Habeas Corpus, for
the, possession of a
minor child.
County Court of Liberty County, Ga. This was an
application by Rosa Seymour, colored, through a writ
Of habeas corpus, for the possession of her minor
child, Judy, which had been apprenticed by the Ordi
nary to the defendant in this case. The question of
the pertinence of this writ to the present case being
raised, the decision of Judge Charlton was affirmed:
“That under this writ not only cases of illegal restraint
can come up, but the writ of habeas corpus at Common
Law will apply, although there be strictly speaking
no illegal restraint and confinement of the inflmt, and
tiie Court will determine under this application, and
under circumstances similar to the present, the right
of custody. To confine the writ of habeas corpus at
Common Law exclusively to cases of illegal confine
ment would be destructive of the ends of justice.

The forms of petition and citation are then included
under the more comprehensive writ of habeas corpus,
and whenever cruelty or immorality is alleged, the
morals of the guardian or master will be inquired into,
as well as the legality of the binding.
The papers of apprenticeship being in the posses
sion of the adverse party, throughtheagency of the
Freedmen’s Bureau, it was held by the Court that a
party has a right to any papers which may be neces
sary to make out his case; but the private correspon
dence or decisions of the Bureau are not included;
th<B court being bound to decide this question ac-
• cording to the laws of Georgia and the common law of
the land.
Upon motion by the defendant to continue the case,
the Court held that the delays which are allowed to
Courts of Justice are not applicable to trials under the
writ of habeas corpus. Where one is deprived of his
liberty, the relief must be speedy and summary. Wit
nesses may !>e compelled to attend peremptorily. Es
pecially does this appear just, when the defendant has
shown no diligence in procuring testimony; he must
suffer toe consequences of his own “ laches." The
motion lor continuance was therefore overruled.
The Court also held that all children are wards in
chancery;*but especially do courts of chanceiy stand
“in loco parentis” to children. Said courts may dele
gate said power to guardians and indentured masters ,
but the Courts can recall such powers granted, for
cause, as cruelty, immorality, Ac. _
Parents are entitled generally to the custody of their
children, except upon good cause shown, as depravity,
cruelty, abandonment, Ac.
In case children are orphans, or abandoned by their
parents without sufficient property to support them,
it becomes the duty of the Ordinary or County Judge;
to bind them out to indentured masters. It is a suffi
cient abandonment when a parent kuowing the cus
tody of the child, makes no application for tbe
child, nor provision for its support for a whole
year, although free to do so. Any one having a
child in custody under these circumstances is iusti-
liable in applying to the Ordinary for an indenture of
apprenticeship; said officer should grant it, and the
interests of society require that all such children
should be bound out to proper masters. It is not the
doty of one seeking the relation ot master to hunt up
the parent of an abandoned child, and obtain his con
sent—contra, the parent must hunt up the child and
provide for it. Neither is it fraud to allege that the
jarent has gone to parts unknown, (which is only
technical language) when the parent is without the
limits of the county, making no application nor pro
vision for the child for a long time. A parent under
these circumstances has well nigh lost his rights, and
the knowledge of the existence of the parent by the
master without consulting him is not fraud; it may
be a violation of courtesy, not right.
In case it is proposed to substantiate fraud by a
part of a correspondence,the whole of that correspon
dence should be furnished to the party attacked,
for tbe purpose of rebutting said charge. The
plaintiff has also moved to annul this apprentice
ship on the ground that under the U. 8. Stamp Act,
said paper being without stamps, were void “ab
initio."
Stamps being affixed to the papers topon both sides
in open Court, and there being no proof that the Rev
enue laws were sought to be evaded, this Court will
not allow such captious, objections to impede the
justice of the cause. The Argus-eyed revenue officer
being left to enforce a questionable enactment, under
which there has been no deciagm in Georgia, of which
this Court is apprised. The plamti^s counsel has
also moved to dissolve this relation of master and ap
prentice on account of the depraved conduct of the
master, and the jeopardy of the morals of the appren
tice. In taking testimony under this allegation, the
Court ruled that a party attacking another for immor
ality, cannot go into an investigation of every act of his
life, but must confine his examination to general char
acter and reputation. Special acts cannot be inquired
into, except as refers to the apprentice. The evi
dence under this allegation has been voluminous,
each party pursuing the other with all the ingenuity
which passion, interest, and' (I might add) malicu
could invent. The defendant has certainly passed
through a painful and tedious ordeal. He has shown
that he has treated his apprentice well, a fact admit
ted by her in open court.* -It has also been shown
that he formerly fed and clothed his servants well.
He has also shown that he is an intelligent, honest
and enterprising citizen. But this Court must be
candid and say that unimpeachable evidence discloses
the fact that he is a violent and profane man of the
world, and on this account objectionable as a custo
dian of a minor child. But the selection of a suitable
custodian is a very delicate matter.
I do not think that I should dissolve this relation
ship without inquiring what would become of the
minor in dispute in that case. The first applicant is
the mother, but she comes before me under circum
stances calculated to inspire distrust from that
former abandonment, unexplained and inexplicable.
But some allowances mu9t be made for those who
have but recently emerged from a state of slavery into
freedom, whether they profit by it or not. The affec
tion of a mother is also enduring and soul-engrossing,
mid this woman may have been heretofore under a
pressure of circumstances. She has certainly ex
hibited extraordinary vigilance and activity in the
prosecution of this case. Under these circumstances
I am at a loss what to do. No acceptable third party
has presented himself, and I must remit this child to
the custody of one or the other. Where reason fails
the instincts of our nature oftentimes carry us safely
through the dangers that environ us. It has long
since been adjudged by a distinguished chancellor,
that a minor child, if of years of discretion, may make
an election. See Charlton’s Rep. p. 119. It may be
proper, therefore, to submit this matter to the arbitra
ment of one most interested and most cognizant of
the faots. The minor in this case being proven to be
thirteen years of age, and having exhibited sufficient
capacity to discern and elect, this^ourt will allow her
this privilege. It is therefore ordered, adjudged and
decreed, that Judy, or Julia Seymour, have the privi
lege of electing her custodian, and she having elected in
open conrt to go with her mother, it is farther ordered
that the relation of master and apprentice between
W. B. Gaulden and Judy Seymour be and is hereby
dissolved—that “Exoneration" be entered upon this
bond, and the defendant do pay the costs of this
