The error complained of iu this cue is
that the oonrt below allowed the plaintiff
to dismiss bis cue after the same had
been anbmltted to the jmy, and white!
they had been considering the same for
some time in the jury room. The tight

When the jary name into oonrt in the
oasenow before ns, after the plaintiff's
motion to dismiss it, nverdiot, it appears,

bad been agreed on by the jary for the
defendant, written and signed by the
foreman, but there is no eridenoe that
that fact was known to tbe plafuiiff or
his oonnsel at the time the motion to
dismiss the case was made. If it had
been shown to the oonrt by oompetent
evidence that the plaintiff had snrrepti-
tionsly or otherwise ascertained that the
jary had tonnd a verdict against him be
fore trie motion was made to dismiss the
case, and that the oonrt had then refused
to dismiss it on that aooonnt, we should
not hare been disposed to interfere with
that judgment, bat nothing of that kind
wm made to appear to the oonrt in this
esse.
Let the judgment of the oonrt below
be affirmed.

Simon Orogan vs. H. G. Christie, et a'.
Mew trial from Terrell
WARMER, C. J.
Tho error complained of in this case,
is the granting of a new trial by the Oonrt
below. The main facts of the case are
as follows: Orogan and JordoDjpnrohasod
a tract of land with a mill thereon from
Christie, who jxeonted to them bis bond
to make a title thereto when the pur
chase money therefor should be paid,
Orogan wont into possession of the land,
and alleges be has paid all tthe pnrohase
money, that Jordon relinquished all his
interest in the land !to him. The evi
dence in tbe record ndon this part of the
case is somewhat conflicting. It appears,
however, that Christie, after he had sold
the land to Crogan and Jordon sold it to
Smith, and made him a deed dated 1st
of November, 1869. Smith] sold |the
land to Jones, and made him a deed
dated 4th of August, 1868. On the trial
of the case, the Oonrt eborged the jury,
that Orogan acquired no title to the land
under his bond for the title, unless, all
the pnrohase money was paid, and even
if it wm all paid, Christie having made
a deed to Smith covering the land in dis
pute, the plaintiff wm not entitled to
reouver unless the proof showed that
Smith had notice of the fact at the time
of pnrohase, and the mere fact of Oro
gan being in possession of the land was
not sufficient notice to Smith. Tbe jury
found a verdict in favor of Orogan.
Whether the oonrt granted tbe new
trial because the jury found contrary to
the oharge of the court, or because the
verdiot was contrary to the evidenoe,
does not appear in the record. If Cro
gan wm in possession of the land at the
time Smith purchased it from Christie,
that fact wm constructive notice to Smith
at leut, and sufficient t > hare put him
upon inquiry m to the obaraoter and ex
tent of Urogan's claim of title to an in
terest in the land, and the charge of the
court was error in regard to that point in
the case. In view of the evidence con
tained in the record, and as there is some
doubt under the evidenoe whether Oro
gan wm in possession of tbe land at the
time of tbe date of Smith's deed, we will
not interfere with tbe judgment of the
oonrt below in granting the new trial.

WARNER, a J.
The plaintiff held an execution against
the defendant, Lu -y J. Bonnell, for the
rent of a house and lot. The defendant
wm a widow who had a homestead set
apart for the benefit of herself and her
minor children on a tract of land with
which the house and lot rented by her
from tho plaintiff in fl fa, had no con
nection. The widow rented her home
stead plantation to Ward the garnishee,
and the question in the oase is whether
the rent due her for the use of her home
stead from her tenant is subject to the
payment of the plaintiff's debt for the
rent of a house and lot wholly disconnec
ted with her homestead ? The Act of
1869 declares that tbe prodnoe, rente
or profits of a homestead shall be ex
empt from levy and sale, exoept M pro
vided in the Constitution, and except for
stock, provisions and other art idea used
in making the crop, neoesaariM for the
family, medical services and tuition for
education. The rent of a house and lot
wholly disconnected with the homestead
is not one of the exemptions mentioned in
the Aot, but it is said it is included in
the words, "oecessaries for the family."
Bat we think tbe fair interpretation of
these words, when taken in oonneotion
with the other words of tbe act, and the
obvious intention of that act, is to con
fine them to snch necessaries for the
family as may have been furnished in
making the crop on the homestead; in
oth<r words, the necessaries for tbe
family moat have been famished them
in ojnnectu u with the enjoyment of the
horn ear sad property, such m was neces
sary tor the family in the cultivation of
the stops raised thereon, and for the
support of tbe family wmlat doing eo to
enable them to enjoy the benefit thereof.
A contract for tbe rent of a house and
lot, having no connection with the home-
rtrad property whatever, la not, in our
judgment, v rithm the purview of the
act, or in accordance with the true intent
and meaning thereof, the more especially
M it dess not appear that it wa
■anas for the family.

It is not sufficient to make a mortgage
lien (good against a homestead end ex
emption under the set of 1868, that it
was given in lien of another mortgage
on the property, ankm it farther appear
that file first morgage or lien was s lien
superior to the right of homestean.
There is nothing in the record which
shows that tbe ordinal lien or mortgage
wm good iu spite of the homestead,
either by the laws of Alabama and Geor
gia.
