RULE NISI.
To the Hon. the .Superior Court of said county.
FBTHF. petition of Charles Hulsey respectfully allows,
I that heretofore, to wit: on the eighteenth day of
March, eighteen hundred and thirty, the said Frede
rick A. Brown and Jabez Lewis, made, executed and
delivered to your petitioner,their certain deed of mort
gage, bearing date the day and year aforesaid, and
which is hero in Court ready to be shown, which deed
of mortgage conveyed a certain tract or parcel of land,
situate, lying and being in said county of Hall, known
as Lot No. ninety-six, in the ninth District of said coun
ty, which tract or Lot of land was mortgaged by the
said Frederick A. & Jabez, for tho bet ter securing to your
petitioner the payment of a certain promissory note
made and delivered to vour petitioner, by the said Fre
derick A. & Jabez, on the day and year aforesaid, for the
sum of three hundred dollars, and due on the twenty
fifth day of December, eighteen hundred and thirty,
together with a certain other note described in raid
mortgage, and which is not yet due, and which said
first mentioned note is herewith shown to the Court:
and your petitioner further shows that the whole
amount of principal and interest on said note, is now
due and unpaid. Wherefore be prays, that unless the
said Frederick A and Jabez, pay into the Clerk’s Of
fice of this Court, the amount of the principal, interest
and cost due thereon, within six months from this date,
that the equity of redemption in, and to the said mort
gaged premises, thenceforth ami forever be foreclosed.
Therefore on motion of Council for theplaintiff.it is or
dered by the Court, that tho said Frederick A. Brown
and Jabez Lewis, pay into the Clerk's office of this
Court tho amount of the principal and interest due on
said note, together with all legal costs, on or before
the expiration of nix months, otherwise the equity of
redemption in and to the said mortgaged premises, he
forever barred and foreclosed; and that a copy of this
rule and petition ho published once a month for six
months in one of tho public Gazettes of this stntc, or
that the defendants ho personally served therewith,
three months before the next sitting of this Court.

as J. Rusk, that John Black in Ins lifetime cxecu*
toil a bond to one John Butt to make titles to Lot of
Land No. one hundred and nineteen, in the ninth Dis
trict of Carroll county; and it appearing to the Court
further, that tho said Thomas J. Husk is the bona fide
holder of said bond, and it further appearing that John
Black departed this life without making titles to the
same. It is ordered by the Court, that tho adminis
trators of the said John Black, deceased, do execute
titles to the said lot of land, tothc said Thomas J. Rusk,
unless good cause be shewn to the contrary within (ho
time pi escribed by law; it is further ordered, that
this rule bo published in one of the public Gazettes of
