Justice 9 * Court in Oirartl.
Dauiol Collins yesterday brought
suit before Justice W. B. Harris, for $84,
against T. J. Jackson and Ed. Roborts,
former trustees of tho Girard public
schools, for oortnin improvements made
by said Collins on tho Girard Academy
by agreement with tho aforesaid trustees.
Tho defendants plead through tlioir attor
ney, A. A. Dozier, Esq., that they wore
t liable for tho money nor any portion
of it, inasmuch as tho improvouiontn
mado <m tho faith of a public subscription
id by tho citizens for tho purpose,
and that they as trustees only consented
to tho improvements to the extent of the
subscription, and no further. Justice
Harris decided that though ho did not
consider tho individual property of de
fendants liable for tho obligation, yet lia
bility must rost somewhere, and that the
work done gave tho architect the right to
a lien thereon. So fts tlie case now' stands
tho school-house is liable to levy and sule,
unloss tho citizens make up the deficit, or
rentals to satisfy the cluim of Mr.
Collins. _
