RULE NISI.
To the Hon. the Superior Court of said county,
flllir. petition of Cliarle* Hulsey respectfully shown,
M that heretofore, to wit: on the eighteenth day of
March, eighteen hundred and thirty, the said Frede
rick A. Brown and Jabez Lewis, made, executed and
delivered to your petitioner,their certain deed of mort
gage, bearing date the day and yca> aforesaid, and
which is here in Court ready to be shown, which deed
of mortgage conveyed a certain tract or parcel of land,
situate, lying arid being in said county of 11 nil, known
a* Lot No. ninety-six, in the ninth District of snid coun
ty. which I raft or Lot of land was mortgaged by the
suid Frederick A. & Jabez, for the better securingto your
petitioner the payment of a certain promissory note
made nod delivered t ryour petitioner, hvtlu* sold Fre-
ferick A. & lahez.on thedavond year aforesaid, for the
vom of three hundred dollars, and doe on the twenty
fifth day of December, eighteen hundred and thirty,
together with a certain other note dcKcnbed in taid
mortgage, and which is not vet due, and which said
first mentioned note is herewith shown to the Court:
und your petitioner further shows that the wholo
amount of principal and interest on said note, is now
due and unpaid. Wherefore he prays, that unless the
snid Frederick A and Jabez, pay into the Clerk’s Of
fice of this Court, the amount oftlie principal, interest
and cost doe thereon, within fix months from this date,
that the equity of redemption in, and to the said mort
gaged premises, thenceforth and forever he foreclosed.
Therefore on motion of Council for the plaintiff, it is or
dered by the Court, that the said Frederick A Bro-.vn
and Jabez Lewis, pav into the Clerk's office of this
Court the amount oftho principal and interest due on
said note, together with all legal costp, on or before
the expiration of six months, otherwise the equity of
redemption in and to the said mortgaged premises, bo
forever barred and foreclosed; and that a copy of this
rule and petition he published once a month for six
months in one oftlie public Gozeltes of this state, or
that the defendants be personally aerved therewith,
three months before the next silting of this Court.

as J. Rusk, that John Black m hi* lifetime execu
ted a bond to one John Butt to ui*ke titles to Lot of
Land No. one hundred and nineteen, in the ninth Dis
trict of Carroll county; and it appearing to the Court
lurther.that the said Thomas J. Hunk is the bona fide
holder of said bond, and it further appearing that John
Black departed this life without making titles to the
same. It is ordered by the Court, that the adminis
trators of the said John Black, deceased, do execute
titles to the said lot of land, to the said Thomas J. Rusk,
unless good cause be shewn to the contrary within the
time pi escribed by law; it is further ordered, that
this rule be published in one of the public Gazettes of
this State agreeably to law. A true extract from the
