On yesterday evening Deputy Unit-
oil States Marshal Wyatt brought to
the city under arre.-t, on charge of
illicit distilling, Mr. Johit’C. Howard,
of Harlan co..nfv.
Mr. Howard is a man about fifty-
five years of age, cortifortnbly clad in
homespun, and has the ap]x-nrance
and being of uu honest, unsophistica
ted mountaineer. He was arraiugned
before the proper authorities this
morning, and after investigation was
honorably discharged—no proof ap-
j waring to create any grounds of suspic
ion against him; but lie is released
from custody 145 miles from his home
without a dollar in his pocket, and no
means of locomotion at command save
his two feet.
We insist upon it that it is a great
hardship to treat such a man in such :t
manner. The Court should appoint
Commissioners in the various sections
of the State before whom preliminary
examinations can lie had, and poor,
innocent men spared the ordeal
through which Mr. Howard is now
pnssiu'g, turned adrift" penniless and
friendless at a great distance from his
home.
The only article of which the un
fortunate man is possessed, from which
he can realize funds sufficient to defray
his expenses to his residence is
a curious-belic,
of ages past, to-wit 2 1\ decaying idol
of the Aboringin&s, which is'carved
from pitch pine, -jind represents the
bust of a human form, including head,
body, and arms, which was found
about four years ago hy Mr. Lewis
Farmer, in a cave in the cliffs over
looking the Cumberland river at the
point where it cuts through Pine
Mountain, about one mile from. Pinc-
ville, the Capital of Josh Bell county.
On his way hither under arrest, Mr.
Howard met Mr. Farmer, who gen
erously allowed him to bring the curi
osity with him to the city with the
view of <lis|>osing of it, if lie could do
so advantageously—-Mr. Howard lcav-
• ing his mule in pleilge to lie' retained
hy Mr. Farmer, if the idol be not re
turned. The entrance to the cave in
which it was found is said to be near
the top of the cliff, almost if not quite 111
n mile above the level of"the river.
How long ago since the statue was
de]iosited there, and hv whom, must
of course lie loft to conjecture—certain
ly ages ago, and by a race now quite
extinct.
Those wishing to examine the curi
osity can see at it the. moms of the
Public Library, where it is. for the
present. It should he purclmrsed for
n remunerative price, and placed
the museum of that instructive itisti-
tion. It will lie nothing but fair lor
those who instigated the arrest of the
unfortunate man to make amends, as
far ns may lie, hy paying him a lib
eral price 'therefor. • *
