It appearing to lhe court by the petition
of Stephen Kilby (accompanied by lhe note
and mortgage deed) that on the twenty
ninth day of December, eightei-n hundred
and seven!v-fotu, the defendant made and
delivered to the plaintiff his promissory
note bearing date the day and year afore
said, when by the defendant promised, five
months after the date thereof, to pay the
plaintiff or bearer one hundred and silty
dollars, with live pel cent, interest per
month until paid, for value received ; and
that afterwards on the day and year afore
said, the defendant, to better secure the
payment of said note, executed and deliv
ered to the plaintiff his d'-ed of mortgage
whereby the said defendant mortgaged to
the plaintiff pails of lots of land number
fortv-two and forty-three (42 and 43), in tlie
fourteenth district and second section of
said county, said land so mortgaged being
one hundred and ninety acres, more or less.
And it further appearing that taid note re
mains unpaid :
It is then fore ordered that the said de
fendant do pay into court, on or before the
first day ot the next term thereof the prin
cipal. interest, and cost due on said note, or
sluiw cause to the contrary, if any he enn ;
and that on the failure of the defendant so
to do, the equity of redemption in and to
said mortgaged premises be forever there
after barred and foreclosed.
And it is iurilier ordered that this rule be
published in The Chekokee Geokgiam
once a month for three months previous to
the n<-xt term ot this court, or served on
the defendant, or his special agent or attor
ney, at least three months previous to lhe
next term of this court.

I desire to call the attention of all
