available troopa at Fort Dodge and Fort

ing up from the south to engage them,
and the military authorities are confident
they can’t eaoapo collision with one or the
other of the forces marching against them.

Bkblik, N. J., April 21.—Prof. Don-
sldaon is at Cakes' Hotel in this place,
safe and Hound. After leaving Philadel
phia, the balloon sailed in nearly a south
ern direotion, and landed at Conrads’
terra cotta works on the Willismatown
railroad, naar Atoo, N. J. The balloon
became unmanageable and no assistance
being at hand, Prof. Donaldson was
obliged to cat the basket loose in order to
save it, and the main part of the balloon
re-aaoendad and was lost. The upper
currents of air wera very oold, so oold, in
feot, that mineral water taken along by
the teronant was ftoxen.

Washinoton, April 23.—The question
of the constitutionality of the Enforoe-
meut Act, to be determined by the de
cision pending, has been folly argued on
its merits font times. In the first in
stance, it was argued at Uw Booth Caro
lina Cir-uit, on a motion to quash the
indictment under it, by Beverdy Johnson
and Henry Stanberry. Thar* wee then a
division of opinion between the Judges-
bat, the hearing being on a motion to
qnash, it waa bald that tbs
division oonid not be eertifled on each a
motion. It was again argued on a mo
tion in arrest of judgment, and the ques
tion was certified here where the osse wet
dismissed, the aconsed having been par
doned by the President. The question
was again argued at this term in a oaee
from Kentucky by Mr. Stanberry and Mr.
Buoknor; and still again in the present
csss by Mr. Johnson, Mr. Field, Mr.
Phelps and Mr. Marr.

Baltoiobe, April 23. — Col. E. M.
Yergar, formerly of Vicksburg, Miss., bnt
for several years past a resident of this
city, died very suddenly last night. At
one time his name was ^prominent before
the publio in connection with the killing
of Col. Crane, .at Jaokson, Mist., for
which he was tried by a Military Commis
sion. The deoeased was in apparent good
health up to 1 o’clock yesterday afternoon.
For several years, since residing in Balti
more, he wss proprietor end editor of the
Evening Journal.
