Mr. Editor: —“An Aldermmii in 1853,” wri
ting ia the last “Telegraph” says, the Resolu
tion of the City Council, instructing the Mayor
to vote a certain ticket in the recent election of
officers of the Gas Company, “had only three
votes in its favor, in a full board of eight mem
jjer* —all present.” As the Mayor, himself,
pronounced the resolution “carried,” the onty
possible inference is, that some of the members
present chose not to vote, but acquiesced in the
result. A result, by tire way, that would ne
ce&wdy have been the same, whether “One of
the Protestants,” specially alluded to, voted or
not, had the other three voted. And that he
voted according to his best convictions of duty,
needs not to be assented or proven in this com
munity.
The Resolutions of a former Council, cited as
an -answer'’ to the first ground taken in the
protest, respecting the power of the Mayor
over the city stock, 90 far from being an “qp

By the Resolutions of 1853, referred to, the
CouucU, Ist, Authorize the Mayor “to subscribe
for stock,” Ac
2d, Authorize the Mayor “to contract for
lighting the street lamps,” Ac.
3d, Authorize the Mayor “to represent and
vote the city stock. “ Ac.
Thus clearly showing that the Mayor could
do either, “except in so far as he was auOtor
ized so to do by the Council ,” This is just what
the protest asserts.
Bv virtue of the authority of Council thus
given, the Mayor could “vote the city stock,” Ac;
but surely, “An Alderman in 1853,” does not
,„in to convey the idea that the Council of
1853, cannot repeal alter or modify the authority
thus given 1
It seems the present Council did not propose
to repeal the Resolution of 1853, giving this
authority to the Mayor. They proposed to con
tinue the power in him, but in a modified form.
They proposed that he should “vote the stock,”
Ac.,” but they, by “resolution,” instructed him
how to vote it.
The Mayor, as shown by the Resolutions,” of
1953, was but the Agent of the City Council to
vote the city stock: and certainly a person or
corporation who appoints an Agent, has a right
to direct and control him. This is what the
Council of 1853 did. They re-appointed the
Mayor as their Agent to vote the city stock, and
directed him how to vote it And had they
expected any failure to observe the instructions
thus given, (the right to give which was not
then questioned) doubtless they, by “resolution,”
would have withdrawn the power altogether,
and conferred it elsewhere.
The City Council can repeal or modify resolu
tions and even <jrdinances, at any time they please,
whether passed by the same or any previous
Council. This being so, the “resolutions’’ of
1853, cited by “An Alderman in 1833,” as an
“answer” to the first ground in the protest, in
stead of being an ‘ answer” to it, are conclusive
of the correctness of it!
This is written without the request of any of
the protestants, and upon the responsibility,
alone of an OhP MEMBER OF COUNCIL.

The Principal is Prof. F. W. Jenkins a gentleman of enlarged
ex;erience in business matters, and every way qualified to
c- >:.duct such a large establishment as the one over which he
pre-. ies. Although Mr. Jenkins is not the founder of the
College, it is mainly owing to him that Its permanency has
been established. It has, through his enterprising industry.
I-, u me one of the most popular institutions in the West, and
he is now realizing a rich reward for his labors by large acces
si- ns being made to his classes almost daily.
The above will suffice to show persons contemplating the
study of a business course that this College presents rare ad
rai.tages over many similar institutions.
)n short, the Iron |li|y Commercial College is one of the
must perfect institutions of learning for the business man in
the country, anti no better could be found where a good prac’
ti.ai education may be required. We commend the institution
t all contemplating the study of a business course.

PLAN OF THE LOTTERY.
The Numbers from 1 to 60,000, corresponding with
thos Numbers on the Tickets printed on separate slips
of paper, are encircled with small tin tubes and placed
in one Wheel.
The first 45f Prises, similarly printed and encircled,
are placed tn another Wheel.
The Wheels are then revolved, and a No. Is drawn
i*3B) tiie Wheel of Numbers, and at ths same time a
Prime is drawn from the other Wheel. The number and
prime drawn out are opened and exhibited to the audi
ence, and registered by the Commissioners; the Prize
being pissed against the number drawn. This opera
tion Is repeated until ail the prle-i are drawn out.
Approximation Prises.—T he two preceding and the
two succeeding Numbers to those tire first 7
prises will be entitled to the {8 Approximation Prizes.—
For example : If Ticket No 11250 draws the $70,000
prize,those Tickets numbered 11348,11249,11251,11252,
will each be entitled to S4OO. If Ticket No 550 draws
the $30,000 Prize, those Tickets numbered 548, 549, 551,
662, will each be entitled to 300 dollars, and so cn ac
cording to the above schejni.
Tue S.uOO Prises of S2O wlu be determined by the lari
figure of the Number that draws the s7o,ooi‘ Prise. For
example, if the Number drawing the STO,OOO Prize ends
with Number 1, then all the Tickets where the Number
ends ini will be entitled to S2O. If the Number ends
with Number 2, then all the Tickets where the Number
ends in 2 will be entitled to S2O, and so on to 0.
