Whereas a vacancy has occurred in the 1st Brigade,
5ih Division, Georgia Militia, by the death of Brigu"
dierGeneral William H. Wyatt :
Now, in order that said vacancy may be filled, and
in pursuance of an act of the Genet al Assembly “ To
provide for tbe election ofgpneral officers of this State,
agreeably to the amended Constitution,” as-ented to
17th December, 1843, l have thought proper to issue
this, my proclamation, hereby ordering you, the -aid
Colonels or Commandants of Regiments and Battal
ions, to cause an election to be held on Monday, the
6th day of Januaiy next, in the seveial places of hold
ing elections for members of the General Assembly in
the counties of Jasper and Jones, giving due notice
thereof for the election of a Brigadier General to fill
the vacancy aforesaid.
The duty w ill devolve upon one (or more) of the
superintendents of the election held at the precincts to
meet a the Court-house in the respective counties,
and count up and cons didate the same, and forward

Be il enacted by the Senate and H- vse of Repre
sentatives of the United States of America in Con
gress assembled, That the following sums he, and
the sameaie hereby appropriated out of any money in
tiie Treasury not otherwise appropriated, for the sup
port of the Army forthe year ending the 30ih ofjune,
1351 :
For the pay of the army, $1,759,842: Provided,
That the pay and emoluments of the superintendent of
the United States Military Academy shall in no case
he less than the pay and emoluments of the Professor
of Natural and Experimental Philosophy.
For commutation of officers subsistence, $550,679,
includ ng t’ae additional rations tor the the commis
sioned officers of ordnance commanding arsenals or
armories, b sing fixed or permanent posts of the army
of the United States; and the additional rations for
the commissioned officer* of engineers, commanding
separate and fixed or permanent posts of the army of
the Unite 1 Skates.
For extra pay lo the commissioned officers and en
listed men of the army of the United States serving in
Oregon or California, $325,854, on the follow ing basis,
to wit: that there shall be allowed to each commis
sioned officer, as aforesaid, whilst serving as aforesaid,
a perdi-m, in addition to their regular pay and allow
ance, of $2 each, and to each enlisted man, as afoie-
said. w hile serving as aforesaid, a per diem, in addi
tion to their present pay and allowances, equal to the
pay proper of each as established by existing laws;
said extra pay of the enlisted men to be retained until
honorably discharged- This additional pay to he con
tinued until the first of March, 1852,or until otherwise
provided.
For commutation of forago for officers’ horses,
$103,770.
For payments in lieu of clothing for officers’ser
vants, $35,720.
For expenses of recruiting, $56,616.
For three months’extra pay to non-commissioned
officers, musician* and privates, on re-enlistrnent,
$10 000.
For clothing and camp and garrison equipage, and
horse equipments, $102,871.
For the regular supplies of the quartermaster’s depart
ment, consisting of fuel, forage in kind for the author
ized number of officers’ horses, mules, and oxen of the
quartermaster’s department, at the several military
postsand stations and with thearmies in the field, and
tor the horses lor ihe first and second regimen's of
dragoons, the eight companies of light ai tiilerv, and
the regiment of mounted riflemen, of straw for sold
iers’bedding, end of stationery, including company
and other blank books for the aimv, certificates fo|

For the incidental expenses of the quartermaster’s

ment was without the consent of his parent or guar

AN AC T to authorize the appointment of Indian
Agents in Culiiornia.
Be it enacted by the Senate and House of Repre
sentatives of tbe United States of America iu Con
gress assembled, I tiat the President be authorized to
appoint, with the advicu und consent of the Senate,
not more than three agents for the Indian tribes within
the State ot California. Such agents shall perform
sin, and railway, at such harbor on the coast of the ! Aches now prescribed by law to Indiins, and shall
Pacific Ocean as he may select, of a capacity and di
mensions in no respect inferior to those of the dry dock
in progress of Construction at Pensacola: Provided,
That by granting the said contractors permission if
required to prepare the materials chiefly at some har
bor on the Atlantic seaboard, and advancing moneys
thereon as the work progressed, the said works can
be completed at a sum not exceeding by more than
twelve per cent, the total amount contracted to be
paid for the floating dock, basin and railway at the
Pensacola navy yard, with the addition thereto of
w hat what would he the cost of transportation to said
coast of the said materials thus prepared, and with
the reservation, till the works are done, of ten per
cent., and the usual surety for the faithful performance
of tiie contract, and the Secretary of the Navy shall
also be authorized to enter into an agreement with
the contractors, if they will keep the said works in re
pair, and lake proper care of the same for any given
period of years, free of charge t& the Government, to
permit them to u?e the said works, during such period,
on their own account, for repairing merchant vessels,
when not occupied by vessels of the navy, to which
precedence shall at all times be given, on such terms
as lie shall deem reasonable.

AN ACT making appropriations for certain Fortifica
tions of the United States, for the year ending the
thirtieth of June, one thousand eight hundred and
fifty-one.
Be it enacted by the Senate and House of Rep
resentatives of the United States of America m
Congress assembled, That the following sums be,
and they are hereby, approprialed, to be paid out of
any money in the treasury not otherwise appropriated,
fur the preservation, repairs, and construction of cet-
tain fortifications, for the year ending the thirtieth of

AN AC1 fur the payment of a Company of Indian
Volunteers.
Be U enacted by the Senate and House of Repre
sentatives of the United Stales of America in Con
gress assembled, That tiie Secretary of War be. and
tie is hereby, authorized and required to cause to be
paid to tiie spy company of Indian mounted volunteer*
(Shawnees and Delawares) called and mustered into
the service of the United States by Colonel W. S. Har
ney. Uui-ed States army, on tbe first day of June,
1816, and discharged the 31 day of August, 1346, one
day’s pay and alluwaaces forevery day held in service
under said muster, and the usual traveling allowances
according to the rates established fur volunteers under
existing taws; and the sum ot $4,000 is hereby appro-
pi iated for this object out of any moneys in the trea
sury not otherwise appropt iated.

AN ACT to provide forextending the laws and the
judicial system of the United States to the Slate of
California.
Be it enacted by the Senate and House of Rcpre-
sertahves of the United States of America, iu Con
gress assembled. That all the laws of the United
States which are not locally inapplicable, shall have
the same force and effect within tiie said State
of California, as elsewhere within the United States.
Sec. 2. And be it further enacted. Thai the said
State shall compose two districts, lo be called the
northern and southern districts of California, divided
by the thirty-seven parallel of north latitude. And
for the purpose of trying all issues of fact triable by a
jury in said districts, a district com l shall he hel 1 in
said districts, to consist of one judge, who shall reside
within the district to which h.» is appointed, and be
called a district judge, and shall in ail things have
and exercise the same jurisdiction and powers which
were by law given to the judge of the southern dis
trict of New York ; tiie said judge shall appoint a
clerk at the place at which a court is holden within
the district, who shall reside und keep the records of
the couct at the place of holding the same; and shall
receive for the services they may peifurm, for the
first four years after the passage of this act, double
lire amount allowed to the clerk of the southern dis
trict of New York ; and thereafter shall receive un y
the fees allowed to theeleik of tbe said southern dis
trict of New York, and may appoint a deputy.
Sec. 3. And be it further enacted. That tne j ,dg-
es of the districts of California shall hold extra
sessions at any time when the public interest may in
their opinion require the same.
Sec. 4. And be it further enacted. That the
judge of the'northern district cf California shu 1 iioid
two regular sessions annually at San Fiar,cisco, and
one regular session annually at San Jose, Sacramen
to, and Stockton, at the limes following, lo wii : at
S .n Francisco, on tbe first Mondays of December and
June ; at San Jose, on the first Monday in April;
at Saciamenio, on the first Monday in September ;
and at Stockton, on the s-cund Mondav in October.
Sec. 5. And be it further enacted. That the
judge of the southern district of Ca!ih,rnia shall hold
one regular session annually at the following places,
to wit: at Monterey, on the first Monday in June ; and
at Los Angelos, on the first Monday in December.
Sec. 6. And be il further enacted, And should
the judges of either of tbe said district courts fail to
attend at the time and place of holding any one of
the regular term3 of the court for either of said dis
tricts before the close of the fourth day of any such
term, the business pending in eorh court shall stand
adjourned to the next regular term thereof: Provi
ded, That whenever the judge of either of said conrt*,

shall have power to discriminate and purchase, in
such manner us he may deem proper, that kind of fuel

School at Annapolis, shali be at the rate allowed to
an officer of his rank when in service at sea.

said term, and to be published iu the several news
papers published in the bounds of said district the
same length of time ;and at any and all such interme
diate terms, the business of any such courts, of every
nature and description whatsoever, shall have refer
ence to and be proceeded with, in the same manner
as if the same were a regular term of said court.
Sec- 7. And be xt further enacted, That there
shall be allowed to the judge of the northern district
aforesaid an annual compensation of three thousand
five hundred dollars, ar.d to tbe judge of the southern
district aforesaid an annual compensation of twenty-
eight hundred dollars, to commence .rum the date of
their appointment* respectively.
Sec. 3. And be il further enacted. That there
shali be appointed in each of said districts a person
learned in the law, to act as attorney for the United
Stares, who shall, in addition to his fees of office,
which, for the first four years after the passage of
this act shall be double those of the southern district
ofNewYoik; and thereafter he shall be entitled to
receive the same fees as the attorney of the said
southern district of New York, and a salary of five
hundred dollars annually as a full compensation for
all extra *ervice».
Sec. 9. And be it further enacted. That a raat-
shal shall be appointed in each of said districts, Who
shall perform the said duties, be subject to the same
regulations and penalties, and be entitled to receive
