If from the bowers of Ease they fled, To seek Affliction's humble shed ; If Grandeur’s guilty bribe they spurned, And home to Virtue’s cot returned, These feet with nngels’ wings shall vio, And tread tho pulace of the sky. — ■« •> [From the Louisville Journal.] Jury Trial in Texas- Tho following incident characterising the order of the times may be relied upon as being truthful in every particular: By a recent military order in the Territo ry of Texas, our newly fledged sable sover eigns are made eligible to seats in the jury box. And before we give the details of the incident, it is proper to state that by munic ipal regulations of the Teiritory justices ol the peace have jurisdiction over offense of certain grades, with power to impannel a jury of six, and try the cause ia regular and ample form, which gives to this charac ter of judicial proceedings a dispatch rarely met with ia the States. In an interior county of the Territory, not many weeks since, a criminal offense occur red between two colored gentlemen, in which one came very near losing bis life, without the least provocation. The offender was ar rested and brought before a justice for trial. Able counsel were employed upon both sides. A jury of colored citizens was brought from the cotton fields, one of whom being an ac quaintance of ours, was appointed foreman, impanneled, sworn, and charged to deter m’ue the issue according to law and evidence. Able arguments were made in both the pro secution and defense. Book after book, and authority afier authority were elaborately and eloquently paraded before the court and jury. Unusual pains were taken to instruct the jury, as it was new to them, not only as to the law applicable to the case, but as to their duties as jurors. Reports say that it was one of the rntst masterly efforts ever made in the Territory before a similar court. His Honor charged the jury that it was their duty to find a verdict, and when they had found it to return it into court —that, if they found their verdict so and so, 6ucb and such would be the result; but if they found it otherwise, the resuld would be different; but impressed it earnestly upon their minds that their first duty was to find a verdict. The jury w as put in charge of an officer and con ducted to a room, aud left to themselves.— After a lapse of half an hour or more, Sam, the foreman, was seen making bis way, fol lowed by the rest of his peers, to the seat of the Judge, pap.-rs in band, with the airs common to the youug in the law. The pan el was called and novitiates requested to answer to their names. Sam squared hints self before the eourt, displaying the papers with great pomposity, aud theu delivered Limselt to bis Honor: “Seehere Mr.Court, we’s been down to dat are room, aod we bunts in every crack, in every corner, up the chimney, and under de floor, and can’t find any thing that looks like a wordiek.” His Honor then attempted to explain to them wliat a verdict was, and directed them to return and consider of it. After they bad been out about a half an hour they agaiu made their appearance before the court, and Sara thus enquired of bis Honor: “Looker here, Mr. Court, didn't you ’point me foreman of dis jury ?” “Yes sir, I did.” “Dal’s what I told dese fools, but doy didn’t got sense enough to know it. I tells ’um what and how dis case is, and dey won’t do as I tells 'urn. Ain’t dey bound to do what I say Mr. Court?” The Justice told them they might go back to their room, and requested the counsel to go after them and make up a ver dict, as be wished to go to dinner. The law yers followed, and the jury soon returned with a verdict of one dollar fine and the dis missal of the defendant.
