Decision of ihe Court of Enquiry.
After a full investigation of such
evidence and circumstances as have
come to the knowledge of the court
in the course of its proceedings, a
correct flatement of which is here
unto annexed, and after mature de
liberation upon the fame, the fol
lowing opinion on the amount of the
testimony, is refpectfully submit
ted.
It has been proved to the fatisfac
tion of this court, that brigadier
general James Wilkinson had been
engaged in a tobacco trade with
governor Miro, of New-Or!eans,
before he entered the American ar
. my in 1791 ; that he received large
funis of money for tobacco deliver
ed in New-Orleans, in the year one
thousand seven hundred and eighty
nine, and that a large quantity of
tobacco belonging to him, was
condemned aud stored at New-Or
leans in that year; but it has not
been proved, and alter the fulled
investigation and comparison of tes
timony in poifoffion of the court, it
does not appear, that he has receiv
ed any money from theSpaniffi go
vernment or any of its officers,
since the vear one thousand seven

hundred and ninety-one, or that he
has ever received money from that
government or its officers for any
other purpose but in payment for
tobacco,- and other produce, fold
and delivered by him or his agents.
It has been stated by the general,
that after hi> damaged tobacco had

it and remitted to him, the several
sums, credited in the copy of an
account current presented by him
and marked No. , and under
the imprtffiorr that the letters ac
companying the said account were
wi itten by his said agent Philip No-
Jan, the court think it highly pro
bable tha r the statement is corred.
They however do not conftder the
verity of it of the least importance
in the case, (nice, if he did receive
the money as Rated, the tranfadion
was .fully juftifiable; and if he dfJ
riot so receive it, there is no proof
of his having received it at all.
It is thei fore the opinion of this
court that there is no evidence of
Brigadier Gen. James Wilkinson’s
having at any time received a pen
ficn from the Spanish government,
or of his having received money
from the government of Spain, or
* any of its officers or agents for cor
rupt purposes: and the court has no
hesitation in faying, that as far as
bis condud has been developed by
this enquiry, he appears to have
difeharged the duties of his Ration
with honor to himfelf, and fidelity
to his country.

We likewise offer the following
flatement relative to the treatment :
of the Osage on the fame authority j
a flatement which lias become the
i more necessary from the numerous
wilful falfehcods with which the
federal prints teem.
On the arrival of the Osage at
L’Orient, she was arrested by the
{ cuflom*houfe officers, conformably
> to their general inftru£tions, in con
! sequence of having been spoken by
! a Britiffi vessel. Mr. Lewis ini me
■ diately proceeded to Pa-is, and
r there without difficulty obtained her
recognition as a national vessel and
reieafe.
On her arrival at Falmouth the
Britiffi excise officer seized her and
took out her naval stores, in virtue
of an alledged infraction of the re
venue laws, which prohibit pr ivate
ships from entering with more than
a prescribed quantity of them. Re
presentation was forthwith made to
i the government at London, and
mr. Canning’s order obtained for
her reieafe, the restoration of the
(lores, and her treatment as a na
tional vessel.
Thus it appears that the treat
ment in both countries was nor fub
ftantiallv different; and that such
difference as does exist (hews the
conduct of the Eng’iffi iubaltern of
ficers to have been more aggrava
j ted than that of the French. It is,
however, fufficient for our fatisfac
| tion, that both governments on
complaint promptly interposed to
set affairs right. Ibid.
