The Federal Government has the
right, of course, to prescribe the
terms upon which arms and accou
trements fhri>||hed by ifrelf, shall
be distributed; just as the several
States have tlje right to decide, each
for ilselt whether they will apply for
the arms, according as those terms
may or may not be satisfactory.
It remains to be seen whether the
Governors of the States entitled to
the arms will make application for
them at all. Our own State Legis
lature, for example, has prescribed
one rule of distribution, while the
act of Congress lays down another,
and a different rule.
We were wrong, therefore, in say
ing that “npon notification from mil
itary companies organizing, as to
what kind df artns are desired, the
Governor will make requisition there
for after the first day of July.”
Should Governor Smith decide to
make application for the arms, and
shoiild tne War Department honor
his requisition, due notice of the fact
will be given to all interested.
