Treasury-and whereas the Sccieiary ol the Treasury did
on the day of in pursuance of said act,
locate the said thirty-six sections of land on both side*,
of the Tombigby rivei, in the then M ssissipp. now Ala-
baira territory ; being township No. ten, range two west,
and sections number thirty ami thirty-one in township
number ten, range one west—And whereas the board of
trustees of said College, deem it a duty by ail honorable
means to promote and carry into effect the benevolent
views of Congress, by iacditatmg the interest of the said
institution, Therefore, be it resolved, that one half ol
the said thirty-six sections of land be let to lease.
2. Resolved, That the half to be leased shall be sec
tions, No. 1, J, 5, 7, 9, 11,18, 15, 17, 19, 21, 23, 25, 27,
29, 31 ami 33, on the map of tlie township, and also sec
tion 31, in township ten, range one west of the same map
3. 'That the leases for the said lands shall be for nine-
ty-mne years, renewable ad-mhniiuin, with an annual
ground rent of one cent.
4. That all leases shall specify the rent agreed on, bow
and in what manner payable, will a right of re-entiy, if
tire terms ot the lease are not complied with.
5. That all leases shall be signed by the president of
the board of trustees ot saul college.
6. That all leases shall be con ructed for by offering
s.nd land in quarter sections, to the h.ghed balder, unde
a notification of the pres dent ot Hie board of trustees of
said college, giving inioniiaiion ot the time and place,
which shall nut be h*« limn forty days.
7. That when the river divides any section so the same
cannot be leased by quarters, such divisional parts may
he leased entire, or ny dividing or unit.ng them with o-
diers, at the discretion of the agent of the board.
8. That no tract shall be leased tin* less than two dol
lars per acre, payable m the following manner, to w.t:
One fourth part to be paid at the tune of executing the
lease; another fourth part within two years; anodic
fourih part within four years, and the other fourth par
within six years from the date of the lease.
9. That all sums not paid at the time of executing any
lease ; the party leasing shall g.ve bonds with a penalty
of double die amount of rent contracted for and unpaid.
10. Interest at the rite of six percent a year, from the
wt of the lease, shall be charged upon the three lust
payments, if not punctually paid as they rcspect.vely be
come due.
11. A discount at the rate of eight per cent a year,
shall be allowed on any of the tlnee last payments winch
sbali be paid before the same shall become due, reckon
ing this discount always upon the sum which would havi
been dcmundable on the day appointed for such payment
12. \t the expiration of seven years from and after the
dale of any lease, if the whole amount, with interest be
not paid, such leas'e shall be void, with a right of re-entry
on the part of the trustees and then* successors, and all
sums previously pa d forfeited to the college, as damage
assessed betw een the parties.
