now here to the presence of the Court
shown.
And it further appearing that said
principal, note, waiver, homestead
and stipulates that should any of said
interest not be paid when due, it.shall
hear interest from maturity at (lie
rate of 8 per cent per annum, unagreed
in said interest note, and that upon
failure to nay any of said interest
within 30days after due, said princi
pal sum may, at the option of said
Petitioner, or ivi.s Assignee, without
notice, be declared due, and may
thereupon be collected at once, time
being of the essence of (lie contract:
and that in case said note is collected
by suit, said makers will pay all costs
of collection, including ten per cent
of Attorney’s fees computed on said
principal and interest.
And it further appearing that said
coupon note for interest due Nov. 15tli.

the same is now past due and unpaid,
liy reason whereof, Petitioner elects

that the said Hiram It mi zee, Avariila

Rouzee are indebted to Petitioner tho
principal sum named in said note and
interest coupons, and interest there
on, and that although so indebted
and to pay said notes often requested,
have not paid the same or any part
thereof, but have hitherto, and do
now refuse to pay the same.
It is therefore ordered, that said
Hiram Rouzee, Avariila Randall,
Martha Rouzee and Cora Rouzee pay
into this Court hy the first day of the
next term thereof, tiie principal, in
terest and costs due on said promisso
ry note and coupon notes, together
with ten per cent on said principal
and interest as Attorneys fees, or
show cause to the contrary if any
there he; and that on failure of said
Respondents so to do, the equity of
redemption in and to said Morgagcd
premises be forever thereafter barred
anil foreclosed.
And it i further ordered, that this
little lie published in the Grkknks
bobo' Herald once a month for four
months, or a copy thereof be served
