ed through the mails for distribution at the post
office of which you have charge.
The statute alluded to it la the following
words:
“Sac. 23. If a free person write or print, or
cause to be written or printed, any book or other

this statute is in conflict with the act of Congress
regulating the administration of this department,

lawfully detain in his oftou any letter, package,
pamphlet or newspaper, with the intent to pre

pamphlet or newspaper may be addressed or <U

forever thereafter incapable of holding the office
of post master in the United States.”
Tho question thus presented was folly decided
by Attorney General Cashing, in tho Case of the
Vasco City post office. (Opinions of Attorney
Generali, vol. H, 4M,) He there held that a stot
wte of MiMisKiupi, in all respects analogous to
that of Virginia as cited, was not “consistent, with
the act of Congress quoted, prescribing the du
ties of postmasters in regard to the delivery of
mail matter, and that the latter, as good citwens
Wore hound to yield obedience to such Htate laws.

rendered, nor indeed can it he. One of the most
solemn eonsiitutioaal obligations imposed on tho

States against “InsnrreeUon” and domestio vio
lence—of course, none of its Instrumentalities
can be lawfully employed in lacking, even In the
remotest degree, to this very crime, which in.

preasion of which it is specially charged. You
must, under the responsibilities resting upon you
as an officer and as a ellisen, determine whether
tho beeks, pamphlets, newspapers, do., received
by you for dlstnbutim, are of tfce incendiary
character described in tlw statute; and ifyuu be
lieve they aro, then you are not only aot obliged
to deliver them te those to whom they aro ad
dressed, but you are empowered eud required
by yohr duty te the State of which you are a
citisen, to dispose of them in strict conformity
to the provisions of the law referred to. The
people of Virginia may uotoaly forbid the intro
duction and dissemination of such documents
within their borders, but, if brought there lu the
mails, they may, by appropriate legal proceed
ing*, have them destroyed. They have the same
right to extinguinli Are brands, thus impiously
buried in to the midst of their homes and altars,

bombshell which is about to explode at bis feet.
