T HE petition of Kirkham McEwen she wet h,
that John Butler, deceased, heretofore, in his
life time, to wit, on the 7th day of Fe bruary, 1825,
did make and execute his certain Bond in writing in
the penalty of Two Hundred Dollars, conditioned to
make titles to Kirkham McEwen to a certain tract
or parcel of land, a part of lot No. 264, in the 5th
district of Gwinnett county, containing Fifty Acres,
(which Bond is annexed to said petition and filed in
the Clerk’s office) and has prayed this Court to di
rect the Executor and Executrix of said deceased to
make a good and sufficient warrantee title to said
tract or parcel of land, according to the tenor of said

RULE NISI.
O N the application of L. F. E. Dugas, shewing
to the Court, that William Edmonson, on the
29th of January, 1824, made his certain Mortgage of
that date^to your applicant, whereby to secure to
him the sum of One Hundred Dollars, on or before
the 29th of July, 1824, he, the said William, Mortgag
ed to your applicant the following described Tract of
Land,‘to wit: lying and being in the County of Jack-
son and State of Georgia, containing one hundred
one and one half acres, being half of a grant made to
Elisha Lake of two hundred and three acres, the
half butting and bounding as follows* beginning on
a white oak corner, on the branch on Jonathan
Smith’s line, running north east to a pine comer on
said Smith’s line, thence South to a white oak cor
ner on the branch on John Smith’s line, thence South
west to a post oak comer on said Smith’s line, thence
on Burgin’s line, to the beginning comer. And that
there is due on said Mortgage the sum of One Hun
dred Dollars with interest from the 29th of July,
1824 ; and praying the foreclosure of the Equity of
Redemption of, in and to said Mortgaged premises..—
On motion, Ordered, Tnat the said Mortgager pay
into Court the principal and interest due on said
Mortgage, together with the cost, within twelve
months from this date, else the Equity of Redemp
tion of, in and to said Mortgaged premises will be
thenceforth forever barred and forelosed.—And it is
further ordered, That a copy of this Rule be publish
ed in some public gazette of this State or served
upon the Mortgager according to the statute in such
eases made and provided.

JTTPON the petition of Seaborn Jones and Robert
U M’Combs, praying the foreclosure of the Equity
of Redemption in and to certain Tracts or parcels of
Land situate iri the county of Gwinnett and State of
Georgia, viz. all that Tract or parcel of Land situate
and being in the state, and county aforesaid, contain
ing Two Hundred and Forty or Three Hundred and
Forty Acres, more or less, being part of a Tract
granted to Caleb Russell, adjoining lands of Shadrick
Bogan, John Winn, and Isham Williams, and Haw-
kin’s Old Line, and near the waters of the Suwarra
and Appalachc Rivers: also, that Tract or parcel of
Land containing Fifty Acres, more or less, being part
of Lot No. 208, and bought by the said Dunlap, of
Mrs. Mary Wilder, lying on the head waters of the
Alcovy, in the county aforesaid—which said Tracts
of Land were mortgaged by the said Patrick L. Dun
lap, of the county of Baldwin, in said state, to the
said Jones &. M’Combs, on the 15th day of May, in
the year 1826, to secure the said Jones & M’Combs
for any responsibility pr loss which they might incur
and sustain by reasoif of being security for the said
Patrick L. Dunlap, as contractor for supplying the
ft Penitentiary of the State of Georgia with Rations,
and also to secure the payment of several notes held
■ Jjp the said Seaborn Jonjs for rent, and for other pur
poses, in the said mortgage specifiedAnd the said
Patrick L. Dunlap having made default—On motion
of Hines Holt, attorney for petitioner, it is ordered,
That unless the said Patrick L. Dunlap, or his repre
sentatives, do pay into the Clerk’s office of the Su-
, perior Court of said county, the amount necessary for
the purposes in the said mortgage specified, together
with all costs, within twelve months, that bis Equity
of Redemption in and to the said mortgaged pre
mises be from thenceforth forever baited and fore
closed.—And it is further ordered, That a Copy of
this Rule be published in one of the public gazettes
of ;ihis state once a month for twelve months, or
served on the said Patrick L. Dunlap, his agent, or
.representatives, at least six months before the time
' the said sum of money is ordered to be paid into
