to the Court by the
petition of Elizabeth T. Latimer, that by
deed of Mortgage, dated the first dav of
October, eighteen hundred and eightv-five
Surah Alma Ware, conveyed Elliott John¬
son and Company, that tract or parcel of
land in Monroe county known in the
plan of said county, as lot number nine (9);
containing eight 202£ acres, half of lot number
district (8 containing 1(>0| acres, in 12th
of said cout\ Vlso 90 acres of lot
number eight (8) and 35 acres of lot num¬
ber nine being (9) in the 12th district of said
county; in all 4‘28'j i lores, all in one
body, on Tobesofkee creek , 1\ liich Mort¬
gage was given to secure the payment ot a
certain prommisson note tor fourteen
hundred (814.(100,00) dollars, principal
sum executed |hy said Sarah Alma Ware,
on date aforesaid in favor i of said Elliott
Johnson & Co., payable October 1st. 1890;
waiving homestead and providing for 10
per cent, attorneys fees on principal and
interest, to which note arc attached i*ou
: pon notes for interest, payable semi-Annu¬
ally tor $56.00 each, which said principal
note has matured bv the terms thereof for
default in payment of interest That two
of said interest coupons (N o. 6 and 7) arc
t due and unpaid N 6. there is SI.50
interest due on this 26th August, 1889, on
coupon >i 7, there is $1.54 interest due Oil
1 principal not there is $45.42 interest due
i<] 159 24 attorneys fees on principal
and interest ; That the total amount due
including principal, interest and attorneys
fees is $1,718.70. that said principal note,
interest coupons and mortgages, were duly
assigned to Elizabeth T. Latimer by said
Elliott Johnson A Co. for value on said 1st
October 1885.
It is ordered that the said defendant do
pay into this court by the first day of the
next term, the principal, interest, attorneys
fees and costs due on said note, interests
coupons or show cause if any ho has to tho
contrary, or that in default thereof fore¬
closure he granted to the said petitioner of
said mortgage, and the equity of redemp¬
tion of the said defendant therein bo for¬
ever barred and that service of this rule
he perfected on said defendant according
to law. 20 August 1889
