O N the application of William N. Bishop stating to
the Court, that in the life time of Richard Vena
ble, lie purchased from him all that part of Lot No. 10,
iu the town of Guiucsvillc, including all that part of
said Lot lying from one foot East of ihe chimney of a
house belonging then toTrumanKelloggon thesamelot,
and to run parallel with thelines of a lot then occupied by
Francis C. Andoc, that isto say, the most northern and
southern lines of said Lot, the Eastern and Western
aidt"wnof Gainesville, and to include all the said
Lot not heretofore sold bv Stephen Ried, to Truman
Kellogg, for which he holds the bond of said Richard
Venable, in the penalty of eight hundred dollars, dated
tho 15th January 1828, a copy of which bond is filed in
the CIerk ? s office of this Court, to cause him to execute
n fee simple title a* aforesaid, and farther, slating that
Kobt.Mitchell and Robert Venable are tho only qualified
•xccutors on the estate of said Richard Venable,deceas
’d, and the said applicant prays that an order may pass
authorising nnd requiring the said Robert Mitchell and
Robert Venable, executors aforesaid, to execute titles
according to 'he original Contract. It is thefefore or

Abraham B. Carter died without executing titles to said
iand in conformity to his said obligation, which is now

Court that tho consideration money for said land has

RULE NISI.
To the Hon. the Superior Court of said county.
T HE petition of Charles Hulsey respectfully shows,
that heretofore, to wit: on the eighteenth day of
March, eighteen hundred nnd thirty, the said Frede
rick A. Brown and Jabez Lewis, intide, executed and
delivered to your potitioiier,their eertain deed of mort
gage, bearing date the day and year aforesaid, and
which is here i:i Cifurt ready to be shown, which deed
of mortgage conveyed a certain tract or parcel of Iand,
situate, lying and being in said county of Hall, known
as Lot No. ninety-six, in the ninth District of said coun
ty, which tract or Lot of land was mortgaged by the
said Frederick A. & Jabez, for the bet ter securing to your
petitioner the payment of a certain promissory note
made and delivered to your petitioner, by the said Fre
derick A. &. Jabez, on the day and year aforesaid, for the
sum of three hundred dollars, and dun on the twenty
fifth day of December, eighteen hundred uml thirty,
together with a certain other note desciihed in said
mortgage, and which is not yet due, and which said
fir.it mentioned note is herewith shown »o the Court:
and your petitioner further shows that the whole
amount of principal and interest on said note, is now
dueand unpaid. Wherefore he prays, that unless ihe
said Frederick A. and Jabez, pay into the Clerk’s Of
fice of this Court, the amount ofthc* principal, interest
and cost due thereon, within six months from this date,
that the equity of redemption in, nnd to the said mort
gaged premises, thenceforth and foreverbe foreclosed.
Therefore on motion of Council for the plaintiff’, it U or
dered by tho Court, that the said Frederick A. Brown
and Jabez Lewis, pay into the Clerk’s office of this
Court the amount of the principal and *nterest due on
said note, together witn an legal costs, on oi ueiore
the expiration of six months, otherwise the equity of
redemption in and to the said mortgaged premises, be
forever barred and foreclosed; and that a copy of this
rule and petition be published once a month for six
months in one of the public Gazettes of this state, or
that the defendants ho personally served therewith,
three months before the next sitting of this Court.

letters of Guardianship shnll not bo revoked, and alto-
thcr Guardian be appointed. On ihe ground, first, that
saul Ezekiel has left the county, and his said Wards
arc now under the care and direction of no person ;
second, because said Ezekiel has mismanaged Ihe

wholly neglects the care and education of his said
