Under the powers in a deed from
L. C. Wilson to Jim Walter Corpo
ration dated January 17, 1961 re
corded in Deed Book 11, Folio
403-5, Clerk’s Office, Taylor Su
perior Court, the same having been
duly transferred and assigned to
the undersigned transferee, there
will be sold during the legal hours
of sale on March 6, 1962, before the
court house door in said County,
at public outcry, to the highest
bidder for cash, the following prop
erty:
All that tract or parcel of land
lying and being in Taylor County,
Georgia, to-wit: That portion or
parcel of land being in District 12
and being taken from the deed of
Nicey Ann Wilson and recorded in
Book X, folio 563 on Mar. 3, 1941,
beginning at an evergreen tree lo
cated at the northwest corner of
the Nicey Wilson home and measur
ing 32’ in a northerly direction to
a point and 15’ from the center of
West End Road running north and
south to a point, this being the
point of beginning of the land to
be conveyed, beginning at said
point measuring 85’ north to a
telephone polec located on the
corner of property owned by Nicey
Ann Wilson and being the right-
of-way line of said person and Katy
and Lige Gray, thence 100’ east to
a point along said right-of-way,
thence south 85’ to a point, thence
100’ west to the point of beginning.
Default having occurred under the
terms of the note secured by said
deed, and the holder having elected
to declare the entire debt due and
payable, the power of sale con
tained in said deed has become
operative.
Sale will be held, deed made
and proceeds thereof distributed in
strict compliance with the terms
of said deed.

WHEREAS, on the 15th day of
August, 1961, James Marvin Car
penter executed to H. W. Richards
Lumber Co., of Carroll County, Ga.
a deed to the following described
property, to-wit:
All that tract or parcel of land
situate, lying and being in Taylor
County, Georgia, and described as
follows: Said tract being one half
of a certain lot No. 6, Block E, de
scribed below and said tract being
100 feet wide and 200 feet long.
This tract is from an original lot
shown and being the same as Lot
No. 5, Block E, of the Plat of Pine
View Sub-Division, City of Butler,
Taylor County, Georgia. Said Plat
being prepared by J. R. Curtis,
Registered Number 402, dated Sept
1, 1958, and recorded in Plat Book
No. 1, Page 192 of the Superior
Court Clerk Records of Taylor
County, Georgia.
BEGINNING at the Southeast
corner of Lot No. 6, Block E, of
Pine View Sub Division, 200 feet
in a northerly direction to a point,
thence 100 feet in an Easterly di
rection to a point; thence 200 feet
; in a southerly direction to a point
j of intersection with Sunset Drive;
| thence 100 feet in a Westerly direc-
'tion along Sunset Drive to the be
ginning point.
To secure a note in the amount
of $8,190.00, which said deed is re
corded in Deed Book 11, Page 526,
in the Office of the Clerk of the
Superior Court of Taylor Counay,
Georgia; and
WHEREAS, said note has become
in default, both as to principal and
interest and there is now due and
owing on said note $8,190.00 and
the said H. W. Richards Lumber
Co. elects and hereby declares said
note, both principal and interest,
due as provided in said deed;
NOW THEREFORE, in accord
ance with the terms of said deed
and the Laws of Georgia, in such
cases made and provided, the un
dersigned will expose for sale to
the highest and best bidder for
cash, the above described land, af
ter proper advertisement, on the
first Tuesday in March, 1962, be
tween the legal hours of sale be
fore the Court House door in Tay
lor County, Georgia.
The proceeds of said sale will be
used first to pay the balance due
on said note as principal and in
terest, and the expenses of said sale
and the balance, if any, will be de
livered to the said James Marvin
Carpenter.

The undersigned will sell before
the court house door in Taylor
County, Georgia, between the legal
hours of sale on the first Tuesday
in March, 1962 to the highest bid
der for cash certain real estate de
scribed in a deed to secure debt
from J. T. Tucker to Timberlake
Grocery Company of Macon, dated
September 18, 1961, recorded in
Book 11, Folio 550, Clerk’s Office,
Taylor Superior Court as follows:
"All that tract or parcel of land
lying and being in the State of
Georgia, County of Taylor, and in
the Twelfth Land District therein,
said conveyed land being all of
Land Lot No. 52 in said District,
County and State. Said land is
bounded as follows: North by Land
Lot No. 51, East by Land Lot No. 77,
South by Land Lot No. 53, and West
by Land Lot No. 45 — all said
named land lots being in said Dis
trict, County and State. Said con
veyed land lot contains 202 >/ 2
acres.
“This is the same property con
veyed to party of the first part by
deed dated March 7, 1957, recorded
in Clerk’s Office of Taylor Superior
Court, on March 8, 1957, in Book 7,
page 596.
“Also all that tract of Lot of
Land lying and being in the State
of Georgia, County of Taylor, and
in the Third Land District there
in, said conveyed land being all
of Land Lot No. 248 in said District
State and County, and said land lot
contains 202% acres, more or less,
and being the identical lands de
scribed in a deed dated Nov. 1,
1893 from Scandrett, et al. to Nancy
Wilcher, and of record in Deed
Book D, page 201, Clerk’s Office of
Taylor Superior Court.
"This is the same property con
veyed to party of the first part
herein by two warranty deeds re
corded Sept. 27, 1957 in Deed Book
9, page 150, and February 20, 1958,
in Deed Book 9, pages 268-269,
Clerk’s Office, Taylor Superior
Court.”
Said sale will be conducted and
a deed executed to the purchaser
pursuant to the powers contained
in the aforesaid deed to secure debt
from J T. Tucker to Timberlake
Grocery Company of Macrvi.
As to the first tract of land de
scribed in said deed to secure debt
being that located in Land Lot 52
of the Twelfth Land District as
aforesaid, said deed to secure debt
is second and inferior to a deed to
secure debt from J. T. Tucker to the
Bank of Fort Valley dated March
16, 1957, recorded in Deed Book 9,
page 3, said Clerk’s Office, and as
to the second tract, being that in
Land Lot 248 in the Third Land
District, said deed to secure debt is
second inferior to a deed to secure
debt from J. T. Tucker to the Bank
of Fort Valley, dated October 1,
1959, recorded in Book 11, Page 61,
said Clerk’s Office. The sale under
said deed to secure debt to Timber-
lake Grocery Company of Macon as
aforesaid will therefore be made
subject to the said deeds to secure
debt in favor of the Bank of Fort
Valley.
Said deed to secure debt was to
secure an indebtedness due on open
account in the sum of $18,779.12 as
described in said deed to secure
debt and also any other or further
indebtedness which the first
party therein might then or there
after owe second party therein,
and the said J. T. Tucker became
indebted to Timberlake Grocery
Company of Macon in a further
sum so that the entire indebted
ness now due and secured by said
dweed to secure debt is $19,971.91,
principal, plus interest at 7 per cent
per annum from January 1, 1962.
Said entire indebtedness is’ now
past due and unpaid, and by rea
son of default of J. T. Tucker in
failing to pay said indebtedness
when due, the power of sale con
tained in said deed to secure debt
has become operative.
The proceeds of said sale shall
be apuplied as provided in said
Deed to Secure Debt.
