We have received, nud copy in this pa
per, the Message of Gov. Terry recom
mending to tho South Carolina Legisla
ture the adoption of the “constitutional
amendment” abolishing slavery. The
message discloses the influences and con*
^derations that prompted tho recommen
dation and induced tho action of the Le
gislature. Tho presumption is that tho
Legislature, in adopting the amendment,
adopted also the suggestion of tho Gover
nor that tho construction given to tho last
clause by Secretary Soward should ho
placed on record.
The last clauso is in those words: “Con-
gross shall have power to cnforco this ar
ticle by appropriate legislation.” Mr,
Howard says that this rlaueo “ii restrain
ing in its effect#, instead of enlarging the
power of Congress.” Wo cannot exactly
“see it” in that light, in view of tho cus
tomary Northern way of Interpreting the
Comtituffibn. But wo think we sou what
Mr. Seward, speaking as a lawyer ad
dressing himself to tho object sought to bo
attained, moans. JIo means that inasmuch
as this clause only gives Congrosa powor
to onforco by appropriate legislation a
provision guaranteeing simple freedom
to tho negro, thorofore it restricts Con
gress from going beyond th^oxpress grant
to onforco any other right of tho frood
man. Whether this will ho tho construe
tlon of Charles Sumner and Tbaddous
Stcvons. and of tho Republican majority
in Congross, remains to bo seen. If they
adopt it, they will spin a thread of nrgu
ment much liner than over wo know one
of that class of politicians to spin before
in limiting tho scepu of a constitutional
grant of power.
But, ns we bavo said before, the adop
tion of tho constitutional amendment is
now as good as secured. Tho best thing
LhAt tho remaining Southern States can do
is, perhaps, to accept it with the clearly
rocogni/.ed construction of Mr. Seward—
with tho distinct declaration that its scope
is undorstood to bo limited to tho extent
Indicated by him and said to ho concurred
in by tho President and tho Attorney
General. By doing so, wo commit to our
support, in this matter, tho highest offi
cials and men of the most extensive influ
ence. ICvon if tho Sonators and Kopro-
Bontatives of tho Southern States should
this winter bo excluded from Congress,
officials occupying such positions and ex
erting such influence ought to bn able to
Arrest ail legislation beyond this scopo
until tho South can obtain representation.
It soems to us useless longer to hold out
Against tho constitutional amendment (for
it is socurod already), and that our host
policy is to securo, if wo can, such a lim
itation of its construction as will provont
legislation by Congross that would bo
utterly repugnant to and subvorsivo of tho
rights of the States .to manage their own
domestic affairs.

Winder, Duncan and Geo, confederates
of Wirz at Andur-onvillo, and now con-
lined in the Old Capitol prison. Winder,

ovor them as partners and active partici
pants in the crimes and peculations of
knowledging or paying tho same d
any part thereof, or from passing any law
for that purposo, or to securo or provide
for tho said debts, or any part thoroof, by
any appropriation of money, property,

object.

as the annual income of tho State, before
and during said war, from taxation and
othor sources of rovenuc, woro amply suf
ficient for tho support of tho ordinary
civil government of tho State, and for tho
payment of all its expenses, incidont to a
state of peace; and ns the extraordinary
expenses which led to a creation of a debt
were the offspring and results of the war,
it is therefore the judgment, Ordinance
and decree of this Convention, that all
debts of tho State incurred during said
war, shall he considered, hold and treated
as debts incurred for carrying on tho war;

Our attention has been called to tho fact
that the specific and ad vniorem taxes on
Articles named in Table 1, published in
this paper, wore imposed by an act of
Congress approved June IK), 1804, and that
by a subsequent act, approved March 3,
1805, an additional tax of ono-flfth or
twenty per cent, upon tho rates of tho
firaUnnmod act was imposed upon articles
named in section l*I of that act, excepting
a few articles ppecillod. This per centage
is computed upon tho tax first imposed,
not upon the value of tho articles. The

in section 94, upon which the duty is in

Boston, Nov. 13.—A Paris correspond
out of the Morning Post says that the in
tended withdrawal of Franco from Mex-
ico had assumed a more decided charac
ter. Maximilian would receive no moro
aid from Austria, and Belgium proposed
to permit French officers and men to tako
tho oath of allcgianco to Maximilian; if
inclined to do so, Maximilian should find
himself surrendered by his own army.

cans, four military drill books, four com

pounds in gold, supposed to bo for the
purposo of U omnnism. Ho statod that lie
had returned to Ireland to see an uncle,
and intendod to shortly return to Anieri
co. lio was remanded for further in
quiry.

prisn in Illinois, groat crimes wore fre
quently perpetrated by obstructing tho
track nnd throwing off tho trains. Many
woro killed by thoso atrocious acts, al
though plundor was, no doubt, the object
of thorn. Tho Michigan Southern suffer
ed most in this way; lives were lost and
tho mails invariably robbed. On ono of
thoso occasions, after a tedious invostign-
tion of months. Air. 1‘inkorxton arrested
one Augustus Stewart Byron, who with
a nephow of Admiral Napior, who was
then serving in tho Crimoan war, was
charged witli obstruction, robbery and j
murder by tho obstruction. Tho forinor
claimod to bo a natural son of Lord Byron,
by an Edinburgh girl named Mary Stow*
art Ho had two or three manuscript lol>
tors written by Lord Byron in his posses
sion, and there were othor authentic docus
monts to provo tho truth of his story. Tho
latter, Napier, also turned out to be tho
porson he ropresonted himself to bo. al
though ho managed finally to elude jus
tice bv running away. He eacaped from
New York in a sailing vessel bound for
England, although Mr. Plnkorton was in
Now York and on his track at the timo.
Tho son of tho poet was convicted of mur
der, by throwing a train front tlio track,
thereby killing tho onginoer, the object
being tho robbery of tho mails. 11a was
sonlcnced to imprisonment for lifo in tho
Stale penitentiary a*. Jackson, capital pun
ishment having boon abolished in Atichi-
gan. Ho died m prison, aged about thirty-

Kailboad Iron. —We arc gratified to
loarn that letters havo beon received from
Hon. O. M. Avery, President of the Ala*
buma and Florida Railroad, stating that

New York, and had contracted with the

eight miles of the track that has never
been destroyed. The cargo of iron that
is on the way will relay probably twelve
