to; the Court, that William Edmonson, on the
29th offJanuary, 1824, made his certain Mortgage of
that datOjto your applicant, whereby to secure to
him the sum of One Hundred Dollars, on or before
the 22th of July, 1824, he, the said William, Mortgag
ed to your applicant the following described Tract of
Land, to wit: lying and being in tne County of Jack-
son and State of Georgia, containing one hundred
one and one half acres, being half of a grant made to
Elisha Lake of two hundred and throe acres, the
half butting and bounding as follows: beginning
a white oak corner, on the branch on Jonatj
South’s line, running north east to a pine corner on
said Smith’s line, thence South to a white oak Cor
ner on the branch on John Smith’s line, thence South

TTPON the petition of Henry Hardin, stating that
wJ he is in pddteasion of a bond, given by Asa
Ayres to him, said Hardin, on the thurtywfirst day of
October, eighteen hundred and twenty-two, for one
thousand dollars, conditioned to be void if tho said
Asa should make good and sufficient titles to Lot of
Land number one hundred and fbrty^dght, in the
ninth district of Monroe county, on or before the
first day of April then next; and it bcingstqted and
made appear to the cohrt that said Hardin has paid
the consideration money, and that $&id Asa depart
ed this life before making titles, and a copy of the
Bond being filed in the Clerk’s office of this court,—
It is on motion, Ordered, That the said Thomas
Payne, Joseph Dnnlap, and James II. Little, execu
tors of said An Ayres, do shew cause, on the first
Monday in September next, why they should not be
directed to make titles to said land, described in said
bond, to said Henry Hardin, in terms of the statute
in such case made and provided. And ft is farther
ordered, that a copy of this rule be published in one
of the public Gazettes of this state, once a month
for three months before the sitting of said court, in
September next.
