trix of the last will and testament of John
Mcrcier, deceased, praying the foreclosure ot
the equity of redemption of all that tract or par
cel oflaiul situate and being in the county ot
Bryan and known by the name of Purnussus, ad
joining and contiguous to a tract of ihe like
number of acres of land belonging to Mrs Di-
incre and included under the same name and
description; mortgaged by Morris Miller in bis
life time to the said John Merciei in h ; s life time
to secure the payment of the sum of four thou
sand dollars i en ioned in a certain bond from
the said Morris iu the said John Mercier, bear
ing (lute the twenty third day*bf April, in the.
year of our Lord, one thousand eight hundred
and five: It is ordered that the principal and
interest due on said bond and the costs of this
proceeding, bo paid into court, within twelve
months from this date, or that from thenceforth
the equity of redemption of said mortgaged
premises be foieclosed; and that such further
proceeding’s take place ns the law directs. And
it is further ordered, that a copy of this rule be
served on the legal representative of the said
Morris Miller six monthsbefore the time at which
the principal, ir-terets and costs, aforesaid, are
required to he paid into court, or published at
h ast once in each month in one of the public
Gazettes of this state, until the time aforesaid.

Jones, late of the same county deceased, at tlie
t ime of tlie death of the said John E. Hartridge,
by two certain promissory notes, in the princi
pal sum of two thousand dollars, beside interest,
and that tfic said sum of money and the interest
thereon, remained due and unpaid, at the death
of the said Noble W. Jones, and that the same
and cverv part thereof now remains due and un
paid: and that to secure the payment of (fie
same, the said John E. Hartridge, in his lifetime
by a certain deed of Indenture or Mortgage,
hearing even date with the aforesaid notes, did
mortgage unto tlie said Noble W. Jones, hi9
heirs and assigns for o*^r, all that Lot or parcel
of land situate, lying anil being in said city of
Savannah, in the county of Chatlmm and state
of Georgia, and known in the plan of the said
city by the number seven, (7) Kyles Tything,
VlcuUhonuto Wuwl, together with «I1 and singu
lar, the edifices, buildings, rights, members, he
reditaments and appurtenances to the same be-
longing or in any wise appertaining: and all the
estate, right, title, interest, property,’ claim, ana
de mand whatsoever of the said John E. Hart-
ridge, of, in or to the same, and the eversion &
eversions, remainder a id remainders thereof;
and il further appearin* to the said court that
the debt aforesaid has not been paid according
to the tenor and effect of the aforesaid promis
sory notes-, but that there are now due upon
them the aforesaid principal sum of two thou
sand dollars, beside interest. And the said
George Jones, Executor as aforesaid, having
prayed the foreclosure of the equity of redemp
tion of the said mortgaged premises.
I his therefore, ordered on motion of Davis
& Drysdale, altornies for the said George Jones,
that unless the said principal sum of two thou
sand dollars, with the interest due thereon,
according to tile tenor and effect of the afore
said promissory notes and costs be paid into
court, within twche months from the date here
of, or good cause he shewn why the same should
not be paid, the equity of redemption of the said
mortgaged premises he from henceforth fore
closed, and that such further & other proceed-
mgs take pljicc* as are prescribed by the sta
tute iu that case made and provided.
.ind it is further ordained, That this Rule he
published once a month for twelve months, ia
one or more of tlie Gazettes ot the City of
•Savannah, or be served on the heirs or repre
sentatives ot the mortgagor, at least six months
previous to the time required for the payment
ot the said sum of money into bank.

ing now shewn to the court, and the statement
in the petition appearing true—It is ordered
that the principal and interest of said sum and
the costs of these proceedings he paid into
court, within twelve months from the date here-
of; or else the equity of redemption in and to
the said mortgaged premises will be foreclosed
according to the act in such case* nude and pro

.Ind it is farther ordered, That this Rule he
published in one of the public Gazettes in this
state, at least once a month for twelve months,
or served on the mortgager or lus special agent
or attorney, at least six months previous to tho
tune the money is directed to be paid.
