have some coca meats to make:

may be to many persons, yet, the doubt it
founded on most grave reasons
Booh an office is unknown to the pres
ent, or my former, GonOitulum of this
State. It is not a qouditulional office.
The Constitution provides that the So
preme Court shall be constituted, or com
posed, of “three Judgm.” Not a word
about a “Chief Justice," nor even about
any "Jastioe." There ere three of them
and they are til Judge.—nothing less,
nothing more. The Constitution gives
each of the three, the toms power md
tha some OyU. They are all “ Judgei,
and they all have ajual store> in the Ju-
risdiotaou and functions oonferred upon
tha Court So the Constitution creates
theca, end so it leaves them—each the
saare as the other two, in functions and
in style.
The Judiciary is one of tha three co
ordinate md independent (Departments
of the Government. Can its composi
tion, or the style of its component parts,
as that sesspaeitien end that style are de
fined by the Constitution itself, be
ehangal by either of the other two co
ordinate Departments ? Cm the Legis
lature make any change in this composi
tion or in this style, either by subtrac
tion or addition T If by addition, why
not by subtraction also f If by addition
to the tfyfa of the component parts, why
not also by addition to their number f
Why not as well say that the Supreme
Court shall have two Judges added to
the constitutional “ three,” as asy that
one of its Judges shall have the style of
“Chief Jastioe" added to his ooustitu-
tional style of “Judge ?"
This whole fabric of a “Chief Jus
tus" rests solely upon a dilatory Jounda
lion. The statutes which brought it into
fashion (only two in number, so far as we
an aware,) are of recent date, md have
never undergone the test either of ju
dieial examination or pubtta discussion

of 1863; md the aeoond, modifying the
first, is the Act of 1866, a

win's Revised Code. Are not these stat
ute* inconsistent with the Constitution,
and, . therefore unconstitutional, null

The vaoanoy created by the resignation
of Judge Biown occurred whan tbs Gen
eral Assembly was not in session, and,
therefore, it wes a vacancy to be filled
partly by the Governor and partly by
election of the General Assembly; by the
Governor until the Legigntnre mot, md
mow by Legislative election lor the re
mainder of Judgo Brown's unexpired
term. Cm there be any donbt that the
General Assembly ought immediately to
elect a Judge of the Supreme Court to
fill the remainder of the nnexpired term,
whieh was left vacant by the resignation
of Judge Brown ? It seems to ns that
there oannot lie. Let the Legislature,
then, prooeed promptly in the discharge

The Office of Chief Justice.
The pnbho eye is being directed to this
high office as the true objective point
in present political mancauveiing.
Whether there be a ring inside of the
Democratic party, or whether there be
no ring amoug those who are numbered
among the faithful, it has come to be
oonceaed that political issue* in State
polities (and after all, these are the issue*
about which our people conoern them
selves most) must take a new departure
upon the election question, wliioh con-
oaals but comprehends the real political
objective point
An “Inquirer” oaks us to publish so
much of the Constitution oa may bear
upon filling the office of Chief Justice,
md puts to us some pertinent questions.
This request we oomply with to the ex
tent of our ability.
Section IX, Article V of the Consti
tution, Paragraph 1, reads u follows:
‘(The Judges of the Supreme and Supe
rior Courts, the Attorneys-General, the
Solicitors-Generel, District Judgoe md
Attorneys, shall be appointed by the
Governor with the advice md consent of
tbs Senate, md shall be removable by the
Governor on the address of two-thirds of
each branch of the General Assembly."
This clause in the Constitution points
out the mode in which the offioee of
Justice! of the Supreme Court are to be
made ab initio, ana also, when the terms
of office have expired, but makes no pro
vision for vacancies. The appointing
power is lodged in the Governor, by and
with the advice and oonsent of the Sen-

But Article IV, Section II, Paragraph
IV, oovers the case of all vacancies, and
reads as follows:
“When any offloe shall become vacant
by death, resignation or otherwise, the
Governor shall have power to fill suab
vacancy tiniest olherwite provided by law ;
md persons so appointed shall oontinue
in omoe until a auooeaaor is appointed,
agreeably to the mode pointed out by
the Constitution, or by law in pore omoe
thereof.”
A vaoancy ooourred upon the resigna
tion of Chief Justice Brown. Tbiavocan-
OV was filled by our late, now fugitive,
Governor. This appointment holds fill-
shall not pay to any of tbo late officers
of slid road, or to any of the persons
now claiming to be officers of said road,
or to my psrtom appointed by Rufus B.
Bullock, late Governor, as Commission

or to my other person whomsoever, my
part or portion of the said balance re
maining in their bonds.
Resolved farther, That the Treasurer

set forth.
Provided, that nothing in the foregoing
reeolations be oonstrued as expressing

The Constitution prescribes its own
mode of making appointments of Judges
of the Supreme Court far tall or entire

vacancies, except the general one that

II, Artiolo V, reads as follows:
‘At the first appointment of Judges
of tbs Supremo Court under this Consti
tution, one shall be appointed for four
yeara, one for eight years, md one for
twelve years, but all subsequent appoint
ments, except to fit unexpirctl term., shall
be for twelve years." Hore the exception
indicates that the Legislature is expected
to provide by law far itnexpired terms.
Now, we sec no reason why Chief Jus
tice Loobrme should not continuo to fill
tbo offloe, should “Governor" Conley
omit or refuse to send in a name for con
firmation to the Senate. Wa know of no
law wliioh compels Governor Conley to
send for confirmation a name to fill a va
cancy (which has already been filled, in
tha ahaanea of my taw which would pro
vide for filling such vacancies. Suoh a
law should exist, md should restrict the
time of such appointment* to the meet
ing of the next General Assembly en
suing, md should make It obligatory
upon the Governor to nomiuutc for con
firmation, and, in default of such nomi
nation, to provido for an eleotion by the
Senate. We find no statute which make*
it tho duty of the Governor to send
withiu any givun period, or ut any par
ticular time, nominations for confirma
tion by tha Hentte, when vacancies occur.
Suoh m act, it appears to us, rests
solely in the discretion of the Executive,
or outing Executive. But we seo uo rea
son why tho Legislature should restrain
from making such a law, to take effect
from md after the passage of the act.
There are more questions involved in
the interrogations of "Inquirer," some
of whioh we are not prepared to answer;
bat, as his chief desire is to bring the
matter to the attention of the legisla
ture, wc feel Uut we here accomplished
tha end he desired.
