Use of Scopolamine Would Violate Two
Fundamental Rules of Common Law,

S UPPOSE the suspect did tell the truth under the influence of
scopolamine, the “drug-that-makes-you-tell-the-truth” that created
such a sensation in San Quentin. Would evidence obtained through 1
its use be admissible'in a court of law? No.
'Our system of law is accusatorial rather than inquisitorial. Men'
used to be tortured to make them confess. The rack and thumbscrew
were used. The idea may have been at one time to get thb truth, but'
the effect was to wing a confession from the victim.
The use of scopolamine might be classed as a mild form of torture;
but, assuming that it does bring out the truth, it would violate two funda*
mental rules of our common law. The first of these is that the accused!
person may not be questioned after arrest or during a magisterial hear*'
lug, and the second is that tortuie may not be used to extort the truth. \
Tn many European continental countries the magisterial function is
inquisitorial. He questions the witness, heckles him, tries to wring the
truth out of him.
-' In the English common law this is not done; it is not possible. Under
ftnr system the accused mim cannot be questioned either preliminary to or'
during his trial. A confession may not he obtained from a man unlaw it.
is a free wwrfemrinn, givenr without fear or favor. Otherwise it cannot be
produced in court No immunity can b8 promised. A confession obtained
under promise of immunity can't be introduced.

tune telling, peanut races and spell
ing matches were, also enjoyed.

Wednesday p. m October 29th at
3:30, Mrs W C Cosey the new presi
dent, "presiding. Several important
business matters were " attended to,
and Mrs. Lucile Bateman was given
a rising vote of thanks for her splen
did efforts put forth as chairman of
the “Penny Circus” committee. Ev
eryone had a delightful time, and
the net proceeds amounted to $20.77.
We want to thank those who helped
to make this entertainment a suc
cess and hope we may be favored
with another real soon.

On Thursday night Oct. 30th Mr
and Mrs A R Rogers gave their
neice Miss Alene Rogers, a birthday
party at their home. After many
games were played a delicious course
of fruit salad, cake and apples were
served. All present reported an ‘en
joyable time. Miss Rogers would not
tell how old she was but we had a
chance to guess.

The Taylor Mill Woman’s Club
will have a Box Supper at the church
on Saturday night Nov. 15th. Every
body is cordially invited. The funds
will be used to buy song books for
the church.
Frday night was a very enjoyable
occasion for all those who attended
the Hallowe’en Party at the cottage.
About 7:00 the guests began arriv
ing and continued coming till about
50 were present. They were met at
the 1 door by ghosts and spooks.
Many games were played and plenty
of fun in them. At a late hour apples
and candy were served and the guests
departed declaring that they had
spent an enjoyable evening.
