From the Albany Journal, April 7.
The act, which has this day become a law, i>\ res
pect to tbo sale of intoxicating liquor in this State,
will bo found ou our first page, in lull. We give here
A luminary of its provisions:
Intoxicating liquor, in any shape, must not be sold,
or kept for sale, except by regularly authorized pet*
sons for manufacturing, medicinal, chemical aud sac
ramental purposes.
It must not bo given away, uor kept at all, except
In dwelling-houses not connected with any shop or
place of amusement, iu churches, iu manufactories,
and in actual transportation.
Any person maybe authorized to sell for the above
purposes, provided he does not use liquor ns a bever
age, Is au elector, is not interested in any shoo, boat
or placoor entertainment, can prove good moral char
acter, and give $1,000 security not to sell for an
other purposes. He must sell only to persons over
21 years old, whom he has reason to believe will lire
it for one of the above purposes. Ho must keep a Ikt
of bis sales, which he must file, and swear to, in the
county clerk’s office, every month. This list is to be
open for public examination. If ho violates any cf
these regulations bo forfeits all his stock of liquor, Is
fined from $50 to $250, and may bo imprisoned thirty
days.
All county, city, police and justices’ courts have
coffnii&nce or cases under the act.
On complaint and on a warrant, suspe rted places
may be searched, but no private dwelling-house can
be, unless the owner has been convicted of selling
liquor In it, within the previous year.
When liquor is seized, notice must be given to the
owner. Ir not adjudged forfeited, it will be returned
to him. If adjadged forfeited, It will be destroyed,
and the vessels containing It sold.
Persons summoned as witnesses, who refuse to tes
tify, will be sent to jail, Persons becoming intoxi
cated in taverns, groceries or tho street, will be llnvd
$10, besides being made to testify where they g.,t
their liquor. All fines go to tho suppoit of the poor.
Upon tho trial, proof of any sale, will bo deemed
proof of unlawful sale, unless the seller can prove
the contrary.
Persons suspected of having violated the act. ate
disqualified from acting as jurors in cases under it.
Llqnor transported anywhere in the state, in quan
tities over fivo gallons, most be marked "Intoxicnt.
log Liquor,” and with tho namo of the poison to
whom it is going.
Cider may bo sold in quantities over ten gallon?,
but none must bo drank on the promises. Manr.bu-
tnran of alcohol and of wine from grapes grown by
themoelves, may keep and vellthcm. Burning fluids
varnishes, perfumery, essences and d ugs, may hue-
wise be freely made and sold. Imported liquors may
besoldln the original packages, by the Inipoitcr,
bmtooly to persons authorized a9 above to .-il at
All liquor kept in violation of the act will he deem
ed a nuisance.
No more licenses shall be granted. This provision
takea effect immediately. «
The section in respect to authorizing agents to sell
formanofoctaringandmcdlciual, chemical and «-n-
cromentat purposes, takes effect on tho 1-t or May.
