Tiib Kim.inii ok Mr. Lewis in Uurkk
County.— Yesterday morning tho negro
(Hen Qodby) to whom is imputed the
killing of Mr. Adl;ln D. Lear is, on
Wednesday morning last, in Rurko court*
ty^llvo miles from Waynesboro, arrived
in this city, nceoinpaiiied by Ids wife,
who hud'alho-been- in the sorvioo of Mr.
Lewis. It ia repotted that the accused
came to tho city with a view to obtain
legal process by which he could secure
tho possession of a child loft on the
premises of Mr. Lewis. At any rate, a
colored man accompanied him to tho
otticu of Justice Lyons, whore he pro
ceeded to rolato his story. That officer
charged him with the killing of
Mr. Lewis. 11c admitted having
u difficulty with tliut gentleman on
Wednesday morning, hut claimed to ho
ignorant of tho death of his employer in
eonsequuncoof the wounds iutlictud by
him. Alleging apprehensions of person
al violence if lie should return to liurke,
he surrendered himself to Justieo Lyons,
nnd was committed to jail to uwait de
velopments.
Tlio weapon which tho prisoner con
fessed to have used in stubbing Mr.
Lewis was found in his possession, to
gether with a pistol. Tho knife is a
rough and ungainly instiumontof death,
having been mau ufcictu rod from nn old
file about an inch in width, mid eight or
tiiue inches long, worked down to u very
sharp point. It is just such a weapon
ns tho brutality of n savage would do*

The Eligibility Queetion
The right of the negro to held office
undsr tho new Coiintitntioo, has been
concedod throughout by many Demo
crats of tho atruighlcNt sect.
After the vote was taken and tho mo
tion to *tri«o nut prevailed, the majority
of the Convention having thus deliber
ately pronounced ugainst the mutter at
issue, wo considered the question finally
disposed of. TheChief Justice concurred
iu theso views, and non-eligibility was
made the turning point of the convuss
in uppor Georgia, when tho ratification
of the constitution was submitted to tho
peoplo.. Had tho contrury doctrine
been asserted, who believes that bo re
spectuble a vote of whites could have
been secured for that hist rumen: ?
As events bnvo turned out, the politi
cal juggling of tho conservative minor
ity iu the Convention, bus been com
pletely checkmated and defeated by u
radical Judiciary, which all uro forced
to concede possesses tho power to con
strue and interpret the Constitution.
Once moro have wo cause bitterly to
deplore that suicidu! lachtn ami blind
submission to old party leiulor*, which
impelled tho whites of Georgia to with
draw from tho convention eunvess, and
allow our ouomiuH, without let or bin
drunco tu frame tlio organic law of the
laud.
Tho very first general election in which
wo condescended to participate, demon
strated that tho Democracy might havo
controlled the constitutional convention
and then and there settled forever tho
questions now in dispute
Hut regrets are unavailing, and we
can only address ourselves to the pres
ent duties of the hour.
Wc hold then, that perfect nud un
complaining submission to existing laws
is the paramount du'y of every good
citizen. Indeed this is also our true und
wisest policy. Any oflort at resistance
now, would but aggravate the asperities
of the situation, and result in deeper
und more ignominious humiliation. We
should hear tlio tread of the armed sen
try again in the hulls of justieo, and be
remanded hark to tlio rule and tender
mercies of Federal sub officials.
May heaven avert from us such a
Tutu. Hut it is contended by some, that
the Uenornl Assembly having the right
to pronounco upon tlio qualifications of
its own members, may ooutinuc to rx
ehiilo those who have been ejected from
tholr seats. We do not hold to this
doctrine when It comes in direct conflict
with constitutional rights Nay, this
privilege is accorded to legislative bod
ion, for tho express reason that they may
purge themselves from sitoli character*
may lift ineligible wider thi lav,
who violate tho rule*, or treat with con
tempt the inomhers of those nssem
bingos
'Hint any, clearly elected under th
constitution, nud against whom neither
fruml nor orimo in imputed, cun ho
polled by tho mere will and oaprico
a majority, in simply an nbiurdity.
Hut in tho present instance, onoh
house has by a direct vote, nlrcndy du
cided that tho Bupromo Court has ju
risdiction in tho premises. And but for
the Executive veto, tho General Assem
bly itself would have referred the ques
tion to tlio arbitrament of that tribunal.
Again, our Legislature should differ
to the late decision of the Suprumo
Court, because not only expediency bill
necessity demands tlii*oourse. A refu
sal, would be construed into an act of
rebellious opposition to law by the Fed
eral authorities, am) the military would
at once by force of arms sustain tho
Court.
Wo trust then, both Legislature and
people will yield a ready assent to this
obnoxious provision of tho constitution.
Whon onto admitted into tho Union and
to our congressional status, another
convention can remodel tho orgiyiic law,
and correct the abuses which We nro
now powerless to abate. To be thor
ough, and successful, tho remedy should
bo ponceublo and legitimate. Surely,
wo liuve already suffered sufficiently, by
uu np|>eul to other and harsher measures
The University of Georgia.
From tho venerable Chancellor ol this
noblo institution, of which every Geor
gian should foci justly proud, we learn
many interesting particulars reluting to
the university, Within the past twelve
months, three times ns many students
have been matriculated ns over joined
the college in the same length of time.
Three hundred and fifty young gentle
men representing tlm best families at
tho South, ore now in actual attendance,
und tho number iscoiietuully increasing.
In the matter of State pride and pat
ronage, our university is fur in advance
of any other at the South. As a proof
of this,
