The Negro Eligibility Question
The late decision of tho Supremo
Court on tho eligibility of negroes to
hold office in this State, has produced
extended and varied comment by the
prose—especially m regard to tho pow
er of each branch of tho legislature to
decide for itsolf the eligibility of mem
bers of its body. Home seem to be of
the opinion tliut the decision will have
the effect of ro seating the nogroos in
thBliegisktur*', while ethers oontend that
it will not. Tho probabilities are that
this question will produce n groat deal
of wrangling and strife, and give the
Radical Congress tho oxcuso for dealing
harshly with this Btnto. Not beiug s
lawyer, we feel incnpablo of advancing
a poailiva opiniou us to the effect of the
deciaiou in regard to restoring the ne
gro members to seats in the Legislature.
As the interpreter of the Constitution
•s well ns the laws, the Supreme Court,
having decided negroes eligible to bold
office, also decided that the action of tho
Legislature in expolliug them therefrom
vie-lated the Constitution, mid thus de
prived them of rights which belong to
them under the Constitution as inter
preted by the Court, lienee, if the no.
groos wore illegally deprived of this
right by oxpulsion, then the decision
simply reinstates thorn in the poesoaiuu
of those rights.

pose upon tho eligibility of members to
seats in each, und if tho Constitution
makes them eligible it is simply the du
ty of the Legislature to see that ite mem
bore aro eligible in the purview of the
Constitution, ami not by any law they

branch to see to it that its members are
elected in accordance with the provisions of
Ms Constitution. Hence,if the constitution
does ooofer the right upon negroes to
hold office, as decided by the Supremo
Court, then the uegrooa have been de
prived of that right by the action or tho
J .ogialature, and the decision of the
Court, the iuterpretor of the Conatitu.

lature, nsder the luting of the Supreme
Court.
All admit however that at the next
election, and 1 until this nbnoxious fea
ture is stricken from tho constitution
negroes If fairly chosen will bo eligible
to any office in the country. The op.
position turns simply upon the judicial
power of the General Assembly to de
termine the qualifications of its own
members. Now, as tho vory construc
tion and authority of the Legislature is
lerived from, and subject to tho laws,
manifestly it involves an absurdity to
assert that it* members aro independ
ent of, and superior to those laws.
It is tantamount to an assumption of
absolute power, und in consonance with
the old apothegm tho king can do no
wrong. By purity of reasoning a Rad
ical majority in congress, time and
again has seated partisan contestants
who were clearly defeated before tho
people The difference in the parrullel
is simply this. Tho federal legisla
ture has usurped and wielded for sever
al years post, absolute power, while our
Genera] Assembly is not only held in
cheek by the supreme tribunal of the
Btatc, but tberu is still a more potent
authority over it in the bayonets of a
despotic military government.
Iiesistanoe to tho decree of tho conrt
at this time, would be met by an order
from General Grant to roseot the ne
groes by force of arms. Tho Buncombe
opposition of tho Legislature therefore
would bo futile, and eyon rosult in
deeper humiliation to itself.
Manifestly our duty in this emorgen
cy, is to ofUr no factious and unavail
ing opposition to the wrotched govern
ment which was furcod U|>on us against
the verdict of the people, and iu viola
tion of our constitutional rights.
Let us wait patiently, and bide our
limo until this period of probation, ami
"continued statu of war" which leaves as
a prey to the conqueror, ceases. Then
Georgia left to liersolf will remodel
Qonoral Mend* constitution, and abolish
innovations odious in their nature, and
degrading to her citixonx.
Until then, wo have only to be vigi
Jsnt and untiring in our efforts to muin
tain tho ascendancy of tho Anglo Sax
on race. Let every soaluwsg and bolt
or from tho ranks, bo crushed out and
avoided, as though infected with the
plague of leprosy. Let them know they
dwell under the ban of all decent socie
ty, and must uln-ono their associates
among those with whom they have a(
filiated. Lot their namea be a hissing
and reproach in the lund. In short, let
them feel that the abandonment of prin
olplo will iuvolvo tho surrender of
spectnhility, and bring down upon thuii
bonds the fiooin and contempt of ull
honest men.
Thus united, who doubts that intelli
genoe, capital, and religion, will continue
to exert thoir sway as in former times.

in order and proper condition for tho
Fair in November, with be immediately

Miiuoii is destined to he, by fui, tho fi
nest exhibition of tho kind ever made in
Georgia. The Laboratory Building,
which by the kindnoas of tho authorities
in Washington bus been turned over
to the Society for this purpose, is grand
ly ndnpted to tho show. Its grounds
contain 140 acres and tho main build
ing, besides numerous other rooms ndup
ted to all uses, has one magnificent hall,
finely lightod, nud over UOO feet long by
eighty feet wide.

or of Agriculture, will bo hero, and
many other men of note. Wo hope to
inako tho occasion one which will re

vnneement of every interest of Georgia,
and bo largely instrumental in dispell
ing unfounded prejudices against our
