The following ordinance read first
time, rules suspended, read second
time and unanimously adopted:
State of Georgia. Hall County,
in the City of Gainesville of said County.
NOTICE.
Notice is hereby given to the qualified voters of
Che City of Gainesville. Georgia, that an election
■will be held in said city on Saturday, the 2nd day
of April, 1910. at the council chamber in the city
hall in said city, the place where the elections of
said city are usually held, for the purpose of de
termining the question of whether bonds shall be
issued by said City of Gainesville for the amount
■of One Hundred Thousand Dollars for the pur
pose of enlarging, increasing and perfecting the
-present water works plant and system in and for
said City of Gainesville, extending water mains
over additional streets of said city, increasing and
enlarging the present water supply in and for
said city by the purchase of additional lands,
streams and water powers, rights of way, rights
and privileges, and for the laying and extending
of additional water pipes and mains, and for the
purpose of installing and erecting filters, pumps,
stand pipes, and additional buildings and dams
and any and all other machinery and fixtures,
necessary for the completion and perfection
■of an up-to-date water works plant and sys
tem in and for raid City of Gainesville; or whether
bonds to the amount of Twelve Thousand Five
Hundred Dollars shall be issued for the purpose
■of erecting one other public school building in and
f,, aid cit; , and the purchase of such land or
lands as »may be necessary for the erection of
aid school building; of whether bonds to the
amount of Twelve Thousand Five Hundred Dol
lars shall be issued for the purpose of extending
-•nd enlarging the present sower system in and
for said city; nr whether bonds to the amount of
Five Thousand Dollars -hall be i sued for the pur
pose of increasing, perfecting and enlarging the
ore-ent lighting system in and for said city. The
amount of the bonds to be issued, the purpose for
which issued, the rate of interest they are to
bear, the amount of principal required as a sink
rig fund to be paid annually, and theamountof
•interest to be paid semi-annually in gold coin, or
its equivalent, and when said principal and in
terest. in case of the adoption of any or all of the
above bonds, is to be fully paid ctf, and the rules
xml regulations covering said election being all
fully set out and fully provided for in the follow
ing Ordinance, which is hereby made a part of
this notice, and published as a part thereof. Said
ordinance having been duly adopted by tlx* Mayor
and Council of said City of Gainesville on the 24th
day of February. 1910, at a regular meeting of
said Mayor and Council.
AN ORDINANCE.
An Ordinance to provide for the submission to
the qualified voters of the City of Gainesville the
quest ion of issuing fiends for the enlarging, in
creasing and perfecting the present water works
plart and system in and for said City of Gaines
ville. extending water mains over additional
streets of said cityl increasing a>d enlarging the
present water sup,lx/ for said cis’ by the purchase
of additional lands, streams aid water powers,
rights of way, rights and privileges, and for the
laying and extending of additional water pipes
and mains, and for the purpose of installing and
erecting filters, pumps, stand pipes, and any and
all other machinery and fixtures necessary for
the completion and perfection of an up-to-date
water works plant and system in and for said
City of Gainesville, and for the purpose of erect
ing one other public school building in and for
said City of Gainesville, for the purchase of such
other land or lands as may be necessary for the
erection of said school building for said city, and
for the purpose of extending and enlarging the
present sewer system in and for said city, and for
the purpose of increasing and perfecting the
present lighting system in and for said city.
Section 1. Be it ordained by the Mayor and
Council of said City.of Gainesville, and it is hereby
ordained by the authority of the same, that on
Saturday, the 2nd day of April, 1910, an election
shall be held at and in the council chamber, in the
city hall, in the said City of Gainesville, for the
purpose of obtaining the assent of two-thirds of
the qualified voters of said City of Gainesville to
the issuing of bonds for the purpose of enlarging, I
increasing and perfecting the present water '
works plant and system in and for said City of |
Gainesville, extending water mains over addi
tional streets of said city, increasing and en
larging the present water supply for said city by
the puachase of additional lands, streams and
water powers, rights of way, rights and privi
leges, and for the laying and extending of addi
tional water pipes and water mains, and for the
installing and erecting of filters, pumps, stand
pipes, and any and all other machinery and fix
tures necessary for the completion and perfection
of an up-to-date water works plant and system
in and for said City of Gainesville, and for the
purpose of erecting one other public school build- ,
ing in and for said City of Gainesville, the pur
chasing of such land or lands as may be neces
sary for the erection of said school building, and
for the purpose of extending and enlarging and
the laying of additional sewer mains in and for i
said city, and for the purpose of increasing and i
perfecting the present lighting system of said city. ’
Section 2. Be it ordained by the authority
aforesaid, that the above specified four ques
tions shall be so arranged in their order that
the voters shall be enabled to vote for or
against other of said propositions, for the
purpose of isruing bonds; and it said voters
shali assent to rhe issuing of bond* for the

lor said cit y; or if the qualified voters should

of one other public-school building, aid the

qualified voters should assent io the issuing ol

aforesaid, then the amount of bonds to lie is

Hundred Dollars; or if tire qualified voters

amount of bonds to be issued for the pulpose
of extending and enlarging the present sewer
system in and tor said city shall be the sum of
Twelve Thousand and Five Hundred Dollars;
or if tire qualified voters of said city of Gaines
ville should assent to the issuing of bonds for
the purpose of increasing and perfecting the
present lighting system in and for said city,
then the amount of bonds to be issued for that
purpose shall be the sum of Five Thousand
Dollars; or if the qualified voters of said city
of Gainesville should assen by their ballots to
the issuing of bonds for each and all of the
above specified projects and improvements then
the amount of bonds to be issued shall be in all
the sum of One Hundred Thousand Dollars. In
either event, whether the issue of any or all of
the above described bonds shall be assented to
by the qualified voters of said city, and in case
any of said bonds shall he assented to by the
qualified voters of said city, then said bonds
shall bear interest at the rate of four and one
half per centum tier annum, payable semi
annually in gold coin or its equivalent, on the
first day of January and of July of each and
every year thereafter, at the office of the City
Treasurer ot Gainesville, Ga., or some bank
elsewhere other than in said city of Gaines
ville. Said bonds shall be issued, whether for
any or all of the above specified and described
purposes, in denominations of One Thousand
Dollars each, numbered consecutively from 1
to 100, and shall be signed by the Mayor and
members of the City Council of said city of
Gainesville, and shall be countersigned by the
Treasurer of said city, and shall be sold to the
highest and best bidder, after such notice or
notices is given as may be deemed best by the
Mayor and Council of said city of Gainesville,
provided that none of said bonds shall be sold
for less than par, and the expense of sale, if
any, shall be paid from the proceeds of the
sale of said bonds. The sum of Seventy Thou
sand Dollars of the proceeds arising from the
sale of said bonds shall be used in the enlarg
ing, increasing, and perfecting the present
waterworks plant and system in and lor said
city of Gainesville, as herein before described.
The sum of Twelve Thousand and Five Hun
dreil Dollars of the nionev arising from the
I sale ol said bonds shad be used lor the purpose
! of ei rni ing one other public school building in
i and for said city, and for the purpose of buy-
ing the land, or lands, necossar.' upon which
Ito erect said school building. The sum of
■ Twelve Thousand and Five Hundred Dollars of
■ the money arising from the sale el said bonds
| shall be used for the purpose of extending and
i enlarging the present sewer system of said
i city, as herein before described. And the sum
, oi Five Thousand Dollars arising from the sale
| of said bonds shall be used for the purpose of
i increasing and perfecting the present lighting
j system in anti for said city, as herein before
I described.
Section 3. Be it ordained by the authority
! aforesaid , that the said bonds shall fall due
. thirty years from date thereof, and shall be
paid in the manner hereinafter set forth.
Section 4. Be it ortiainetl oy the authority
aforesaid, that the said city of Gainesville shall
each year assess mid collect a tax, not, to ex
ceed the Charter limit, snflieient in amount to
i j>ay the annual interest, on the bonds issued as
above set forth, and to provide the required
amount necessary to lie set aside as a sinking
fund, lor the payment of said bonds, as follows:
II the qualified voters of said city assent to the
issuance of only the sum of Seventy Thousand
Dollars for the increasing and perfecting the
present water works plant ami system in and
for said city, aS herein before described, then

to be set aside as a sinking fund tor the pay
ment of said bonds, as follows: If the qualified
voters assent to the issuance ot the sum of

ry land lor the same, in and fur said city, then
said tax to be raised for the payment of the
principal shall be: l or the first five years, the
sum of Three Hundred Dollars per annum: lor
the next five years, the sum ot Three Hundred
Dollars per annum; tor the next five years, the
sum ot Four Hundred Dollars per annum; for
the next five years, the sum of Four Hundred
and Fifty Dollars per annum; lor the next five
years, the sum of Five Hundred Dollars per an
num; and lor the next and las: five years, the
sum of Five Hundred and Fifty Dollars per an
num.
Section 6. Be it ordained by the authority
aforesaid, that the said city of Gainesville shall

chased under this section, or this Ordinance, j
. shall not, under any conditions, be reissued, ■
but shall be canceled.

words expressive of his desire and choice, as
follows: “For bonds for the purpose of increas
ing and perfecting the present lighting system
in and for said city of Gainesville,” or
‘‘Against bonds for the purpose of increasing
and perfecting the present lighting system in
and for the said city of Gainesville.”
Section 11. Due and legal notice, as required
by the laws of Georgia, shall be given of the
holding of the election hereby ordered, by pub
lication of said notice iu the Gainesville Eagle
the same being the newspaper iu which’ the
Sheriff’s advertisements of the County of Hall
are published, and said notice shall he pub
lished in the Herald, a newspaper published in
the city of Gainesville, and said notice shall be
published also in the Gainesville News, anews
paper published in the city of Gainesville, f r
the space ot thirty days before the date <>n

Section 12. AH ordinances, or parts of ordi
nances, conflicting with this ordinance are
hereby repealed.
This notice is given in compliance with the
provisions of Section 377 of the Code of 1895 of
Georgia, by direction of the Mayor and Council
of the city of Gainesville, Ga.
