Lottery. Said credi
tor’s claim being younger than others, the money was
paid lo the eldest claim, and he still not paid. On vi
siting Savannah, the Proprietor was taken hy this«ame
creditor hy ca sa, and placed in confinement on the
23d of last March, and in Ihe mean time tlie mortga
gee’s attorney took possession of the negroes offered
in the scheme of said Lottery and sold them. It is
proper to state, that from the sales of tickets, there is a
larger amount of money on hand than the amount of
the nine negroes in the scheme in said Lottery. On
Inking now nearly two months to consult (both per
sonally and by letters) a number of gentlemen, the best
course to betaken, the Proprietor from their advice,
as well as his own convictions has, coine to the con
clusion to continue the said Lottery, hut admits he
must have Ihe nid of his country. He will present a
petition to tlie next Legislature ns soon as it sits, with
a number of respectable signers, praying leave to draw
sail! Lottery, and to pay cash to prize holders instead
of negroes to the amount set forth in the scheme of
said negroes. Then justice will he done to purcha
sers of tickets, nnd to his numerous creditors, and he
will feel grateful to his country, which will verify the
old adage, “ a friend in need is a friend indeed ’’
He does not make this appeal to the public with n
hope of obtaining the fame of Tiinoleon of old, by
means ofchaiice and fortune—no , he only asks what
can he done hy his State—for its aid so as to act legal
ly—and only to maintain his steadiness of purpose and
firmness of mind, hy which, although poor, he will he
aide to pass the remainder of his days, neither to he
grieved with past prosperity, nor to he broken down
hy present or future adversity, but to be gratified for
having the satisfaction of doing justice, and for the fol
lowing very goad reasons—it will balance his affairs,
restore his credit, satisfy his creditors, nnd to injure
neither individual nor country in this peculiar case.
It i9 therefore requested, that the purchasers of tick
ets remain satisfied, until it Is known whether the Le
gislature will have rejected or granted his petition. If
rejected, all the money will be immediately returned
by (lie Agents ; but if, on the other hand, the petition
is allowed, he will have time to sell tlie unsold tickets,
and draw said Lottery by the finP of next January, the
time specified in the last notice, dated the 25th of
March. J. B. BATEMAN.
(CF Editors who have published any of the notices
that have been issued, respecting said Lottery, will he
pleased to give the above one insertion per month, till
the Yj gislnture sits in next November, and in addition,
the Proprietor requests tlie editor of the Hickory Nut
to do the same.
