3b John Heart, Esq., and IV. It. Taber, Jr.,
Esq., Editort Charleston Mstcury :
Gentlemen s—You have, after repeated
threatenings, and with deliberation, published
and circulated insulting and libelous attacks
upon my . brother, Judge Magrath. Toellect
this, you havo put aside the habitual propriety
of a Charleston newspaper; and disregarding
the taste aud sentiment of the community,
havo emulated the corruption and licentiousucss
of a venal press elsewhere.
You have done this without provocation, or
the excuse of excitement, aud in the face or re*
latlons with Judge Magrath, proving upon both
of you personal estimates of him in private ex
actly the reverse of those you have endorsed
aud published. Herein is tne proof of your do-
liuqueucy, either in your private intercourse or
in your pubho conduct. You havo, ills Uue,
attempted to interpose the protection and veil
of au anonymous correspondent; this could not
serve you in any evout. In your seeming anxi
ety to secure it, you have, by an apologetic par
agraph, in yoar own names us Editow, endorsed
the libel. 1 am thus relieved of all duestiou as
am thus relieved of ali question as
to whom I should address myself. You know,
in attacking ouo exercising judicial functions,
that, as to Aim, you would be exempt from the
| lersonal accountability, I claim at your hands.
Ton will not doubt my right to do so. How far

your supposed security may havo sharpened

ilefore I take notice of the simply persona/
aspect of vour note to myself, I have u word to
say touching its bearing to me, as the conductor
of a public press, its relation to Judge Magrath
and tho party who has given the cause of of
fence, for which you seek revenge. You are an
intruder, and you intrude to commit an outrage
upon the liberty of tho press. Either through
malice, or from calculation, you turn aside from
the avowed responsible author of the disquisi
tion upon the merits of your brother as a candi
date, to the conductors of a public journal, who
would give u chance to truth and to tho discus
sion of the qualifications and character of can
didates for tho highest public trusts. You u»-
surae to represent tbe honor aud manhood of
your brother—an avowed candidate for tho
highest office m our gift—and by your iutorisr-
euce to reduce his honor aud manhood to a vi
carious existence. I do uot admit that, when a
candidate by his own consent, he con avoid the
proper, necessary responsibilities of his position
as a candidate.
If a Judge, he is no less a candidate. He
cannot legitimately put his character in com
mission, and maintaiu his honor by proxy. If
he con resign his seat to go into Congress, he
can resign it (if necessary) to vindicate his
honor. He has no right to be a candidate if
he is to cease to be a man. The sheltor of his
Judgeship is without the countenance of prin
ciple. It is a refuge, without manhood and
without character. Rut truth shall not he
muzzled, thoughihe be a Judge, and the “liber
ty of the press 0 shall be maintained, even
against the vicarious champions of his man
hood and the intrusive representatives of his
honor. Thns much for your warrant to insult
ine and to represent your brother. But you
nave insulted me, and you shall not do bo with
impunity.
Prutcatiog, therefore, against your right to
call upon me, either as a man or editor, your
right to assume your brother’s proper responsi
bility, your attempt to stifle by the pistol the
freedom of discussion, I nevertheless waive all
this, and consent to meet yon. My friend, Mr.
Burnet, will make tho necos9ary arrange
ments,
Your obedient, servant,
W. R. Taber, Jr.
In pursuance of tho above correspondence
aud by the arrangements of the respective
friends named in it, the parlies met near the

An earnest conference between the seconds
then ensued looking to an adjustment. They

His suggestions were nt ouce respectfully re

Col. Cunningham offered in writing, the fol
lowing settlement:
“Tbe following are tho terms of adjustment
between Mr. E. Magrath and W. R. Taber, Jr.,
after an exchange of two shots:
“Mr. Taber disclaims, as an editor of the

“A Nullifier,” he Intended any attack upon
the private character of Judge A. G. Ma

“Mr. Edward Magrath disclaims that in his

The young lady was accordingly placed at
—, at Hammersmith, and lor a time the
hoped-for change seemed to have taken place
in her temper. But, attorn while, it appears
that the hurst of violenco to which she gave
way, and tho fits of depression which succeed
ed, liccame ho alarming as to eaiwe serious
fears of her health. Letter after letter was
despatched to her guardian first tho young la
dy fieiwlfheggiug to be taken into favor, de
claring that the climate of Euglund was weigh
ing her to the earth, and tlie discipline of
Hammersmith breaking her heart.
Tlie Prince de 8. univedut HammerMHith
nuo Sunday morning. Ho returned uo answer
to the lust letter despatched by his ward, and
slm was, therefore, not aware of his intention
of arrivlug. The lady commissioned to te
hearer of the uews reported to have found her
ou her knees alone in her room, praying, with
a most fearful expression of countcnante, and
on being informed of her giiurdian’s univul
she had uttered a most uucaitlily shriek, and
rushed down the stairs like oue possessed.
The guardian was much pleased with tho
a rcs* and improvement, und brought her
to Purls triumphantly, usu epecimeu of
the good training of the ladies of Hammer
smith. There was, indeed, no token of the
old indomitable spirit left within her. She wua
slleut and subdued, submissive to ull, aud ouiy
urgent iu her supplications never to bo loft
uluue or in the dark. She always persisted in
maintaining that it wus useless to lay any
ohms for her welfure, for that she should die
before she was twenty-one! Even when sho
became tbe bride of Prince Leou, sho would In
sist upon every arrangement being made with
a view to this early death, which seemed to
prey upon her mind foreyer. It wus not till
the young couple had beeu married for some
time that, by diut of maternal care and solici
tude, tlie confession was wrung from her that
snohadsold herself to tho Evil One, aud that
she would be claimed before sho reached tlie
age of tweuty-one! Sho confessed that her
despair hud been so great at being exiled that
sho liud addressed her vows to the powers of
darkness on the very Sunday morning when
her guardian bad arrived, mid the announce
ment of his preseuco was evidoutly the token
of the acceptance of that fearful vow.
It seems thnt.iu spite ofevory oaro and coun
sel—despite 6f the constont wutching aud wire
teaching of the Abbe Dupauioux, nothing could
turn aside this ideejlxe from the mind of Prin
cess Eleauore! and, although every extreme of
dissipation and excitement was tried to divert
her thoughts, sho gave way to a Rottled melan
choly, nnd diedjusttwodaysheiorethe com
