Tub most troublesome question before
the Legislature of Massachusetts is the
liqnor question. It has boon a disturbing
elemont in all recent elections in that
tho Republicans think that
midaugusllioir party ascendancy. They
havo now undor consideration a bill re
ported by a committee which proposes
virtually to turn tho whole matter over to
tho authorities and poople of the towns,
with a reservation of the right of tho State
to approve or disapprove local action.
This reservation is proposed to satisfy the
extreme prohibitionists, who will not con-
aeut to give up State control of tho ques
tion.

The reader no doubt noticed the great
difference between the Doiuocratio major
ities in tho vote for Governor and for
Congressmen in Connecticut. It is oosily
explained. Geu. Hawley, who opposed
the Force bill, Gen. Grant's Arkansas
policy, and a third term for Graut, re
ceived a considerable Liberal Republican
vote, which was not given to Groonc, the
Radical candidate for Governor. Gen.
llawley's vote in tho District was some
1,500 greater than Greene’s. In the 4th
District, too Mr. lhirnum, tho Democratic
candidate for Congress, ran behind his
ticket, because ho hud voted for tho “sal-
ary grab” and tuken his share of it. In tho
other Districts there was not much differ
ence between the Gubernatorial and Con
gressional votes.
The Legislature of lihodo IsLud, just
chosen, will havo to elect a United States
Senator to succeed Mr. Anthony. There
is not much chauco of a Democrat io ma
jority iu tho Legislature (a number of
members have yet to be chosen by (owuh
that made uo choice on Wednesday), but
it is possible that the Democrats may be
able to secuie tho election of a man very
little objectionable -perhaps Ex-Senator
Sprague. They may do this by a coali
tion with oue of thu Republican factions,
as they w ill pretty surely hold the balance
of power in the Legislature and bo able
to elect a* Governor either Lippitts, regu-
Ur and liconse Uepublicsn, or Hazard,
bolter and prohibitionist. The defeat of
Anthony, who is understood to be iu favoi
of a third term for Grant, may be con
sidered almost oerlain.

The Atlanta papers of Friday publiah
the decisions of the ttnpretaa Oonrt in a
number of eases from the Ghattahooohee
Circuit. Wo can only give tho decree in

In the Howard Manofaetnring Com
pany et al. vs. Water Lot Company, an
Equity oa3e from Muteogee, the judg
ment of the Court below was reversed for
error in overruling tho demurrers of the
defendant.
In the case of H. K. Lamb vn. Jacob
B. Murrny, from Mnscogee, tho Judg
ment of tho Court below was affirmed,
sustaining its ref anal to order a new trial
on the ground that tho verdict was con
trary to evidence, and for nowly discov
ered evidence.
Io Martin Hollis et al., executors, vs.
Calvin Calhonn, from Talbot, the judg
ment was reversad. The oourt below had
allowed the defendant to testify in his
own behalf after the death of ths plain
tiff's testator, who was a party to the suit;
and this tho Hnpremo Court holds to be
contrary to the act allowing “both par
ties" to become competent witnesses.
Calvin E. Johnston vs. Peter Freer et
al., from Mnsc >gae. This waa a suit
brought on an error in the set Burnout of
partnership in 1800, which mistake was
not discovered until 1872. The court be
low ruled that under the facts disclosed
and the pleas made, the oloims of both
partiee were barred by the statute of limi
tations, and the plaintiff could not re
cover; and this Judgment the Euprcmo
Oourt affirmed.
In The Columbus Factory vs. John 0.
Herndon, Sheriff, from Htowart, the judg
ment of the Court below was reversed.
The Supreme Court nay : “The Columbus
Factory having placed its execution in
the hands of the Sheriff, claiming tho
money as belonging to Hill before the
transfer of judgment and execution to
DeLaunay, it has the superior equity, and
was entitled to have had tho money bo-
longing to Hill appropriated to itsfl. fa.
instead of tho assignee of Hid, who ob
tained his title to the judgment pending
tho litigation between tho Columbus Fac
tory and Hill for tho money in the Sher
iff’s hands. When ono purchsMes proper
ty pending litigation for that property,
ho acquiros no bettor title to it than tho
one from whom ho purchased it hud, as
against the litigation claimant thereto.”

Court affirmed the refusal of tho court

ed. “In a suit hy a widow for tho honii

civil suit, and a plea of such acquittal is

Louis Putney vs. Swift, Murphy ACo.,

Co., from Talbot: “A married woman

Wilcox, Gibbs A Co. vh. II. T. Cun
ningham, from Tulhot. Judgment re
versed. “Iu a suit for tho price of guano,
which was sold as n manure, a plea that
tho manure wus properly applied to tho
crop, that the crop was well attended to,
and that ho applied and no used\ the guano
i in the production of his said crop of
benefit what over, and was wholly use-
loss and valueless to this defendant, is uot
I plea in bar of the recovery. Tho
pica should have said distinctly that the
guano wns not reasonably suited for a
manure, or was worthless, or to tbo state
ment that it was properly nsed, it should
havo further set forth, that tho seasons
wore seasonable.”

from Stowart. Tho Supremo Court de
cided that the defendant could not plead
the “scaling ordinance” of 18(55, without
showing that it was tho iuteut of tlia par
ties that the note sued ou should be pay
able in Confederate money. Judgment
reversed.
Collin Collins vs. The Commissioners
of Harris county : “Un.ler sections 6(53,-
(570,(571 aud (531 of tho Code, when a suit
is brought against a county for damages,
caused by a mint of proper repairs to a
public bridge, it should appear tliut tho
bridge was erected hy letting it out to tho
lowest bidder, and that no bond wus taken
from tho contractor faithfully to perfor
his contract, and to indemnify for all
damages occasioned by a failure so to do,
and to keep the bridge in good repair for
n years, and for such further time
as may be embraced in the contract—aud
both of these facts should bo alleged in
the consideration." Judgment affirmed.

from Talbot: “A warehouseman and fac

claiming reimbursement out of the pro
ceeds of the sale thereof, from a mere
ommishiou to inform a purchaser of the
cotton that such udvauco* had hot»u made,
when the purchaser depodts the receipts
of the cotton with him, and directs that it
be sold ou his (the purchaser'll) account."

was addresied to Gon. Leo under date of

meeting of the Louisiana Jockey Clnb
was successfully inaugurated to-day.
Fine weather, large attendance, good
track, and spirited racing.
First race: Hurdle race of two miles,
over eight hurdles, for a clnb purse of
$500—first horso, $350; second, $100;
third, $50. Seven started. All came to
the string at the finish except lloloxi, who
let down completely at the seventh
hurdle. ,At the start Capt. Hutc hinson
took the lead, closely followed hy Lirne-
stoue and Boloxi, with the others well
bunched five lengths behind. At the end
of the first mile the horses were well to
gether, but gradually stringing out, until
tho finish, when Hutchinson and Lime

COAL MINERS—CARDINAL M INNING.
London, April 10.—The coal masters
of South Wales havo agreed to stop tho
lockout for a week, and throw open the
pits nt a reduction of ten per cent. If
work is not resumed a further reduction
will be demanded. They give a week to
consider the queation. If tho terms are
rejected, 15,000 mon will ho unemployed.
