TRicT of Georgia.
[L. S.) Charub 8. Hznbt, Clerk.
To the Marshal of said District. Greeting : v
WK«H“a:±sr!.t ;
the name, firm aud style of Joseph FineKan a Co,, of
FJoridu, havo exhibited their 'ibel-ln theUnlted dates
District Court for the Southern District of Georgia,
stallug* alleging and propounding that on or about ■ 1
the twenty first day of June, in tbe present year; it ...
was agreed between the agents of tbe ship Parlia
ment theu in Liverpool, and the agents or tbs safe
libellants, that tbe said ship Parliament should pro
ceed to CardUT, aud thence convey a cargo of rail-
road Iron, not exceeding twelve hundred tons, to
Fernandiua, Amelia is land, Florida, and deliver the
same, oa being paid freight; that, at tbs titn* ol
maklug said agreement* it.was represented by the
agents of said ship, that with the said cargo shs
would draw from eighteeh to nineteen feet only:
that it was further agreed, if on - arrival-off Amelia
Island, it should be ascertained, from the pilot, that -
there was not sufficient water to admit the ship so '
that she could get up to Femandina, the
should have the right, upon having the fact duly
certified by a licensed pilot, to proceed to hi.
Marys, Georgia, or, if the same objection applied t<
that port, then to go-to Savannah,or so near therstt
as she might safely get, and there dsllverJief cargos
that the said ship arrived off Amelia Island on the
morning of the twenty-ninth or Septembers when
the master or said ship represented that shs. drew > •
nineteen aud ene hairieet ofwater. aud there being
on the bar, on thatday, lull twenty feet or water,
there was amply sufficient to admitlho ship: never-
tholets, tho wind being adverse, the said ship did
not attempt to enter; that* on tbe following day
tbo wind having in the meantime continued to blow
from the west, and thereby greatly reduced the
wafer on the bar. tho master of the said ship ob
tained from the pilot in charge a certificate that the
said ship drawing nineteen and one half feet of
water, could not cross tho bar that morblng, and
Immediately aud without further delay, sailed away
tor Savannah; that at the time when the said ship
so sailed away* tho weather was periCotiy (Sir, ana
has so continued hitherto, and the anchorage per
fectly secure, and that It is toe custom for snips
and vessels to wait a reasonable time for favorable
winds aud tides to cross ail bars, and this tbe mors
especially at those ports where the aid of steam
cannot be obtained; that there is reason to beliav$' >
that tbe master of tbe said ship exaggerated her
drought, and that tho same did not exceed nineteen
feet os represented by her agents st tho time of
making the said contract 5 but that, even with ths
drought ol'nineteen and one half feet, the said ship
could havo crossed the bar on divers days since •
•be so sailed away, and without having been com
railed to wait more than a reasonable time after
ier first arrival; that, before the arrival of ths said
ship off Amelia Island, the owners thereof. Enoch
Train k Oo.* of Boston, bad issued to the muter ot
said ship positive orders to proceed at once to Sa
vannah, in violation or the said contract, and that
tbo subsequent proceedings or the said muter were
merely a pretext to shield his owners from legal
responsibility for Buch violation ; that the said mas
ter, although requested so to do, refuses to proceed
to Femandina and deliver his said cargo, butinalste
on delivering the same at Savunnah on being paid
full freight; that, by reason of too said premises
tbe Bald Ubellaute will bo subjeoied to great loss'
damages and expenses, tor which they are justly
entitled to compensation from the said ship; and
they therefore pray that process, in due form of
law, may issue against the said ship Parliament
her boats, tackle, apparel qnd fornitnre. and tba
tho said Court will pronounce in fevor of the said
fibellauu, that the master orsald ship shall deliver
tho said cargo to them, free and discharged from
all claim for freight for tbe transportation thereof!
or iu default thureOf, that tbe said ship may bs
condemned in such amount or damages u the Court
may decree tbe said libellants have sustained, and
or such other und iurtber relief as to right andjus>
tloo may appertain and the. Court iu competent to
givo in tho promises.
And whereas, the Honorable John G. Nlcdll. tba
Judge or tbe said Court, hu ordered and directed'
the eleventh day or November next, for all persona
in general, who havo or pretend to have any right,
title or interest in tbe said ship Parliament, tour
boats, tackle, apparel and ftirniture, to be - cited at
the premises, to appear before the Judge oi said

You are, therefore, hereby authorised, empow
ered and strictly oujomed, peremptorily to cite aU

any right, title or interest iu the said ship Parlia
ment, nor boats, tackle, appaiel aud furniture, by
