T HE petition of Kirkhora McEwen sheweth,
that John Butler, deceased, heretofore, in his
life time, to wit, on the 7th day of February, 1825,
did make and execute his certain Bond in writing in
the penalty of Two Hundred Dollars, conditioned to
make titles tc Kirkharn McEwen to a certain tract
or parcel of laod, a part of lot No. 264, in the 5th
district of Gwinnett county, containing Fifty Acres,
(which Bond is annexed tosaid petition and filed in
the Clerk’s of ice) and hag;prayed this Court to di
rect the Executor and Executrix of said deceased to
rqokc a good and sufficient warrantee title to 6aid
tract or parcel of land, according to the tenor of said
bond :—Therefore, orderd, That this rule be pub
lished in one of the public gazettes of this state, and
in the public places of tVi's county for three months,
and unless cause be shewn to the contrary at the

Land, to wit: lying and being in the County of Jack-
son and State of Georgia, containing one hundred
one and one half acres, being half of a grant made to
Elisha Lake of two hundred and three acres, the
half butting and bounding as follows: beginning on
a white oak corner, on the branch on Jonathan
Smith’s line, running north east to a pine comer qn
said Smith’s line, thence South to a white oak cor
ner on the branch on John Smith’s line, thence South
west to a post oak comer on send Smith’s line, thence
on Burgin’s fine, to the beginning comer. And that
there is due on said Mortgage the sum of One Hun
dred Dollars with interest from the 29th of July,
1824; and praying the foreclosure of the Equity of
Redemption of' in and to said Mortgaged premises.—
On motion, Ordered, Tnat the said Mortgager pay
into Court the principal and interest due on said
Mortgage, together with the cost, within twelve
months from this date, else the Equity of'Redemp
tion of, ih and to said Mortgaged premises will be
thenceforth forever barred and forclosed.—And it is
further ordered, That a copy of this Rule be publish
ed in some public gazette of this State or served
upon the Mortgager according to the statute in such
cases made and provided.

Gwinnett Superior Court, September Term, 1827.
Seaborn Jones and Robert M’Combs, vs. Patrick
L. Dunlap.
U PON the petition of Seaborn Jones and Robert
M’Combs, praying the foreclosure of the Equ
of Redemption in and to certain Tracts or parcels of
Land situate in the county of Gwinnett and State of
Georgia, viz. all that Tractor parcel of.Land situate
and being in the state and county aforesaid, contain
ing Two Hundred and Forty or Three Hundred and
Forty Acres, more or less, being part of a Tract
granted tq'Caleb Russell, adjoining lanes of Shadrick
Bogan, John Winn, and Isham Williams, and Haw-
kin’s Old Line, and near the waters of, the Suwarra
and Appal&che Rivers: also, that Tract or parcel of
Land containing Fifty Acres, more or less, being part
of Lot No. 208, and bought by the said Dunlap, of
Mrs. Mary Wilder, lying on the head waters of the
Alcovy, in the county aforesaid—which said Tracts
of Land were mortgaged by the said Patrick L. Dun
lap, of the county of Baldwin, in said state, to the
said Jones & M’Combs, on the 15th day of May, in
the year 1826, to secure the said Jones' & M’Combs
for any responsibility or loss which they might incur
and sustain by reason of being security for the said
Patrick L. Dunlap, as contractor for supplying the
Penitentiary of the State of Georgia with Rations,
and also to secure the payment of sevdfal notes hel< 1
by the said Seaborn Jones for rent and for other pur
poses, in the said mortgage specified:—Andthesaic
Patrick L. Dunlap having made default—-On motion
of Hines Holt, attorney for petitioner, it is ordered,
That unless the said Patrick L. Dunlap, or his repre
sentatives, do pay into the Clerk's office of the Su
perior Court of said county, the amount necessary for
the purposes in the said mortgage specified, together
with all costs, within twelvemonths, that his Equity
of Redemption in and to the said mortgaged pre
mises bo from thenceforth forever barred and fore
closed.—And it is further ordered, That a copy of
this Rule be published in one of the public gazettes
of this statp once a month for twelve months, or
served oh the said Patrick L. Dunlap, his agent, or
representatives, at least six months before the time
the- said stun of money is ordered to be paid into
Court.
I certify the foregoing to be a true extract from
the minutes, this 25th September, 1827.

in the Inferior Court of Clark county, silling for Ordi
nary purposeSeptember Term, 1827.
r PON tie petition of Jonathan Ward, stating
that Robert Flournoy, late of Chatham county,
deceased, in his life time, executed his Bond to make
titles to said Jonathan to Two Hundred and Eighty-
Seven and cine half Acres of Land, more or less, ly
ing and being in Greene county, granted to Young,
adjoining Lands of said Jonathan, and Lands grant
ed to Lewis Bobough, including a place called
Burne’s Old Field, (a copy of which Bond is to said
Petition annexed,) and stating further, that said
Rebett departed this life without executing said titles,
having first executed his Will and leaving John A.
Cobb and Robert W. Flournoy, now resident in Clark
county, his Executors, and that he has fully paid off
and discharged the whole consideration money
agreed to be paid for said Land, and praying the
order of this Court, that said Executors may be di
rected, with the concurrence of the Inferior Court of
Chatham county, (where said Robert resided az the
time of his death) when sitting for Ordinary purposes,
to execute titles to said Jonathan to said Land, ac
cording to the tenor and effect of said Bond and the
statute in such cases made and provided, and this
Court being now made satisfied of the truth of the
premises—Whereupon it is ordered, That upon three
months notice being given in one of the public ga-
zettecs of this state, and in the public places of the
county (by publishings copy of this order) of such
application, the said Executors will be directed, at
tne Term .of this Court, next after the expiration of
said three months, to make titles to said Jonathari
to said Land, agreeable to said Bond or obligation,
unless sufficient cause shall then and there be shewn

a foreclosure of the Equity of Redemption in
and to a certain Lot of ground near the Town of
Athens, containing One Acre, more or less, adjoining
the Lands of Mrs. Baldwin and Ool. Josiah New
ton, stating that William B. Taylor, on the 2d day
of January, 1827, executed ana delivered to him t
Deed of Mortgage for the better securing the pay
ment of a certain Promissory Note given by the said
William B. tu the sail Garland W. for the sum of
Three Hundred and Sixteen Dollars and Sixty-Five
Cents, dated the Slst day of December, 1826, and
made payable on or before the 25ti» of the same
month, and praying a Rule Nisi for the foreclosure
of the Equity of Redemption in and to the said pre
mises. jv
On motion, it is ordered, That the said William B,
do, within six months from this date, pay into tl
office of tbe Clcrk of this Court the principal and i
terest due on said Mortgage, together with the costs
of this application, or that the Equity of Redemption
in and to said mortgaged premises be thenceforth
barred and forever foreclosed.—It is further ordered,
That this Rule be published in one of this public ga

or attorney, at least three months previous to the
Term at which the money hi directed to be paid,
