A most important decision bus lately been an
nounced by tbo Court of Sessioua iu Scotland, which
has given an entirely new aspect to tho question of
marriage with a deceased wile's sister. It lias b.en
constantly asseited in Parliament aud elsewhere, by
the Mipporterx ol the Bishop of Loudou’s clause iu
the Act commonly called Lord Lyudhufet'x Act, (6
aud 6 Will. IV., c. 64) that suco marriages arc to
tally repugnant to tbe ancient laws m well as tbe
muderu feeling* or Scotland. So much wm that as
sumed to be tbe case that tbe Scotch claimed ami
got exemption Irom all operations of that act, be
cause they repudiated the ratification of past mar
riages of efflulty, which Lord Lyndhutst provided
for England.
It is stated in Mr. E. B. Denison’s pamphlet on
the “Validity of Marriage with a wife’s sister, cele
brated abroad," that uuiess this marriage it a capi
tal felooy, as ail incest is by tbe law of Scotland,
there is no prohibition of it whatever in tbe Scutch
law, that incest is expressly defined by tbe Scotch
statutes to be a violation or the express prohibi
tions of tbe 18tb chapter of Levilicua, and that all
marriage* nut su prohibited ere declared to be law
ful.

been pending for several years. The Lord Ordinary
declares that he would willingly defer to the authori
