A.N ACT to jircvide Jurors for Special or Called
Terms of tbe Superior Courts of tho counties of
in is State f»r ilie trial of Criminal Cases.
Section 1. Be i/ enacted, That in the
event of any Judge of the Superior Court
of this State calling in auy couuty or
counties <d his Judicial Circuit a Special
or Called Term of the Court, the Jurors
drawn to serve for the Fall Terms of said
Court shall he compelled to servo as Ju
rors for said Special Terms nuder the same
pains aud penalties as are proscribed by
law upon a failure to serve-
Sec. 2. All laws militating against this
Act are hereby repealed.

the Penitentiary of this State.
Sec. 2. Be it further enacted, That, said
officers, mentioned in the first section of
this Act, shall hear and determine each
case {not civil) that may come bofore them,
immediately, unless good cause be shown
authorizing a continuance; aud in no
event shall a continuance be allowed for
auy time longer thau is necessary with
proper diligence to procure the attendance
of the witnesses, for and against tho pris
oner; JArocided, that nothing herein con
tained shall bo construed as to force the
prisoner to trial if, from Providential caus
es, he is unprepared.
Sec. 3. Be it further enacted, That all
offeuces shall be tried before said Court
upou written accusation, founded upon af
fidavit; said affidavit shall distinctly set
forth tho nature of the offence, the time
when committed, aud by whom commit
ted ; and the accusation shall follow tho
affidavit, and shall be signed hy the ac
cuser.
Sec. 4. There shall be no Jury trial bes
fore said Court, unless demanded by the
accused, in which event the Jury shall
consist of seven men, competent to serve
as Jurors in (his State, and when demand
ed by the accused, tho sai l Court shall
require their bailiffs to snrumous a jury of
twelve men, aod when said jury shall have
been summoned and assembled, the accus
ed and the accuser shall proceed to strike,
as provided heretofore in cases of appeal,
until the uumber shall have been reduced
(0 seven, aud when the striking bLall li.ivo
been completed, the Court shall order the
parties to proceed with the trial.
Sec. 5. Be it further enacted, That said
Court shall receive two dollars tor each

a written affidavit, in said Court, that, by
reason of his poverty, lie is notable to pay

the Superior Court should be, that an ap
peal i9 frivolous and intended for delay
only, said Court shall, in addition to the
liual judgment iu the case, enter judgment
against the appellant for twenty per cent,
damages ou said frivolous appeal.
'Sko. 2. And be it farther enacted, That
in all cases, when no appeal lies, or none
is entered, a Justice of the Bence, or com
missioned Notary Public, shall issue execu
tion, after the expiration of tour days,
(Sundays exeepted) and the levy shall he
advertised ten days, in case of personal
property, before the day of sale, which ad
vertisement shall designate (he time and
place of sale, and shall give a reasonable
description of the property to ho sold, and
shall be posted in three public pieces in
tho county. In case the levy is upon real
estate, it shall be turned over to the Sher
iff of the county and disposed of aa now
directed by law'.

where it shall clearly appear to tbe Court
that the accused acted maliciously, then,
and in that eveut, ;he accuser shall pay
the cost.
Sec. 6. Be it further enacted. That it
shall be the privilege of the defendant to
sue out a writ of certiorari, from the de
cision of the Court, under such rules aud
regulations as are now preserved for sue-
iug out certiurancs in civil cases ; Provid
ed, that no writ of certiorari shall be grant
ed unless the accused shall first have filed
his affidavit, setting forth that he is advis
ed and believes that he has uot had a fair
trial, and that he has beeu wrongtully aud
illegally convicted.
Sec. 7. Be it further enacted, That it
shail be the duty of the Court to have en
dorsed upon trie written accusatiou signed
by the accuser, tho following w'ords: “lu-
dictinent by the Grand Jury waived.”
And said endorsement shall be signed by
the accused or by his counsel, and in the
event the accused shall refuse to sign the
waiver, it shall be tbe duty of the Court to
proceed to hear evidence against the ac
cused, aud if probable guilt is made to ap
pear, it shall be the duty of tbe Court to
commit the accused, as heretofore practic
ed hy the Courts iu this State.
Sec. 8. Be it. further enacted, That
whenever any case shall be brought before
this Court for the purpose of trial, aud af
ter the evidence has beeu heard, it shall
appear to the Court that tbe accused is
guilty of an offence punishable either by
death or imprisonment in the Penitentia-
ly, it shall be tbe duty of the Court to bind
the party over to the next term of the Su
perior Court, to be held iu the county in
which tho crime was committed, to an«.
aw'er the charge preferred, aud on failure
of the accused to give bail required by tbe
Court, shall be cointnitt«jd to jail.
Sec. 9. Be it further enacted, That either
tbe Justice of the Peace, or Notary Pub
lic, when it is not convenient for both to
sit at the same time, may hear and deter
mine the case or cases submitted, and the
decision rendered by tho Justice or Nota
ry, alone, shall have all the legal effect as
if rendered hy the joint act of both, and
should the. Justice aud Notary fail to
agtee, it shall be the privilege of the ac
cused to say which one of the officeis pre
siding shall pronounce the decision, and
the decision so pronounced shall be, aud
the same is hereby made, the decision of
the Court.
Sec. 10. Be it further enacted. That the
county of Chatham is not embraced iu the
provisions of this Act.
Sec. 11. Be it further enacted. That in
the counties of McIntosh and Liberty uo
one -hdi be eligible to a position iu this
Court who is not an attorney at law.

to appoint Arbitrators in certain cases therein
mentioned.
Section 1. Be it enacted, Up:., That when
ever the Act of Incorporation of a Compa
ny for mining or other purposes, authoriz
es or requires the action of the Inferior
Court, or of tho Justices of the Inferior
Court of the county iu the appointment or
selection of Arbitrators to settle or fix the

Act, it shall and may ha lawful for the
Justices of the Peace an*l tbe Notaries
Public, appointed by the Governor, of the
several counties of this State, living in the
Militia district in which the county town
is situate, or iu auy Militia district having
company and the owner of the land, that
duty shall be performed by the Ordinary
of the cuunty in the same manner and uu
der the same circumstances that the Infe
rior Court or the Justices of the Inferior
Court were heretofore authorized and re
quired to appoint or select such arbitra
tors.
