delivered to said Petitioner a certain
Instrument in writing commonly call
ed a promissory note, wit It six coup< tl
notes for interest annexed thereto,
whereby they promised to pay said
Petitioner or order SIOO, on the Ist
day of April 18X7, with interest from
said date at the rate of s pereeut. per
annum, paynhlc amntally, said cou
pon notes for interest being as follows;
one fur the sum of slit 28 due Nov. !■>,
IXB2 (which lias been paid!, and each
of tile others for 882, payable respect
ively on the 15th Nov., Iks:!, 1884,

Ist, ISS7; and, that afterwards, on
the Sth day of April IKS:* for securing
the payment of said notes oil the sev
eral days of payment aforesaid, the
Said Hiram, Avarilla, Martha and Co
ra, executed and delivered to Peti
tioner, a certain deed of Mortgage,
conveying to said Petitioner nil that
tract of laud, beginning at a hickory
and ruiintng East 1-1 chains to a stake,
ilionee South 11 West 01.71 chains to
aehesnut; thence South 20 West 7.0S
chains to a stake; thence North S7;
West 22.77> chains to a stake or rock ;
thence North 1ti.50 links along the
public road from Greenesboro’ to Pen-

6.50 chains to u rock; thence North J
NVest 27.77) chains to a rock; thence
North 4 East 4.80 chains to a stake;
thence South Kill Mast 7.00 chains to
a stake ; thence North 1 West 7> chains
to the beginning corner, containing
J2SJ acres, hounded by the lands of
John K. < iodkin, James M. Littleton
and Philip Robinson and John T.
Stone, and lacing in the 144 District
said county; condititioned to lie void
on the payment of said note; which,
said note and Mortgage deed, are
nowhere to the presence of the Court
shown.
And it further appearing that said
principal, note, waiver, homestead
and stipulates that should any of said
interest not lac paid when due, it shall
hear interest from -maturity at the
rate of 8 percent peramnmi. as agreed
in said interest note, and that upon
failure to pay any of said interest
within 80 days after due, said princi
pal sum may, at the option of said
Petitioner, or his Assignee, without
notice, be declared due, and may
thereupon he collected at once, time
being of the essence of the contract;
and that in ease said note is collected
by suit, said makers will pay all costs
of collection, including ten per cent
of Attorney's fees computed on said
principal and interest.
Audit further appearing that said
coupon note for interest due Nov. Pith,
1883 was not paid when due, and that
the same is now past due and unpaid.
By reason whereof, Petitioner elects
that the principal and inter.-t shall
all become, and is now due, and -ay -
that the said Hiram Rouzee, Avarilla
Handle, Martha Rouzee and Cora
Rouzee are indebted to Petitioner the
principal sum named in said note and
interest coupons, and interest there
on, and that although so indebted
and to pay said notes often requested,
have not paid the same or any part
thereof, but have hitherto, and do
now refuse to pay the same.
It is therefore ordered, that said
Hiram Houz.ec, Avarilla Hundall,
Martha Rouzee and ('ora Rouzee pay
into this Court by the liist day of the
next term thereof, the principal, in
terest. and costs due on said promisso
ry note and coupon notes, together
with ten percent on said principal
and interest as Attorneys fees, or
show cause to the contrary if any
there be; and that on failure of saill
Respondents so to do, the equity of
redemption in and to said Morgiiged
(premises he forever thereafter barred
stud foreclosed.
And it is further ordered, that this
Rule be published in the ( Jkkknks

months, or a copy thereof be served
on said Respondent)* or their special
•agent at least three months before the
next term of this Court.
