TV cases of the State of Maryland
vs. M.. lison J. Marnns, of Augusta, Go.,
indicted on the charge of obtaining
goods on false pretences in Baltimore
last fall, \rere decided yesterday in the
Criminal Court, his Honor,| Judge Gil*
mor, sitting as judge and jury, the pris
oner having elected to have his trial be
fore the Court Too trial occupied au
entire week, haring been begun on the
2*2<1 inj-tunt, and attracted very general
interest throughontthocommunity, more
especially among the mercantile classed.
Six indictments were found against the
accused, one of which was baMsl on
charges preferred by Messrs. M. L.
Straus .t Co., whoh.sale fclothiers, 2oO
West Baltimore street, from whom there
was obtained merchandise valued at &V
300, being the largest bill bought by
Mr. Marcos.
The other indictments were on charges
of Messrs. Hurst A Co., dry goods deal
ers, 241 West Baltimore street; Messrs.
Baker, BruiY & Co., wholesale dry goods
dealers, 245 West Baltimore street:
Messrs. WicsonfoM A Co., wholesale
clothiers, 232 West Baltimore street; and
two indictments on similar chargee by
Messrs. Hoclit A PatzeJ), boot, shoo and
hat dealers, :>02 West Baltimore street.—
The amount bought by the accused from
those several houses aggregated about
^7,000. Mr. Marcus was arrested in Au
gusta lost September upon u requisition
from Governor Bowie, and brought on
and lodged in jail in this city. In a week
or two thereafter his connsel, Col. J.
Fairfax McLaughlin, procured his re
lease, Hon. John M* rryman, < instav
Ober, Esq,, Col. It. M. Johnston und
Solomon Murcup, Esq., appearing as
bail for the aeons d in the penalty of
$15,500.
The varionsindictments, by agreement
among connsel, ycre tried together, and
t uo test case was that of Messrs. Straus
A Co., the evidence developed in this
being supported principally by tlmt
brought out bv the witnesses for the
same house, and for those of Messrs. Ba
ber, Brill! A' Co., and Messrs. Jlcdit A
Patzall. The prosecution abandoned the
other indictment*, tho testimony not go
ing to provo the cases for the State. The
speeificati *ns alleged against Mr. .'larcns
wero embraced under four heads, viz:
First, that be represented his business in
Augusta ns a cash one, and that it reach
ed ^23,000 to 30,000 a yt»nr; second, tlmt
lie represented bis stock on hand nt the
lime of hia purchases nt about $h,O00;
third, that he represented himself ns free
from debt, and lourlli, tlmt he rej'tvsent-
ed himself as ownii g *2,000 in real es
tate in Elberton. (J* orpin. To these sev
tral statements tin* indictments plead
negative averments, and issue was joined.
The arguments of counsel extended
over throe days, and nt tlieir conclusion
on ycstcnliv, Judge Gilmer summed up
the entire evidence and law of tho case
in a very full and interesting manner,
.and laid it down sis n well-set tied princi
ple of law that the actual condition, the
liuancial ability, and the solvency in con
nection with the r* presentations of the
accused nt the time the purchases were
made, constituted tho gratuuu-n of the
ease, and tlmt in order to make it out on
the part of tho State tho representations
of tho accused must be proved to have
Leen false, and the goods obtained by
iiicau c of them; they* < ntcr or fraudulent

in question it was proved by various wit
nesses, among others by the clerk of tho
accused, that liis business was substan
tially ns great as ho represented it to be;
